HomeMy WebLinkAbout05634 ORD - 01/06/1960JAW:JKH:11 -3D -59 / AN ORDINANCE RECEIVING IN AND ANNEXING TO THE CITY OF CORPUS CHRISTI, TEXAS, A TERRITORY OF 31.644 ACRES ORE OR LESS, BEING MORE PARTICULARLY DESCRIBED HEREIN METES AND BOUNDS, IN NUECES COUNTY, TEXAS, AND ALSO KNOWN AS MALIBU HEIGHTS UNIT 1 AS SHOWN BY MAP AND FLAT HE T OF IN THE OF_FI OF THE COUNTY RECORDS OF NUECES COUNTY, TEXAS, OWNED IN FEE BY MAGEE DEVELOPMENT COMPANY; FULLY DESCRIBING THE SAME AS AN INTEGRAL PART OF THE CITY OF CORPUS CHRISTI AND DECLARING THE SAME A PART THEREOF, AND SUBJECT TO THE CONDITIONS, RULES, REGULATIONS, ORDINANCES AND CHARTER OF THE CITY OF CORPUS CHRISTI, TEXAS; PROVIDING FOR THE PUBLICATION AT LEAST ONE TIME OF THIS ORDINANCE IN A NEWSPAPER PUBLISHED IN THE CITY OF CORPUS CHRISTI. WHEREAS, THE CITY OF CORPUS CHRISTI, TEXAS, DID ON JUNE 10, 1959, AUTHORIZE AN, ANNEXATION AGREEMENT BY MAGEE DEVELOPMENT COMPANY, THE OWNER IN FEE SIMPLE OF THE HEREINAFTER DESCRIBED TERRITORY, AGREEING TO ANNEX AND INCORPORATE SAID TERRITORY INTO THE CORPORATE LIMITS OF THE CITY OF CORPUS CHRISTI•„ AND WHEREAS, THE SAID AGREEMENT TO ANNEX PROVIDED FOR THE ANNEXA- TION AND INCORPORATION INTO THE CORPORATE LIMITS OF THE CITY OF CORPUS CHRISTI, TEXAS, OF THE 31.644 ACRES OF LAND, MORE OR LESS,MORE PARTI- CULARLY DESCRIBED BY METES AND BOUNDS IN SECTION 1 HEREOF, AND BEING KNOWN AS MALIBU HEIGHTS, UNIT 1, AS SHOWN IN THE MAP RECORDS OF NUECES COUNTY, TEXAS; AND WHEREAS, THE ZONING AND PLANNING COMMISSION HAS RECOMMENDED THE ANNEXATION OF THE SAID 31.644 ACRES, AND THERE ARE NO RESIDENT VOTERS IN THE SAID TERRITORY, AND THE SAID TERRITORY IS ADJACENT AND ADJOINS THE CORPORATE LIMITS OF THE CITY OF CORPUS CHRISTI, TEXAS; AND WHEREAS, THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI DEEMS IT IN THE PRESENT INTEREST OF THE CITY THAT THE ABOVE DESCRIBED PROPERTY BE ADMITTED TO THE CITY OF CORPUS CHRISTI: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THERE IS HEREBY ANNEXED INTO THE CITY OF CORPUS CHRISTI, TEXAS, THE FOLLOWING DESCRIBED TERRITORY, TO -WIT: 563-1 M M SITUATED IN THE COUNTY OF NUECES, STATE OF TEXAS, AND BEING A 31.644 ACRE TRACT OF LAND OUT OF LOT THREE (3) BYRON WILLIS SUBDIVISION, NUECES COUNTY, TEXAS, AND BEING DESCRIBED BY METES AND BOUNDS AS FOLLOWS, TO -WIT: BEGINNING AT A POINT IN THE CENTERLINE OF WEBER ROAD, SAID POINT BEING THE NORTHWEST CORNER OF LOT 3, BYRON WILLIS SUBDIVISION, AS RECORDED IN VOL. 5, PAGE 46, DATED OCTOBER 14, 1930, NUECES COUNTY MAP RECORDS, NUECES COUNTY, TEXAS.
