HomeMy WebLinkAbout05804 ORD - 07/06/1960JKH:7 -6 -60 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565 ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 2266 PASSED AND APPROVED ON THE 4TH DAY OF MAY, 1948, APPEARING OF RECORD IN VOLUME 16, PAGES 339 ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS, AND AS AMENDED BY ORDINANCE NO. 4846, ADOPTED ON THE 21ST DAY OF AUGUST, 19572 APPEARING OF RECORD IN VOLUME 26, PAGES 385 ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS, BY AMENDING THE ZONING MAP BY CHANGING THE ZONING OF GULFGATE UNIT 1, BEING THAT PROPERTY LOCATED AT THE NORTHEAST CORNER OF THE INTERSECTION OF AIRLINE ROAD AND LEXINGTON BOULEVARD IN THE CITY OF CORPUS CHRISTI, FROM "B -1" NEIGHBORHOOD BUSINESS DISTRICT TO "B -3" SECONDARY BUSINESS DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, THE ZONING AND PLANNING COMMISSION HAS FORWARDED TO THE CITY COUNCIL ITS REPORTS AND RECOMMENDATIONS CONCERNING CERTAIN APPLICATIONS FOR AMENDMENTS TO THE ZONING MAP OF THE CITY OF CORPUS CHRISTI, TEXAS; AND WHEREAS, PUBLIC HEARING WAS HELD AT WHICH HEARING ALL PERSONS WISHING TO APPEAR AND BE HEARD WERE HEARD, 11) CONSIDER THE SAME, BEFORE THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, IN ACCORDANCE WITH PROPER NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD ON JUNE 29, 1960, AT REGULAR COUNCIL MEETING OF THE CITY COUNCIL IN THE CITY COUNCIL CHAMBER OF THE CITY HALL IN THE CITY OF CORPUS CHRISTI; AND WHEREAS, REPRESENTATIONS HAVE BEEN MADE TO THE CITY COUNCIL BY THE APPLICANT, RAY PETERSON, THAT THE BELOW DESCRIBED PROPERTY WILL BE USED FOR A BANK AND MAJOR DEPARTMENT STORE; AND WHEREAS, BY MOTION DULY MADE, SECONDED, AND CARRIED, IT WAS DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER SET FORTH AMENDMENT WOULD BEST SERVE PUBLIC HEALTH, NECESSITY, AND CONVENIENCE AND THE GENERAL WELFARE OF THE CITY AND ITS CITIZENS BY PERMITTING A BANK AND MAJOR DEPARTMENT STORE TO BE ESTABLISHED IN THE BELOW DESCRIBED AREA: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: = SECTION 1. THAT THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, PASSED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565 ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND IN PARTICULAR AS AMENDED BY ORDINANCE No. 2266, PASSED AND APPROVED BY THE CITY COUNCIL ON THE 4TH DAY OF MAY, 1948, APPEARING OF RECORD IN VOLUME 16, PAGES 339 ET SEQ OF THE SAID ORDINANCE AND RESOLUTION RECORDS, AND AS AMENDED BY ORDINANCE No. 4846, ADOPTED ON THE 21ST DAY OF AUGUST, 1957, APPEARING OF RECORD IN VOLUME 26, PAGES A ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS, BE AND THE SAME IS HEREBY AMENDED BY MAKING THE CHANGES HEREINAFTER SET OUT. SECTION 2. THAT THE ZONING OF GULFGATE UNIT 11 BEING THAT PROPERTY LOCATED AT THE-NORTHEAST CORNER OF THE INTERSECTION OF AIRLINE ROAD AND LEXINGTON BOULEVARD, BE AND THE SAME IS HEREBY REZONED FROM "a -111 NEIGHBORHOOD BUSINESS DISTRICT TO "B -3" SECONDARY BUSINESS DISTRICT. SECTION 3. THAT THE OFFICIAL ZONING MAP OF THE CITY OF CORPUS CHRISTI, TEXAS, BE AND THE SAME IS HEREBY AMENDED AS HEREIN ORDAINED. SECTION 4. THAT THE ZONING ORDINANCE AND MAP OF THE CITY OF CORPUS CHRISTI, TEXAS, APPROVED ON THE 27TH DAY OF AUGUST, 1937, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED ON THE 21ST DAY OF AUGUST, 1957, EXCEPT AS HEREIN CHANGED, SHALL REMAIN IN FULL FORCE AND EFFECT. SECTION 5. THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH ARE HEREBY EXPRESSLY REPEALED. SECTION 6. THAT THE NECESSITY OF IMMEDIATELY MAKING AFORE- SAID CHANGE FOR THE PURPOSE OF MAINTAINING AT ALL TIMES A COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF CORPUS CHRISTI, TEXAS, CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR -2- RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY PASSED AND APPROVED, THIS 'I/' DAY OF JULY, 1960.
