AMENDING ORDINANCE NO. 3570, AS AMENDED, READOPTED
AS SECTION 3"7 OF THE CORPUS CHRISTI CITY.CODE,
1958, BY ADDING AN ADDITIONAL RESIDENTIAL INCENTIVE
SUMMER GAS RATE;, PROVIDING FOR THE PERIOD WHEN SUCH
RATE SHALL BE EFFECTIVE
WHEREAS, IT IS CONSIDERED BY THE CITY COUNCIL THAT THE
ADOPTION OF A SPECIAL GAS RATE FOR RESIDENTIAL USERS AND FOR COMMERCIAL
AIR CONDITIONING USERS APPLICABLE DURING THE SUMMER MONTHS OF THE YEAR
WHEN THE USUAL CONSUMPTION OF GAS IS BELOW THE AVERAGE MONTHLY CON-
SUMPTION BY RESIDENTIAL CONSUMERS, WOULD BE ADVANTAGEOUS TO THE
CUSTOMERS AND TO THE CITY.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT ORDINANCE NO. 3570, AS AMENDED, AND PAR-
TICULARLY ADOPTED AS SECTION 38 -47 OF THE CORPUS CHRISTI CITY CODE,
1958, BE AND THE SAME IS HEREBY AMENDED BY THE ADDITION OF THE FOLLOWING
PROVISIONS:
RESIDENTIAL INCENTIVE SUMMER GAS RATE AND
COMMERCIAL CONSUMER AIR CONDITIONING RATE
APPLICABLE FOR THE BILLING MONTHS OF MAY
THROUGH OCTOBER OF EACH YEAR INCLUSIVE.
ALL RESIDENTIAL CUSTOMERS, UNLESS OTHERWISE REQUESTED BY THE
CUSTOMER, SHALL BE BILLED FOR THE BILLING MONTHS OF MAY THROUGH OCTOBER,
INCLUSIVE; AND ALL COMMERCIAL OR INDUSTRIAL CUSTOMERS WHO USE GAS
OPERATED AIR COOLING AND AIR CONDITIONING EQUIPMENT WHO REQUEST IN
WRITING AS A SUPPLEMENT TO THE GAS SUPPLY CONTRACT SHALL, UNDER RULES
AND RESTRICTIONS HEREINAFTER PROVIDED, BE BILLED AT THE FOLLOWING RATE:

ALL COMMERCIAL OR INDUSTRIAL CUSTOMERS USING GAS OPERATED
AIR COOLING AND AIR CONDITIONING EQUIPMENT WHO REQUEST, IN WRITING, AN
AIR CONDITIONING SUPPLEMENT TO THEIR GAS SUPPLY CONTRACT SHALL BE BILLED
AT THE SPECIAL RATE OF 35¢ PER MCF FOR A VOLUME WHICH SHALL BE DETERMINED
MONTHLY ON THE BASIS OF THE NUMBER OF TONS OF INSTALLED AIR CONDITIONING
CAPACITY IN ACCORDANCE WITH THE FOLLOWING SCHEDULE:

IT IS A CONDITION OF THE AVAILABILITY OF THE FOREGOING
COMMERCIAL GAS AIR CONDITIONING RATE THAT ALL GAS CONSUMPTION UP TO
6,000 CUBIC FEET AND IN EXCESS OF'•THE VOLUME BILLED IN ACCORDANCE WITH
THE FOREGOING SCHEDULE SHALL BE BILLED AT THE COMMERCIAL RATE SCHEDULE
OTHERWISE APPLICABLE.
