AN ORDINANCE
AN ORDINANCE CANCELLING $16,801.30 HERETOFORE
APPROPRIATED BY ORDINANCE # 5268; CANCELLING $10,571.55
OF FUNDS APPROPRIATED BY ORDINANCE 1 -5424, CANCELLING
THE APPROPRIATION OF $252,653.69 FROM THE APPROPRIATION
PROVIDED IN ORDINANCE -# 5250; CANCELLING THE APPROPRIA-
TION OF $128.50 APPROPRIATED BY ORDINANCE #5157; CAN-
CELLING THE APPROPRIATION OF $400.00 APPROPRIATED IN
ORDINANCE #5476;AND DIRECTING THAT THE AMOUNT OF APPRO-
PRIATION HEREBY CANCELLED IN THE AMOUNT OF $280,555.04
REVERT TO AND BECOME A PART OF THE BRIDGE BOND FUND 230;
AND DECLARING AN EMERGENCY.
WHEREAS, Ordinance x#5268 appropriated $391,752.00 for a construction con-
tract to Heldenfels for Grading: South Approach, Savage Lane Line, Joint
Yard, Interchange Yard, and Corn Products Road, and $18,248 for contin-
gencies; and whereas.Ordinance x#5587 appropriated $67,732.28 for the
same project for change order #2; and whereas change orders #1 ($290.70),
#3 ($578.00), and 9 ($578.00) are the only charges against the contingency
appropriation; and whereas project changes have caused the actual contract
to be less than the contract appropriation; and
WHEREAS -, Ordinance #5424 appropriated $76,340 for the purchase of.railroad
materials; and whereas the City has expended $54,198.33 for railroad mater-
ials, $10,685.91 for freight costs and $460.01 for unloading costs, and
wher a a contested freight bill in the amount of $424.20 is outstanding
agai t this project; and whereas the City has now determined that it does
not de ire to exercise its option to purchase more materials under this
contra t; and
WHERRea The City Council appropriated $796,750 by Ordinance #5250 for the
purchas of rights -of -way; and whereas the City has also passed numerous other
appropri tion ordinances for the same purpose and the same project; (North
and South Approaches, Interchange Yard, Savage Lane Yard, and Corn Products
Road), and whereas a balance of $252,653.69 exists in this project
appropriation; and
WHEREAS, The City Council in Ordinance ¢5157 appropriated $128.50 for the
appraisal of the KEYS Radio Tract by Gregory Moore; and whereas the City
Council appropriated $400.00 by Ordinance #5476 for the appraisal of the
S. A. Uvalde and Gulf Railroad properties by Gregory Moore; and whereas
the project plans have since been modified to exclude these two properties;
and whereas Mr. Gregory Moore has done no work on these parcels; and

WHEREAS, by the cancellation of said amounts there will be available
the total sum of $280,555.04 in the Bridge Bond Fund 230 for other and
future use in connection with the Bascule Bridge Relocation Project:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. The contingency appropriation to the extent of the
amount of $16,801.30 heretofore appropriated by Ordinance ¢5268 for
Project 230- 55 -5.1, Construction Contract, Heldenfels Bros., Contractor,
is hereby cancelled.
SECTION 2. The appropriation to the extent of the amount of
$10,683.91 heretofore appropriated by Ordinance #5424 for project
230- 55 -8.2, Railroad Materials - E. L. Cole, is hereby cancelled.
SECTION 3. The appropriation to the extent of the amount of
$252,653.69 heretofore appropriated by Ordinance ¢5250 for Project
230 -55 -9, Right -of -Way, in connection with the Bascule Bridge Relo-
cation Project, is hereby cancelled.
SECTION 4. The appropriation to the extent of $128.50 heretofore
appropriated by Ordinance #5157 for Project 230 -55 -9.38, Right -of -Way, —
KEYS Tract, is hereby cancelled.
SECTION 5. The appropriation to the extent of the amount of
$400.00 heretofore appropriated by Ordinance #5476 for Project 230 -55 -9.39,
Right -of -Way, Uvalde and Gulf Railroad Tract is hereby cancelled.
SECTION 6. The total amount of the items cancelled in Sections
1, 2, 3, 4, and 5 is hereby ordered to revert to and be placed in
Bridge Bond Fund 230 subject to further appropriation by the Council.
SECTION 7. The necessity for the cancellation for unused portions
for sums heretofore appropriated so as to make said amounts available for
future appropriation creates a public emergency and an imperative public
necessity requiring the suspension of the Charter Rule that no ordinance
or resolution shall be passed finally on the date of its introduction
and that such ordinance or resolution shall be read at three several meetings
of the City Council, and the Mayor, having declared such emergency and
necessity to exist, having requested the suspension of said Charter Rule
and that this ordinance be passed finally on the date of its introduction
and that this ordinance take effect and be in full force and effect from
and after its passage, IT IS ACCORDINGLY PASSED AND APPROVED, this the
day of March, 1960.

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE-
GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE
SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLU-
TION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED AND THAT SUCH
ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL;
1, THEREFORE HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIRE-
MENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRODUCEDS OR AT THE
PRESENT MEETING OF THE CITY COUNCIL.
