AN ORDINANCE AMENDING ORDINANCE NO. 5096, BY AMENDING SECTION 4 OF SAID ORDINANCE SO AS TO PERMIT THE CONSTRUCTION OF A FISHING PIER IN THE AREA DESIGNATED AS 'A PORTION OF AVENUE A IN SAID ORDINANCE AND TO CONSTRUCT CONCRETE GROINS FOR BEACH EROSION CONTROL; AND DECLARING AN EMERGENCY. WHEREASS THERE IS PROVIDED IN ORDINANCE NO. 5o96 FOR THE CLOSING, TO VEHICULAR TRAFFIC, OF A PORTION OF AVENUE A IN THE CITY OF CORPUS CHRISTI, IN BROOKLYN ADDITION, AND BEING THAT PORTION OF AVENUE A EXTENDING FROM THE NORTH LINE OF VINE STREET (SOMETIMES KNOWN AS FOURTEENTH STREET) TO THE SOUTH BOUNDARY LINE OF THE STREET KNOWN AS "GOLF PLACE" IN BROOKLYN ADDITION IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; AND WHEREAS, SAID ORDINANCE ALSO RESERVES THE RIGHT IN THE CITY OF CORPUS CHRISTI TO REOPEN AT ANY TIME THE SAID PORTION OF AVENUE A AND RE- ESTABLISH THE SAME AS A PUBLIC STREET AND/OR FOR OTHER PURPOSES; AND WHEREAS, THE OWNERS OF THE PROPERTY ABUTTING SAID STREET ARE DESIROUS OF BUILDING A FISHING PIER ON THE EAST SIDE OF SAID PORTION OF AVENUE A CLOSED BY SAID ORDINANCE NO. 5o96 AND TO ERECT CONCRETE GROINS FOR BEACH EROSION CONTROL, ALL SUBJECT TO THE APPROVAL OF THE DIRECTOR OF PUBLIC WORKS OF THE CITY OF CORPUS CHRISTI AND SUBJECT TO THE SAME RIGHTS OF THE CITY TO REOPEN SAID AVENUE A AS A PUBLIC STREET, AND IT IS CONSIDERED BY THE COUNCIL THAT SAID CONSTRUCTION UNDER SUCH CONDITIONS WOULD -BE IN THE PUBLIC INTEREST: NQ4, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT ORDINANCE NO. 5o96 BE AND THE SAME IS HEREBY AMENDED BY AMENDING SECTION 4 TO HEREAFTER READ AS FOLLOWS: "SECTION 4. NO STRUCTURES SHALL BE CONSTRUCTED OR PLACED ON SAID PORTION OF THE AREA HERETOFORE KNOWN AS AVENUE A, THE PORTION OF THE ALLEY IN SAID BLOCK S OR ON THE WEST 150 FE-ET OF THE PORTION OF ELM STREET HEREBY CLOSED TO VEHICULAR TRAFFIC, PROVIDED, HOWEVER, THAT IN CONNECTION WITH THE USE OF THE PROPERTY ABUTTING SAID PORTION OF AVENUE A, ON THE WESTERN SIDE, THE OWNERS OF SAID PROPERTY MAY CONSTRUCT, ERECT AND MAINTAIN A FISHING PIER AND/OR CONCRETE GROINS FOR BEACH EROSION CONTROL, PROVIDED THE SAME 5GGO ARE CONSTRUCTED ACCORDING TO SPECIFICATIONS AND PLANS APPROVED BY THE DIREC- TOR OF PUBLIC WORKS OF THE CITY OF CORPUS CHRISTI AND SUBJECT TO-REMOVAL AS PROVIDED IN SECTION 3 OF ORDINANCE 5096.° SECTION 2. THE FACT THAT PUBLIC CONVENIENCE AND NECESSITY WILL BE BENEFITED BY THE PERMISSION TO USE SAID PORTION OF SAID AVENUE A WITH THE RESERVATIONS HEREIN PROVIDED TO THE CITY CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH - ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS P AGE IT IS ACCORDINGLY PASSED AND AP- PROVED, THIS THE U DAY OF�, 1960.
