AN ORDINANCE
AMENDING AN ORDINANCE N0. 4563 ENTITLED "ESTABLISHING
RULES, REGULATIONS AND FEES APPLICABLE IN CONTROL AND
ADMINISTRATION OF UTILITY TAPS OR SERVICE CONNECTIONS
FOR CITY OWkb UTILITIES, REPEALING ALL OTHER ORDINANCES
IN CONFLICT HEREWITH AND DECLARING AN EMERGENCY", PASSED
AND APPROVED ON THE 27TH 'DAY OF JUNES 1956, .AS AMENDED,_
BY AMENDING SUBSECTION B (3)'& RULE 5, SECTION 1, OF
SAID ORDINANCE 2307 SO AS TO PROVIDE FOR AN INCREASE IN
WATER TAP FEES FOR TAPS IN STREETS AND EASEMENTS OUTSIDE
OF THE CITY LIMITS OF THE CITY_OF_CORPUS,CHRISTI, AND
DECLARING AN EMERGENCY.
WHEREAS, DUE TO THE INCREASED COST OF THE INSTALLATION AND
MATERIALS INCORPORATED IN MAKING WATER CONNECTIONS, WHICH IS NOT
REFLECTED IN THE INITIAL TAP FEES SET OUT IN ORDINANCE N0. 4563, AS
AMENDED, IT IS NECESSARY TO AMEND SAID ORDINANCE AS HEREINAFTER SET
OUT:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT ORDINANCE N0. 4563, PASSED AND APPROVED BY
THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI ON THE 27TH DAY OF JUNE,
1956, AND ENTITLED "ESTABLISHING RULES, REGULATIONS AND FEES APPLICABLE
IN CONTROL AND ADMINISTRATION OF UTILITY TAPS OR SERVICE CONNECTIONS
FOR CITY OWNED UTLLITIES, REPEALING ALL OTHER ORDINANCES IN CONFLICT
HEREWITH AND DECLARING AN EMERGENCY ", AS AMENDED, BE, AND THE SAME IS
HEREBY AMENDED TO PROVIDE FOR AN INCREASE IN WATER TAP FEES IN STREETS
AND IN EASEMENTS OUTSIDE THE CITY LIMITS OF THE CITY OF CORPUS CHRISTI
BY AMENDING SUBSECTION B (3) OF RULE 5, SECTION 1 THEREOF TO HEREAFTER
READ AS FOLLOWS:

*THE DIRECTOR OF PUBLIC UTILITIES UPON APPROVAL OF DIRECTOR OF PUBLIC
WORKS MAY SPECIFY A REDUCTION OF FEES BASED ON CIRCUMSTANCES, PRO-
VIDED ONLY, THAT THEY SHALL NOT BE LESS THAN THE COST THEREOF, AND PROVIDED
FURTHER THAT SUCH SHALL APPLY ONLY WHERE THE DISTRIBUTION LINE IN NEW
SUBDIVISIONS IS AS SHOWN ON THE PLAT THEREOF LOCATED WITHIN THE AREA
BETWEEN THE PROPERTY LINE AND THE CURB -LINE THE CHARGE MAY BE REDUCED SO
AS TO CHARGE THE FEE PROVIDED, IN INSTANCES WHERE THE LINE IS IN THE
EASEMENT, FOR ALL TAPS FOR PROPERTY ABUTTING THAT SIDE OF THE STREET OR
PORTION OF STREET AND THAT THE FEE PROVIDED FOR STREET TAPS BE CHARGED
FOR TAPS FOR ALL OTHER PROPERTY ON THE STREET.
SECTION 2. THE NECESSITY FOR CHANGING ASSESSMENT OF TAP FEES
CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING
THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE
OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL,
AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND
HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED, AND THAT THIS ORDI-
NANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT
AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS
ACCORDINGLY SO ORDAINED.

SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLU-
TION SHALL BE PASSED FINALLY ON THE DATE 17 15 INTRODUCED AND THAT SUCH
ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL;
I, THEREFOREp HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIRE-
MENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRODUCEDO OR AT THE
PRESENT MEETING OF THE CITY COUNCIL.
