AH:4 -t5 -6o 0 AN ORDINANCE APPROPRIATING OUT OF STREET BOND IMPROVEMENT FUND NO. 220 THE SUM OF $169,475.00 FOR THE ACQUISITION OF 17 PARCELS OF PROPERTY FOR RIGHT OF WAY REQUIRED BY THE STATE OF TEXAS AND APPLICABLE TO PROJECT NO. 220 -56 -24 CROSSTOWN EXPRESSWAY HIGHWAY 286 RELOCATED, A COPY OF 9FTI CH PARCE L I ST S ATTACHED HERETO AND MADE A PART HEREOF; AUTHORIZING AND DIRECTING THE'CITY MANAGER TO EXECUTE REAL ESTATE SALES CONTRACTS, FOR AND ON BEHALF OF THE CITY OF CORPUS CH_R STI, FOR THE ACQUISITION OF SAID PARCELS, WHEN AND ONLY�WHEN THE WHEREAS, THE CITY COUNCIL HAS PREVIOUSLY, BY ORDINANCE NOS. 1797 AND 1798, AUTHORIZED THE CITY MANAGER TO ENTER INTO A CONTRACT WITH THE HIGHWAY DEPARTMENT OF THE STATE OF TEXAS WHEREBY THE CITY AGREED TO PURCHASE THE NECESSARY RIGHT OF WAY FOR STATE HIGHWAY NO. 286, COMMONLY KNOWN AS THE CROSSTOWN EXPRESSWAY, AND THE STATE OF TEXAS, ACTING BY AND THROUGH ITS HIGHWAY DEPARTMENT, AGREED TO DETERMINE EACH PARTICULAR PARCEL OR TRACT OF LAND TO BE ACQUIRED AND TO APPRAISE SAID LAND AND TO SET AN "APPROVED VALUE" UPON EACH OF SAID TRACTS AND TO REIMBURSE THE CITY FOR ONE -HALF OF THE COST THEREOF; AND WHEREAS, IT IS NECESSARY TO AUTHORIZE THE CITY MANAGER TO EXECUTE REAL ESTATE SALES CONTRACTS FOR THE PURCHASE OF THE NECESSARY TRACTS OR PARCELS OF LAND, AS DESIGNATED BY THE STATE OF TEXAS, BY AND THROUGH ITS HIGHWAY DEPARTMENT, AND TO APPROPRIATE THE NECESSARY FUNDS FOR THE ACQUISITION THEREOF: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THERE IS HEREBY APPROPRIATED THE SUM OF $169,475,00 FROM STREET BOND IMPROVEMENT FUND N0. 220 FOR THE ACQUISITION OF 17 PARCELS OF PROPERTY FOR RIGHT OF WAY REQUIRED BY THE STATE OF TEXAS FOR THE CROSSTOWN EXPRESSWAY, HIGHWAY 286 RELOCATED, PROJECT N0. 220- 56 -24, A COPY OF WHICH PROPERTY LIST IS ATTACHED HERETO AND MADE A PART HEREOF. IT BEING THE INTENTION OF THE COUNCIL TO APPROPRIATE FUNDS TO COVER THE 5736 AFOREM €NMIONED PURCHASES BUT IT IS THE INTENTION OF THE COUNCIL TO SEEK REIMBURSEMENT OF THE STATE OF TEXAS, FOR ONE -HALF OF THE PURCHASE PRICE OF EACH TRACT OR PARCEL PURCHASED FROM THE HIGHWAY DEPARTMENT OF THE STATE OF TEXAS. SECTION 2. THAT THE CITY MANAGER IS HEREBY AUTHORIZED AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI REAL ESTATE SALES CONTRACTS WITH THE OWNERS,.OF THOSE PARCELS OR TRACTS OF LAND DESIGNATED BY THE TEXAS HIGHWAY DEPARTMENT AS NEEDED FOR STATE HIGHWAY ND. 286 RELOCATED, THE CROSSTOWN EXPRESS- WAY, WHEN AND ONLY WHEN THE PARCEL OR TRACT HAS BEEN DESIGNATED BY THE STATE HIGHWAY DEPARTMENT AS NEEDED FOR SAID PROJECT, AND WHEN THE SALES CONTRACT IS FOR AN AMOUNT OF MONEY WITHIN THE "APPROVED VALUE" AS SET AND DETERMINED BY THE STATE HIGHWAY DEPARTMENT. SECTION 3. THE PUBLIC IMPORTANCE OF MAKING FUNDS AVAILABLE AND IN BEGINNING THE PURCHASING OF THE NECESSARY RIGHT OF WAY SO THAT THE STATE HIGHWAY N0. 286 RELOCATED CROSSTOWN EXPRESSWAYS PROJECT MAY BE BEGUN IMMEDIATELY CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCILS AND THE MAYORS HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRO- DUCTION AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY PASSED AND APPROVED, THIS DAY OF APRIL, 1960.
