HomeMy WebLinkAbout05887 ORD - 08/31/1960JKH :8 -29 -60 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A CONTRACT WITH HELDENFELS BROTHERS FOR THE CONSTRUCTION OF MORGAN STREET IMPROVEMENTS, PORT AVENUE TO AIRPORT ROAD, PROJECT NOS. 220 -53 -15.2 AND 220- 59 -34; APPROPRIATING THE SUM OF $116,165.00 FROM NO. 220 STREET BOND IMPROVEMENT FUND, REPRESENT- ING NET COST TO THE CITY FOR CONSTRUCTION AFTER ALLOWANCE FOR ASSESSMENTS AND INCLUDING $3,020.25 FOR LABORATORY TESTING AND LEGAL ADVERTISING FOR BIDS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER IS HEREBY AUTHORIZED AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, A CONTRACT WITH HELDENFELS BROTHERS, CONTRACTORS, FOR THE CONSTRUCTION OF MORGAN STREET IMPROVEMENTS, PORT AVENUE TO AIRPORT ROAD, WHICH CONSTRUCTION CONSISTS OF WIDENING AND PAVING MORGAN STREET, CONSTRUCT- ING CURBS— GUTTERS, SIDEWALKS, STORM SEWERS AND APPURTENANCES, BEING PROJECT Nos. 220 -53 -15.2 AND 220- 59 -34, ALL AS MORE FULLY SET OUT IN THE PLANS, SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE IN THE OFFICE OF THE CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF BY REFERENCE, AND ACCORDING TO THE BID OF HELDENFELS BROTHERS, OPENED ON THE 24TH DAY OF AUGUST, 1960, THE SAID BID OF HELDENFELS BROTHERS BEING THE LOWEST AND MOST ADVANTAGEOUS TO THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 2. THAT THERE IS HEREBY APPROPRIATED THE SUM OF $116,165.00 OUT OF No. 220 STREET BOND IMPROVEMENT FUND, REPRESENTING NET COST TO THE CITY FOR CONSTRUCTION AFTER ALLOWANCE FOR ASSESSMENTS AND INCLUDING $3,020.25 FOR LABORATORY TESTING AND LEGAL ADVERTISING FOR BIDS EXPENSE. SECTION 3. THE NECESSITY FOR PROMPT EXECUTION OF THE CON- TRACT AND APPROPRIATION OF THE NECESSARY FUNDS TO PROVIDE AN ADEQUATE TRAFFIC FACILITY AS A PART OF OVERALL MASTER STREET IMPROVEMENT PROGRAM CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION 5887 SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY', ON THE DATE OF ITS INTRODUCTION AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY PASSED AND APPROVED, THIS Si DAY OF , 1960.
