HomeMy WebLinkAbout05710 ORD - 03/16/1960AN ORDINANCE AN ORDINANCE CANCELLING THE APPROPRIATION OF $270,000 OF FUNDS APPROPRIATED BY ORDINANCE #5265; AND CANCELLING $13,738 OF $361,738 APPROPRIATED BY ORDINANCE #5547; AND DIRECTING THAT THE AMOUNT OF APPROPRIATION HEREBY CAN- CELLED IN THE AMOUNT OF $283,738 REVERT TO AND BECOME A PART OF THE BRIDGE BOND FUND #230, AND DECLARING AN EMERGENCY. WHEREAS, Ordinance ¢5265 appropriated the sum of $270,000 for the purchase of certain properties from Bertha Weil, Alex Weil, M. Harvey Weil, Adele H. Weil, William H. Cohen, Trustee, and Moise Weil, owners, in connec- tion with the Tule Lake Lift Bridge project and the resulting relocation of certain roads, railroads, and rail yards; and whereas 13 months have passed since the passage of the original appropriation without the completion of the negotiations for the afore mentioned land; and whereas the current estimate of the cost of the above mentioned land is approximately $94,000 less than the original estimate; and whereas it is desirable to cancel the above mentioned appropriation; and WHEREAS, Ordinance X65547 appropriated $316,738 out of Bridge Bond Fund #230 for engineering costa due and to be due Harrington and Cortelyou, Engineers, under their contract with the City; and whereas revised estimates of the total project cost under the above mentioned engineering contract in- dicate that the total cost of engineering will be approximately $306,000; and whereas the balance of the above mentioned appropriation of $13,738 is now in excess of estimated engineering costs; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TESAS: SECTION 1. The appropriation of $270,000 heretofore appropriated by Ordinance #5265 for project ¢230 -55 -9.27, Right -of -Way; B. Weil, et al, tract is hereby cancelled. SECTION 2. The appropriation to the extent of the amount of $13,738 heretofore appropriated by Ordinance ¢5547 for project #230- 55 -11, Engineering; Harrington and Cortelyou, is hereby cancelled. SECTION 3. The total amount of the items cancelled in Section 1 and 2 is hereby ordered to revert to and be placed in Bridge Bond Fund #230 subject to further appropriation by the Council. & SECTION 4. The necessity for the cancellation for unused portions for sums heretofore appropriated so as to make said amounts available for future appropriation creates a public emergency and an imperative public necessity requiring the suspension of the Charter Rule that no ordinance or resolution shall be passed finally an the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, having requested the suspension of said Charter Rule and that this ordinance be passed finally on the date of its introduction and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY PASSED AND APPROVED, this the day of March, 1960. • C MAYOR' THE CITY OF ORPUS 61STI, TEXAS ATTES�i City Secre ar i APPROVED AS TO LEGAL FORM THHIS I e_ SAY OF MARCH, 1960.
