BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER IS HEREBY AUTHORIZED AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, A CONTRACT WITH HELDENFELS BROTHERS, CONTRACTORS, FOR THE CONSTRUCTION OF BOOTY STREET IMPROVEMENTS, OCEAN DRIVE TO SANTA FE, WHICH CONSTRUC- TION CONSISTS OF WIDENING AND PAVING BOOTY STREET WITH HOT MIX ASPHALTIC CONCRETE SURFACE, CONSTRUCTING OF CURBS AND GUTTERS, SIDEWALKS AND STORM SEWER FACILITIES, BEING PROJECT N0. 220- 53 -37, ALL AS MORE FULLY SET OUT IN THE PLANS, SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE IN THE OFFICE OF THE CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF BY REFERENCE, AND ACCORDING TO THE BID OF HELDENFELS BROTHERS, OPENED ON THE 6TH DAY OF JULY, 1960, THE SAID BID OF HELDENFELS BROTHERS BEING THE LOWEST AND MOST ADVANTAGEOUS TO THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 2. THAT THERE IS HEREBY APPROPRIATED THE SUM OF $22,700.00 OUT OF N0. 220 STREET BOND IMPROVEMENT FUND, OF WHICH AMOUNT $21,515.55 REPRESENTS NET CITY COST FOR THE CONSTRUCTION AFTER ASSESS- MENTS, $663.70 IS FOR ADJUSTMENT OF TRAFFIC SIGNALS BY CITY FORCES, $500.00 IS FOR LABORATORY TESTING AND $20.75 IS FOR LEGAL ADVERTISING FOR BIDS. SECTION 3. THE NECESSITY FOR PROMPT EXECUTION OF THE CONTRACT AND APPROPRIATION OF THE NECESSARY FUNDS TO'PROVIDE AN ADEQUATE TRAFFIC FACILITY AS A PART OF OVERALL MASTER STREET IMPROVEMENT PROGRAM CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE 5812 SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEET- INGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST,,HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE,IT IS ACCORDINGLY PASSED AND APPROVED, THIS //l?
