ROAD , ALL AS MORE FULLY DESCRIBED HEREINAFTER, FOR THE PURPOSE OF CONSTRUCT- ING A 42 -INCH WATER LINE COPY OF SUCH AGR EME BEING ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER IS HEREBY AUTHORIZED AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, CONSENT AGREEMENTS WITH THE STATE HIGHWAY DEPARTMENT WHICH APPROVES THE INSTALLATION OF A 42 -INCH WATER LINE TO BE CONSTRUCTED UNDER STATE HIGHWAY NO. 286, APPROXIMATELY 74 FEET NORTHEAST OF TEX -MEX RAILROAD NAVAL BASE SPUR) CROSSING; ON WEST SIDE OF STATE HIGHWAY 358 FROM APPROXIMATELY 600 FEET NORTH OF KOSAR ROAD TO AN EXISTING 48° WATER LINE LOCATED APPROXIMATELY 200 FEET SOUTH OF FOREST LANE; AND CROSSING F.M. 665 APPROXIMATELY 82 FEET NORTHEAST OF TEX -MEX RAILROAD NAVAL BASE SPUR) CROSSING, A COPY OF SUCH AGREEMENTS BEING ATTACHED HERETO AND MADE A PART HEREOF. SECTION 2. THE NECESSITY TO EXECUTE THE CONSENT AGREEMENTS AS OUTLINED IN SECTION 1 HEREOF CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY PASSED AND APPROVED THIS THEE{ /A AY of MAY, 1960. It is expressly understood that the State Highway Department does not purport, here- by, to grant any right, claim, title, or easement in or upon this highway; and it is further understood that the State $ighway Department may require the owner at his own expense to relocate this line, subject to provisions of governing laws, by giving thirty (30) days written notice. All work on the highway right -of -way shall be performed in accordance with Highway Department instructions. That your line shall be placed through a hole bored beneath the highway. 2. That your line shall be placed through an iron caning, said casing to extend from right -of -way line to right -of -way line, and satis- factory vents provided at each end. 3. That all borings on paved highways shall extend for the full width of the pavin& and ten (10) feet on each side thereof or for the full width of the roadbed, as the case may be. For gravel or earth roads, the borings shall extend for the full width of the roadbed in all cases. 4. That casing shall be of approximately the same diameter as the bored hole. 5. That all pipes shall be 18" beneath grade line in ditches and well covered in order not to interfere with the blading of ditches. 6. That all backfill of trenches shall be thoroughly compacted, excess dirt disposed of and right- of-way reshaped to its original section. That it is expressly agreed that the said company will provide, at their own expense, all repairs of leaks that develop without delay. 2. That the top of the pipe line shall be placed a minimum of 18" below the existing surface. 3. That the pipe will be so placed as to have full bearing on the bottom of the trench and after the pipe has been laid, the trench shall be properly back - filled for its entire width and length. Any excess excavation material not required to provide the necessary backfill shall be removed from the highway right -of -way and disposed of by said company. 4. If it is necessary to revise the existing roadway section adjacent to the right -of -way line to permit the installation of this pipe line, that sub- sequent to completion of the pipe line and all backfill, the original roadway section will be restored to its original section. 5. That in modifying the existing roadway section to permit the construction of this pipe line, at no time will the existing roadway ditch be blocked to prevent drainage. 6. That ingress and egress at all private drives and county road approaches will be provided at all times. 7. That any private or county roadside structures that are moved to permit the installation of this pipe line shall be restored, or replaced, in a condition comparable to the condition existing prior to their removal. 8. That necessary barricades and warning signs will be provided during the construction to safeguard and direct traffic on the highway, and at all private drives and county road intersections. 9. That parking of cars and trucks belonging to employees on both sides of the pavement will be prohibited and that all such vehicles shall be parked on one side of the road and in no instance closer than a minimum of 8 feet from the edge of the pavement. 10. That no construction equipment or materials which would be hazardous to the traveling public will be left on the shoulders of the highway during the night. U.
