HomeMy WebLinkAbout05746 ORD - 04/27/1960• BWS:Mw 4 -27-60 • AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE A SUPPLEMENTAL AGREEMENT WITH SCOTT ELECTRIC COMPANY FOR THE CONSTRUCTION OF THE LIGHTING OF THE RUN -UP PAD AT THE NORTHWEST END OF RUNWAY 13 -31 AT THE NEW CORPUS CHRISTI MUNICIPAL AIRPORT, FOR A TOTAL COST OF $2, '84.50; AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE A CHANGE ORDER, ORDERING SCOTT ELECTRIC COMPANY TO DELETE CERTAIN ITEMS OF LIGHTING CONSTRUCTION PREVIOUSLY PLANNED IN THE AREA OF SAID RUN -UP PAD FOR A TOTAL DEDUCTION OF $2,036.49; APPROPRIATING THE SUM OF $214$.01 FROM AIRPORT BOND FUND NO. 245 FOR PROJECT NO. 245- 56 -7.1 TO COVER THE DIFFERENCE IN THE CONSTRUCTION COST BETWEEN THE SUPPLEMENTAL AGREEMENT AND THE CHANGE ORDER; AND DECLARING AN EMERGENCY. • BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THE CITY MANAGER IS HEREBY AUTHORIZED AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A SUPPLEMENTAL AGREEMENT WITH SCOTT ELECTRIC COMPANY, WHICH ADDS THE LIGHTING OF THE RUN -UP PAD AT THE NORTHWEST END OF RUNWAY 13 -31 AT THE NEW CORPUS CHRISTI MUNICIPAL AIRPORT TO THE AGREEMENT PREVIOUSLY ENTERED INTO BY AND BETWEEN THE CITY OF CORPUS CHRISTI AND SCOTT ELECTRIC COMPANY DATED APRIL 2, 1959, WHICH AGREEMENT WAS FOR RUNWAY AND TAXIWAY LIGHTING AT THE CORPUS CHRISTI MUNICIPAL AIRPORT. A COPY OF THE AFORESAID SUPPLEMENTAL AGREEMENT IS ATTACHED HERETO AND MADE A PART HEREOF FOR ALL PURPOSES AS IF COPIED VERBATIM HEREIN. SECTION 2. THE CITY MANAGER IS HEREBY AUTHORIZED AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A CHANGE ORDER WITH SCOTT ELECTRIC COMPANY UNDER AIRPORT PROJECT No. 245- 56 -7.1, C.Q.A. PROJECT No. 9- 41- 156 -5M803, WHEREBY CERTAIN CONSTRUCTION ITEMS CONCERNED WITH THE LIGHTING OF THE AREA WHERE THE RUN-UP PAD IS TO BE ADDED ARE DELETED, FOR A TOTAL DELETION of $2,036.49, A COPY OF SAID CHANGE ORDER BEING ATTACHED HERETO AND MADE A PART T HEREOF. SECTION 3. THE SUM OF $248.01 1S HEREBY APPROPRIATED OUT OF AIRPORT BOND FUND No. 245, FOR. PROJECT No. 245- 56 -7.1, TO COVER THE DIFFERENCE IN THE CONSTRUCTION COST BETWEEN THE SUPPLEMENTAL AGREEMENT AND THE CHANGE ORDER. 5746 • r t SECTION 4. THE TOTAL CONSIDERATION DUE AND OWING BY THE CITY OF CORPUS CHRISTI TO SCOTT ELECTRIC COMPANY FOR THE CONSTRUCTION OF THE LIGHTING OF THE RUN -UP PAD AT THE NEW CORPUS CHRISTI MUNICIPAL AIRPORT, AS SET OUT IN THE SUPPLEMENTAL AGREEMENT, SHALL NOT EXCEED THE SUM OF $2,284.50. SECTION 5. THE NECESSITY OF BEGINNING CONSTRUCTION IMMEDIATELY OF THE LIGHTING OF THE RUN -UP PAD AT THE NEW CORPUS CHRISTI MUNICIPAL AIRPORT SO THAT CONSTRUCTION MAY BE COMPLETED AS SCHEDULED CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY PASSED AND APPROVED, THIS THE 2 7 DAY OF i i _1 , 1960.
