OF THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, RECEIVING AND ACCEPTING THE WORK OF IMPROVING THE HEREIN DESCRIBED PORTIONS OF AGNES, LAREDO, SIXTEENTH, TWENTY -FIRST AND ALAMEDA STREETS WITHIN THE CITY OF CORPUS CHRISTI, TEXAS; AUTHORIZING AND DIRECTING THE EXECUTION AND ISSUANCE OF SPECIAL ASSESSMENT CERTIFICATES TO BROWN & ROOT, INC.; APPROVING THE FORM OF SUCH SPECIAL ASSESSMENT CERTIFICATES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, IN MEETING DULY ASSEMBLED: SECTION 1. That the work of improving the following streets within the indicated limits, to -wit: AGNES STREET, from Port Avenue to Staples Street, LAREDO STREET, from Agnes Street to Staples Street, SIXTEENTH STREET, from Agnes Street to Laredo Street, ALAMEDA STREET, from Agnes Street to Laredo Street, TWENTY -FIRST STREET, from Agnes Street to Laredo Street, by raising, grading, filling, widening, permanently paving and repaving same, and by the construction, reconstruction, repairing or realigning of concrete sidewalks, curbs, gutters and driveways, and by the construction of such drains and other necessary inci- dentals and appurtenances as deemed necessary by the City Engi- neer, said permanent paving consisting of an adequate asphaltic wearing surface upon a substantial base course, both of such type, construction, materials and thickness as have been deemed adequate and proper by said City Engineer, and all of said im- provements being as provided for in the Plans and Specifications therefor which have heretofore been prepared by the City Engi- neer and as have been approved and adopted by the City Council; 5 f?o1 and all of same having been performed and completed in full accordance with all the terms and provisions of the contract dated December 29, 1958, between said City of Corpus Christi, Texas, and Brown & Root, Inc.; and said City Engineer having measured, examined and caused to be tested the finished improve- ments by the means and in the manner provided by the terms of said contract and the Plans and Specifications, and having found that such improvements have been constructed and completed in full compliance with all provisions of said contract and said Plans and Specifications, and said City Engineer having approved and accepted said work and improvements and having heretofore issued his Certificate of Final Acceptance, and so certified to said City Council and recommended that it accept and receive said work and the improvements as constructed and completed by said Brown & Root, Inc., and said work and improvements having been examined and found by the Mayor and City Council of said City of Corpus Christi, Texas, to have been performed and completed by Brown & Root, Inc., in full compliance with the terms and provisions of said contract and said Plans and Specifications therefor, and same are hereby accepted and received by said City Council of the City of Corpus Christi, Texas. SECTION 2. That the Mayor and City Secretary of the City of Corpus Christi, Texas, are hereby authorized and directed to execute and issue to Brown & Root, Inc., Special Assessment Cer- tificates evidencing the assessments levied against the properties improved abutting upon said portions of said streets and against the real and true owners thereof, which, by the terms of said contract, the City of Corpus Christi, Texas, has agreed and obligated itself to issue and deliver to said Brown & Root, Inc., in accordance with the provisions of the relative proceedings heretofore had and adopted by said City Council; said Special Assessment Certificates to be executed in the name of said City - 2 - by its Mayor and City Secretary, and impressed with the seal of said City, and dated as of the date hereof, and such officers are hereby authorized and directed to execute said certificates in their official capacities on behalf of said City, and deliver same to said Brown & Root, Inc., said Special Assessment Certifi- cates having heretofore been prepared and printed, a copy of which is on file with the City Secretary, the form and contents thereof being hereby approved and adopted. SECTION 3. The fact that the improvements to said above described streets have been completed by Brown & Root, Inc., con- tractor, which is entitled to receive its payment therefor, creates a public emergency and public imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three several meet- ings of the City Council, and the Mayor having declared that such public emergency and imperative necessity exist and having requested that such Charter rule be suspended and that this Ordi- nance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage; IT IS ACCORDINGLY SO ORDAINED, Passed and approved this a day of , 1960.
