AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND
ON BE LF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE
AND DELIVER TO THE OWNERS OF THAT PORTION OF FARM
LOT 5, J. P. CONNELL FARM LOTS, NUECES COUNTY, TEXAS,
EXCEPT THOSE PORTIONS OF SAID FARM LOT UPON WHICH
PUBLIC STREETS, ROADS AND RIGHTS OF WAY HAVE BEEN
DESIGNATED, DEDICATED OR CONVEYED, A RELEASE FROM
THE BURDEN OF THE RIGHT OF WAY AND PIPELINE EASEMENT
DATED JULY 18, 194 , RECORDED IN VOL. 281, PAGE
OF THE DEED RECON DS OF NUECES COUNTY, TEXAS; AND
DECLARING AN EMERGENCY.
WHEREAS, ON ABOUT JULY 18, 1940, THE OWNER OF FARM LOT 5
OF J. P. CONNELL FARM LOTS, ACCORDING TO MAP OF RECORD INTHE OFFICE
OF THE COUNTY CLERK OF NUECES COUNTY, TEXAS, EXECUTED AND DELIVERED
A RIGHT OF WAY TO LAY, MAINTAIN AND OPERATE A PIPELINE ACROSS SAID
FARM LOT 5 TO THE CITY OF CORPUS CHRISTI, WHICH EASEMENT IS OF RECORD
IN VOL. 281, PAGE 484 OF THE DEED RECORDS OF NUECES COUNTY, TEXAS; AND
WHEREAS, SAID PIPELINE WAS INSTALLED AND SAID EASEMENT
DEDICATED AND IS NOW LOCATED WITHIN THE RIGHT OF WAY OF BALDWIN BOULE-
VARD, A STREET WITHIN THE CITY LIMITS OF THE CITY OF CORPUS CHRISTI,
TEXAS, AND THE BALANCE OF SAID FARM LOT 5 SHOULD BE RELEASED FROM THE
BURDEN OF SAID EASEMENT:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THE CITY MANAGER IS HEREBY AUTHORIZED AND
DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE
AND DELIVER TO THE OWNERS OF THAT PORTION OF FARM LOT 5, J. P. CONNELL
FARM LOTS, NUECES COUNTY, TEXAS, EXCEPT THOSE PORTIONS OF SAID FARM
LOT 5 UPON WHICH PUBLIC STREETS, ROADS AND RIGHTS OF WAY HAVE BEEN
DESIGNATED, DEDICATED OR CONVEYED, A RELEASE FROM THE BURDEN OF THE
RIGHT OF WAY AND PIPELINE EASEMENT DATED JULY 18, 1940, RECORDED
IN VOL. 281, PAGE 484 OF THE DEED RECORDS OF NUECES COUNTY, TEXAS.

SECTION 2. THE NECESSITY FOR REMOVING THE BURDEN FROM THE
BALANCE OF FARM LOT 5 CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE
PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO
ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS
INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT
THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING
DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE
SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED
FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINACE TAKE
EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE,

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE-
GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE
SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLU-
TION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH
ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL;
I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIRE-
MENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE
PRESENT MEETING OF THE CITY COUNCIL.
