RECEIVING AND ACCEPTING THE WORK OF CONSTRUCTION OF
STORM SEWERS IN THE MOLINA AND 11TH STREET AREAS,
DESIGPIATED'AS PROJECTS NO. 295 -54 -11 AND 295 -5 - 14.2;
AUTHORIZING PAYMENT TO THE CONTRACTOR, LEWIS A. FOWLER,
IN THE AMOU�NT �OF HIS FINAL ESMIATE NO. 5 IN THE AMOUNT

FUNS.PREVIOUSLY APPROPRIATED IN THE ALIOUNT OF $13,467.31;
APPROPRIATING THE STM OF 1 162.-1 FROM UNALLOCATED NO.
295 STORM SEWER. BOND FUT4DS AND AUTHORIZING PAYMENT
THEREOF ON SAID FINAL ESTIMATE: AIM DECLARING AN II�RGENCY.
BE IT ORDAITJED BY THE CITY COUNCIL OF THE CITY OF CORPUS CIRISTI,
SECTION 1. That the construction of storm sewers in connection
with Molina and 11th Street areas, designated as projects No. 295 -54 -11
and 295 -56 -14.2, performed by Lewis A. Fowler, contractor, under his con-
tract with the City dated November 20, 1959, as authorized by Ordinance
bIo• 5558, having been performed and completed in accordance with the terms
and provisions of the contract, plans and specifications therein contained
and the Director of Public Works having inspected the same and certified
to the completion of said work in accordance with said plans and specifi-
cations, the work aforesaid is hereby found to have been completed in
accordance with said plans and specifications and is here and now accepted
and received by the City Council o£ the City of Corpus Christi, Texas.
SECTION 2. That final payment due under the contract and
as set out in the final estimate attached hereto and made a part hereof,
prepared by the Director of Public Works, dated APRIL 1.8, 1960, in the
amount of $14,629.62 from remaining No. 295 Storm Sewer Bond Funds
previously appropriated, in the amount of $13,467.31, and appropriation
o£ an additional $1,162.31 from Unallocated No. 295 Funds, is hereby
authorized.
SECTION 3. That the necessity for completion of such project
by said acceptance and final payment immediately creates a public emer-
gency and an imperative public necessity requiring the suspension of the
Charter Rule that no Ordinance or Resolution shall be passed finally on

the date of its introduction and that such Ordinance or Resolution shall
be read at three several meetings of the City Council, and the Mayor,
having declared such emergency and necessity to exist, having requested
the suspension of said Charter Rule and that this Ordinance be passed finally
on the date of its introduction and that this Ordinance take effect and
be in full force and effect from and after its passage, IT IS ACCORDINGLY
PASSED AND APPROVED, this the Z 7day of ,196o.

GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FUR THE
SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLU-
TION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH
ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL;
I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIRE-
MENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE
PRESENT MEETING OF THE CITY COUNCIL.
