HomeMy WebLinkAbout05827 ORD - 07/27/1960IMS:JKH:7 -27 -60 . � 1 AN ORDINANCE PRESCRIBING THE RATES TO BE CHARGED AS GREEN FEES FOR USE OF THE OSO MUNICIPAL GOLF COURSE; PROVIDING THAT NO FREE USE OF GOLF COURSE FACILITIES SHALL BE ALLOWED; ESTABLISHING REGULATIONS FOR THE CONTROL AND OPERATION OF THE GOLF COURSE; AUTHORIZING AND EMPOWERING THE GOLF COURSE MANAGER TO ENFORCE SUCH REGULATIONS; DECLARING THIS ORDINANCE TO BE AN AMENDMENT OF ORDINANCE NOS. 4834, 5073 AND 5276 AND REPEALING ALL PROVISIONS IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, IT IS DEEMED NECESSARY BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, TO FIX UNIFORM RATES TO BE CHARGED AS GREEN FEES IN THE USE OF THE OSO MUNICIPAL GOLF COURSE TO AID IN DEFRAYING THE EXPENSE IN THE MAINTENANCE OF SAID MUNICIPAL FACILITY; AND WHEREAS, IT IS DEEMED NECESSARY TO ADOPT REGULATIONS FOR THE OPERA- TION AND CONTROL OF THE OSO MUNICIPAL GOLF COURSE AND PROVIDE FOR ENFORCEMENT OF SAID REGULATIONS: NOW, THEREFORE, BE IT ORDAINED SY-THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE RATES TO BE CHARGED AS GREEN FEES IN THE USE OF THE OSO MUNICIPAL GOLF COURSE, TO BE PAID BY ALL USERS OF THAT CITY RECREATIONAL FACILITY, SHALL BE AS PRESCRIBED IN THE FOLLOWING SCHEDULE: -SCHEDULE OF RATES OF GREEN FEES FOR USE OF OSO MUNICIPAL GOLF COURSE MONTHLY RATE (PER INDIVIDUAL) $9.00 SATURDAYS, SUNDAYS AND HOLIDAYS (PER DAY) $1.50 WEEKDAYS (PER DAY) $1.00 AFTER 4:00 P.M. ANY DAY $ .75 SCHOOL CHILDREN THROUGH HIGH SCHOOL GRADES ON DAYS OTHER THAN SATURDAYS, SUNDAYS AND HOLIDAYS: A. DURING THE SUMMER, JUNE THROUGH AUGUST, UNTIL 12 NOON $ .50 AND B. DURING THE SCHOOL YEAR, SEPTEMBER THROUGH MAY, AFTER 3:00 P.M. $ .50 C. MONTHLY RATE (PER INDIVIDUAL CHILD), DURING THE SUMMER, JUNE.THROUGH AUGUST, UNTIL 12 NOON, AND DURING THE SCHOOL YEAR, SEPTEMBER THROUGH MAY, AFTER 3 :00 P.M. $3.75 581IZ7 i t D. NOTWITHSTANDING ANY OTHER PROVISION HEREOF, DIS- CRETION IS HEREBY VESTED IN THE CITY MANAGER, THE PARK AND RECREATION BOARD AND THE DIRECTOR OF THE PARK AND RECREATION DEPARTMENT, AND UPON THE CONCURRENCE OF THE CITY MANAGER AND THE DIRECTOR OF THE PARK AND RECREATION DEPARTMENT WITH THE MAJORITY OF THE PARK AND RECREATION BOARD, GREEN FEES MAY BE WAIVED DURING OFFICIAL JUNIOR CHAMPIONSHIP TOURNAMENTS SO AS TO PERMIT HIGH SCHOOL GOLF TEAMS TO CONDUCT THEIR TOURNAMENTS ON A MUNICIPAL GOLF COURSE WITHOUT PAYMENT OF GREEN FEES. THE WAIVER SHALL APPLY IF AUTHORIZED ONLY FOR OFFICIAL TOURNAMENT PLAN, AND A SEPARATE WRITTEN EXPRESSION OF WAIVER OF FEE SHALL BE REQUIRED FOR EACH TOURNAMENT. SECTION 2. PROVIDED, ALSO THAT NO FREE GREEN FEES SHALL BE ALLOWED FOR AND IN BEHALF OF ANY USER OF THE OSO MUNICIPAL GOLF COURSE, UNLESS APPROVED BY THE CITY MANAGER, OTHER THAN THE GOLF PROFESSIONAL AND HIS IMMEDIATE STAFF WHO ARE IN CHARGE OF THE ADMINISTRATION AND MAINTENANCE OF SAID PUBLIC RECREATIONAL FACILITY. SECTION 3. No PERSON SHALL PLAY UPON ANY PART OF THE GOLF COURSE WITHOUT BEING THE HOLDER OF A TICKET, VALID AT THE TIME OF SUCH PLAYS AND AUTHORIZING THE ACTIVITY °ENGAGED IN BY SAID PLAYER. ALL TICKETS SHALL BE NON- TRANSFERRABLE AND ANY TRANSFER IN VIOLATION OF THIS PROVISION SHALL SUBJECT EACH OF THE PARTIES CONNECTED WITH SUCH TRANSFER TO PROSECUTION FOR SUCH VIOLATION. SECTION 4. THE GOLF COURSE MANAGER AND HIS AUTHORIZED EMPLOYEES SHALL BE IN FULL CHARGE OF THE GOLF COURSE AT ALL TIMES AND ALL TICKETS AND PERMISSION TO PLAY SHALL BE UPON THE CONSIDERATION THAT THE RULES PERTAINING TO THE USE OF THE GOLF COURSE AS APPROVED BY THE CITY PARK AND RECREATION BOARD AND POSTED IN THE CLUB HOUSE AT THE GOLF COURSE. FAILURE TO OBEY ANY OF SAID RULES SHALL CONSTITUTE A MISDEMEANOR. SECTION 5. ALL VEHICLES ENTERING THE GOLF COURSE GROUNDS SHALL TRAVEL ONLY ON THE ROADWAYS PROVIDED THEREIN AND AT A SPEED NOT EXCEEDING 15 MILES PER HOUR. ALL VEHICLES NOT MOVING SHALL BE PARKED ONLY WITHIN THE PARKING AREA PROVIDED NEAR THE CLUB HOUSE. SECTION 6. THE PROVISIONS OF THIS ORDINANCE, WHEN ADOPTED, SHALL BECOME A PART OF THE CORPUS CHRISTI CITY CODES 1958, AND ENTITLED "CHAPTER 18A, GOLF COURSE SCHEDULE OF GREEN FEES AND REGULATIONS." THE PROVISIONS OF SECTION 1 OF THIS ORDINANCE SHALL BE ENTITLED AS ARTICLE I UNDER SAID CHAPTER 18A AND HAVING THE SECTION NUMBER OF 1EA -1. -2- AA V SECTION 7. THE PROVISIONS OF SECTION Z OF THIS ORDINANCE SHALL BE ENTITLED AS SECTION 18A -2 OF SAID ARTICLE i OF SAID CHAPTER 18A. SECTION 8. THE NECESSITY FOR ADOPTING A NEW SCHEDULE OF FEES AND PROVIDING REGULATIONS CONCERNING THE GOLF COURSE CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF,ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED ANDIRAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT ANDBE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY PASSED AND APPROVED, THIS�DAY OF JULY, 1960.
