HomeMy WebLinkAbout05918 ORD - 10/05/1960AN ORDINANCE AMENDING CHAPTER 2 OF THE CORPUS CHRISTI CITY CODE, 1958, BY GIVING'THE COLISEUM MANAGER POWER TO-ENTER-INTO CERTAIN CONTRACTS; AMENDING CHAPTER 12 OF THE CORPUS CHRISTI CITY CODE, 1958, BY DELETING-SECTIONS 12 -3, 12 -4, 12 -8; 12 -1019 12 -12, 12 -13, 12 -17 THROUGH AND INCLUDING 12 -22, 12 -21+., THROUGH AND INCLUDING 12 -29 AND 12 -31 AND BY ADDING SECTIONS 12 -32 THROUGH AND INCLUDING 12 -51 WHICH CLASSIFY THE AT- TRACTIONS AND PURPOSES FOR WHICH THE MEMORIAL COLISEUM AND EXPOSITION HALL ARE RENTED; FIXING AND PROVIDING A SCHEDULE OF RATES OF RENTALS TO BE CHARGED EACH CLASS OF ATTRACTION; PROVIDING THE EXTENT TO WHICH EXTRA SERVICES, CONVENIENCES AND ACCESSORIES WILL BE FURNISHED WITHOUT ADDITIONAL CHA -RGES; PROVIDING FOR THE RENTAL AT REDUCED RATES FOR REHEARSAL AND PREPARATION PURPOSES AND FOR THE MOVING OF EQUIPMENT IN AND OUT; PROVIDING THAT THE RIGHT TO OPERATE CONCESSIONS SHALL BE RESERVED BY THE CITY; REQUIRING CERTAIN PROVISIONS IN ALL RENTAL CONTRACTS; PROVIDING A PENALTY; PROVIDING FOR THE REGULATION AND SALE OF BEER; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT "HEREWITH AND PARTICULARLY ORDINANCE NOS. 4303 AND 43048 PASSED AND APPROVED BY THE CITY COUNCIL ON AUGUST 3, 1955; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS„ SECTION 1. THAT CHAPTER -2 OF THE CORPUS CHRISTI CITY CODE, 1958, BE AND THE SAME IS HEREBY AMENDED _13Y ADDING TO THE SECOND PARAGRAPH OF SECTION 2 -31 THE WORDS- "WHO SHALL HAVE AUTHORITY -TO EXECUTE RENTAL CONTRACTS FOR THE COLISEUM AND EXPOSITION HALL - INCONFORMITYWITH THIS CODE' SO THAT THE SECOND PARAGRAPH -OF SECTION 2-31- SHALL HEREAFTER READ- "SECTION 2 -31. THE COLISEUM AND EXPOSITION HALL DIVISION SHALL HAVE AS ITS SUPERINTENDENT A PERSON QUALIFIED TO ATTEND TO THE DUTIES OF THE COLISEUM AND EXPOSITION HALL SUPERINTENDENT AND SHALL BE KNOWN AND DESIGNATED AS THE COLISEUM AND EXPOSITION HALL MANAGER WHO SHALL HAVE AUTHORITY TO EXECUTE RENTAL CONTRACT$ FOR THE COLISEUM AND EXPOSITION HALL IN CONFORMITY WITH THIS CODE." SECTION 2. THAT CHAPTER 12 OF THE CORPUS CHRISTI CITY CODE 1958, IS HEREBY AMENDED BY DELETING SECTIONS 12 -3, 12°4, 12-8, 12 -10, 12 -12, 12 -13, 12 -17 THROUGH AND INCLUDING 12 --22, 12 -24 THROUGH AND INCLUDING 12 -29 AND 12 -31. SECTION 3. THAT CHAPTER 12 of THE CORPUS CHRISTI CITY CODE, 1958, IS AMENDED BY ADDING THE FOLLOWING SECTIONS, TO -WIT: "SECTION 12 -32. THE VARIOUS ATTRACTIONS -AND PURPOSES FOR WHICH THE MEMORIAL COLISEUM AND EXPOSITION HALL ARE RENTED ARE DIVIDED INTO THE FOLLOWING CLASSES' TO -WIT:, A. CLASS I, COMMERCIAL: THIS RATE WILL APPLY TO ANY AND ALL ACTIVITIES OR EXHIBITS CONTRACTED FOR BY PROFIT- MAKING OR COMMERCIAL ORGANIZATIONS OR INDIVIDUALS. ALL POLITICAL USES, OTHER THAN NON- PARTISAN USES AS STATED IN CLASS IV, SHALL BE CONSIDERED IN THIS CLASS. SAID RATE WILL ALSO APPLY AND TAKE PRECEDENCE OVER CLASS II;AND CLASS III RATES WHEN CHARGES FOR SPACE ARE MADE-BY THE LESSEE AGAINST EXHIBITORS. PROFIT - MAKING OR COMMERCIAL ORGANIZATIONS OR INDIVIDUALS SHALL BE INTERPRETED TO MEAN THOSE ORGANIZATIONS OR INDIVIDUALS OF WHICH SOME PART OF THE NET EARNINGS INURES TO THE BENEFIT OF ANY PRIVATE SHAREHOLDER OR INDIVIDUAL. B. CLASS II,- NON - COMMERCIAL -- PROFIT - MAKING: THIS RATE WILL APPLY TO ANY AND ALL ACTIVITIES OR EXHIBITS CONTRACTED FOR BY NON -COM- MERCIAL ORGANIZATIONS OR INDIVIDUALS ENGAGED IN AN ACTIVITY FOR THE PURPOSE OF RAISING FUNDS. THIS PROVISION%SHALL NOT BE INTERPRETED TO WAIVE THE SPECIAL SERVICE CHARGES SET FORTH IN SECTION 12-39 HEREOF. E. EVENING RATES ARE BASED UPON A FOUR-HOUR PERIOD BEGINNING AFTER 6.00 P. M. -3- I F. DAYTIME RATES ARE BASED UPON A FOUR -HOUR PERIOD BETWEEN 7500 A. M. AND 6 :00 P. M. G. MOVE -IN AND MOVE -OUT RATES ARE BASED UPON -A 24-HOUR PERIOD. H. RATES FOR ACTIVITIES OR EXHIBITS WHICH- -USE LESS SPACE THAN THAT SET FORTH IN THE BASIC RATE TABLE WILL BE COMPUTED ON THE BASIS OF THE PERCENTAGE OF SPACE CONTRACTED FOR OR UTILIZED, WHICHEVER I$ THE GREATER. THESE RATES WILL BE COMPUTED BY THE COLISEUM MANAGER AND WILL BE BASED UPON THE BASIC RATE TABLE. "SECTION 12 -34. - EVENTS SOLELY SPONSORED BY THE PARK AND RECREATION DEPARTMENT MAY BE EXEMPT FROM PAYMENT OF -ANY RENTAL FOR ACTIVITIES OF A CIVIC NATURE WHICH ARE OF BENEFIT TO THE COMMUNITY AS ,A WHOLE, SUBJECT TO PRIOR APPROVAL OF THE DIRECTOR OF PARKS AND RECREATAON. EVENTS CO- SPONSORED BY THE PARK AND RECREATION DEPARTMENT AND USES BY OTHER CITY DEPARTMENTS AND DIVISIONS SHALL SECURE THE AP- PROVAL OF THE CITY MANAGER BEFORE REQUESTING EXEMPTION FROM ANY RENTAL PAYMENTS. EXEMPTION UNDER THIS SECTION DOES NOT PRECLUDE ANY CITY .DEPARTMENT OR DIVISION FROM THE REQUIREMENTS TO PAY THE CHARGE FOR PER- SONNEL TO OPERATE THE PUBLIC ADDRESS SYSTEM AND/OR SPOTLIGHTS, OR OTHER SPECIAL SERVICES. "SECTION 12 -35. AT ANY TIME PRIOR TO NINETY (90) DAYS BEFORE ANY SPECIFIC DATE, THE MANAGER MAY BE AUTHORIZED BY THE-PARK- AND -- RECREATION BOARD,TO CONTRACT FOR THE USE OF THE MEMORIAL COLISEUM AND/OR EXPOSITION HALL ON -SAID DATE, ONLY ON BIDS IF AT THE TIME OF AUTHORIZATION NO CON- TRACT FOR USE OF SAID MEMORIAL COLISEUM AND /OR EXPOSITION HALL ON SAID DATE HAS BEEN EXECUTED WITH ANY TENANT WHO HAS PAID THE REQUIRED DEPOSIT. UPON DETERMINATION OF THE PARK AND RECREATION BOARD -THAT THE LEASING OF MEMORIAL COLISEUM AND/OR EXPOSITION HALL FOR SUCH SPECIFIC DATE SHALL BE BY BIDS ONLY, THEN THE PROCEDURE FOR LEASING SHALL BE SUBSTANTIALLY AS FOLLOWS- -4- i A. THE PARK AND-RECREATION-BOARD 1S AUTHORIZED TO ACCEPT INFORMAL B106 FOR USE OF THE COLISEUM AND /OR EXPOSITION HALL WHEN SUCH ACTION IS CONSIDERED TO BE TO THE BEST INTEREST OF THE CITY. _ B. THE PARK AND RECREATION BOARDmWtLL DESIGNATE A PERIOD DURING WHICH INFORMAL SEALED BIDS WILL BE ACCEPTED AND DESIGNATE A DATE ON WHICH BIDS WILL BE OPENED IN A PUBLIC MEETING OF THE BOARD. THE -BOARD SHALL RESERVE THE RIGHT TO ACCEPT THE BID MOST ADVANTAGEOUS TO THE CITY-AND THE RIGHT TO REJECT ALL BIDS. THE PURPOSE FOR WHICH THE PROCEEDS ARE TO BE USED SHOULD BE ONE FACTOR IN DETERMINING THE MOST ADVANTAGEOUS BID. - C. IN ALL CASES, THE ESTABLISHED RATES SHALL CONSTITUTE THE MINIMUM BID PROPOSAL WHICH THE CITY WILL ACCEPT. ALL OTHER CHARGES AND CONDITIONS OF USE SHALL REMAIN IN EFFECT AS IN OTHER LEASES. D. A CERTIFIED CHECK FOR Zfvlpl" MUST BE ATTACHED TO EACH BID. THE SUCCESSFUL BIDDER SHALL PAY THE CITY THE FULL AMOUNT OF THE BID WITHIN TEN DAYS AFTER THE BID IS AWARDED. , f9SECTION 12 -36. WHEN ALL OR ANY PORTION OF THE FACILITIES ARE RENTED FOR A PERIOD OF THREE CONSECUTIVE DAYS, MOVE -IN AND MOVE -OUT TIME EXCLUDED, A 015COUNT OF 5% WILL BE ALLOWED. WHEN ALL OR ANY PORTION OF THE FACILITIES ARE RENTED FOR A PERIOD OF FIGHT CONSECUTIVE DAYS OR MORE, MOVE -IN AND MOVE -OUT TIME EXCLUDED, A DISCOUNT OF 10% WILL -BE ALLOWED. "SECTION 12 -37. IN THE EVENT THAT THE FACILITIES RENTED ARE NOT OTHERWISE OCCUPIED, THE BASIC RENTAL SET FORTH IN THE: BASIC RATE TABLE SHALL INCLUDE A FOUR -HOUR PERIOD IMMEDIATELY PRIOR TO THE EVENT, FOR THE PURPOSE OF DECORATING. IN THE EVENT THAT SUCH FACILITIES ARE OTHERWISE OCCUPIED, PRIOR TO THE,PERIOD FOR WHICHTHE PREMISES ARE RENTED, T'I+E;,.B,ASI, C ,RATE WILL STILL APPLY AND NO REFUNDS OR REDUCED RATES WILL BE GRANTED. _ "SECTION 12-38. FOR THE PURPOSE OF CALCULATING THE PERCENTAGE OF GROSS RECEIPTS AFTER ADMISSION- TAXES, THE LESSEE SHALL PROVIDE TO THE COLISEUM MANAGER, PRIOR TO ANY TICKETS WHATSOEVER BEING PLACED ON SALE, A CERTIFIED LIST OF ALL TICKETS PRINTED FOR THE EVENT. WHEN TICKET SALES HAVE BEEN COMPLETED, THE NUMBER OF UNSOLD TICKETS WILL BE DEDUCTED FROM . THE NUMBER OF TICKETS PRINTED. THE AMOUNT OF STATE AND FEDERAL ADMISSION TAXES WILL BE DEDUCTED AND THE LESSEE WILL BE CHARGED THE PROPER PERCENTAGE i -5- RATE OF THE DIFFERENCE, ACCORDING TO —THE -BASIC RATE TABLE. THE- LESSEE SHALL CERTIFY ANY INFORMATION REQUESTED BY THE - COLISEUM MANAGER' CON CERN)NG TICKET SALES -ON FORMS TO BE,PROVIDED BY THE CITY. IN ORDER TO DETERMINE THE GROSS RECEIPTS, THE COLISEUM MANAGER SHALL BE ALLOWED ACCESS TO THE RECORDS OF THE LESSEE, CONCERNING GROSS RECEIPTS AND TICKET SALES. "SECTION- 12 -39. CLASSIFICATION OF SPECIAL SERVICES AND SCHEDULE OF CHARGES, A. STAGEHANDS, AN ADEQUATE NUMBER OF QUALIFIED STAGEHANDS WILL BE REQUIRED TO HANDLE STAGE EQUIPMENT AND STAGE PROPERTIES AND THE NUMBER AND QUALIFICATIONS OF SAID STAGEHANDS SHALL BE DETERMINED BY THE COLISEUM MANAGER. QUALIFIED PERSONNEL WILL ALSO BE REQUIRED TO HANDLE AND OPERATE PUBLIC ADDRESS EQUIP- MENT AND CARBON ARC LIGHTS. ARRANGEMENTS FOR STAGEHANDS AND OPERATORS -MAY BE MADE BY THE COLISEUM MANAGER ON BEHALF OF THE LESSEE, BUT WILL BE EMPLOYEES OF AND PAID BY THE LESSEE AT THE -PREVA +LING WAGE. "SECTION 12 -41. SUFFICIENT SECURITY PERSONNEL TO PROPERLY PROTECT BOTH CITIZENS AND PROPERTY SHALL BE REQUIRED AND THIS NUMBERSHALL -BE DETERMINED BY THE COLISEUM MANAGER. ARRANGEMENTS FOR SECURITY PERSONNEL -, MAY BE MADE THROUGH THE COLISEUM • MANAGER ON BEHALF OF THE LESSEE, BUT SUCH PERSONNEL SHALL BE EMPLOYEES OF AND PAID BY THE LESSEE AT THE PREVAILING WAGE. m "SECTION 12 -42. UTILITIES. THE RENTAL SCHEDULE PROVIDED HERE- IN INCLUDES THE NORMAL UTILITIES NECESSARY TO THE COMFORT AND CONVENIENCE OF THE PATRONS, INCLUDING BUT NOT LIMITED TO HEATING, COOLING, WATER, GAS AND ELECTRICITY. IN THE EVENT THAT CONSUMPTION OF ELECTRICITY SHALL EXCEED AN AGGREGATE AMOUNT OF 25.00 PER DAY FOR EACH RENTAL UNIT; SUCH CHARGES THAT EXCEED $25.00 PER DAY ARE TO BE PAID BY THE LESSEE. CHARGES WILL BE CALCULATED AT 2¢ PER KILO WATT HOUR BASED ON METER READINGS BEFORE AND AFTER OCCUPANCY BY THE LESSEE. "SECTION 12 -43. CATERING. FOOD AND BEVERAGES SERVED IN THE FACILITIES SHALL BE DISPENSED FROM DESIGNATED AREAS EQUIPPED AS SERVICE LOCATIONS. WHEN THE SERVICE LOCATIONS ARE REQUIRED TO BE USED BY ANYONE OTHER THAN THE CONCESSIONAIRE THEY SHALL BE CHARGEABLE AT THE FOLLOWING RATES IN EXCESS OF BUILDING RENTAL. NON - PROFESSIONAL CATERING $15.00 PER LOCATION PROFESSIONAL CATERING $15.00 PER LOCATION OR 10¢ PER PLATE, WHICHEVER IS GREATER. P°SECTION 12 -44. THE USE AND /OR RENTAL OF THE FACILITIES DOES NOT INCLUDE THE RIGHT TO MAKE OR TO PERMIT TO BE MADE SALES OF ANY NATURE EXCEPT THAT THE SELLING OF MERCHANDISE BY DISPLAY SHALL BE PER- MITTED UPON THE APPROVAL OF THE COLISEUM MANAGER AND ALSO EXCEPTING THE SALE OF ADMISSION TICKETS. THE CITY RESERVES TO ITSELF AND ITS ASSIGNS THE EXCLUSIVE RIGHTS TO CONTROL THE SERVICE AND /OR SALE OF ANY AND ALL ITEMS OF FOOD; BEVERAGES, NOVELTIES AND ANY OTHER MERCHANDISE EXCEPT AS PROVIDED HEREIN. "SECTION 12 -45. ALL TENANTS SHALL HOLD THE CITY HARMLESS FROM ANY AND ALL LIABILITY FOR ANY CLAIM OR CLAIMS AS A RESULT OF RENTAL OR USE OF THE PREMISES, AND SHALL INDEMNIFY THE CITY IN CASE OF ANY CLAIMS RESULTING FROM THEIR OPERATIONS OR OCCURRING DURING THEIR OCCUPANCY OF THE PREMISES AND ALL RENTAL CONTRACTS SHALL SPECIFICALLY INCLUDE SUCH PROVISIONS. - i 'SECTION 12 <46. VERBAL AGREEMENTS TO RENT ARE NOT RECOGNIZED UNDER ANY CIRCUMSTANCES, AND THIS ORDINANCE AND THE RENTAL CONTRACTS UPON ACCEPTANCE -,, CONSTITUTE THE ENTIRE RENTAL AGREEMENT AND MAY NOT BE ALTERED UNLESS DONE SO IN WRITINGS SIGNED BY AUTHORIZED REPRESENTATIVES OF BOTH PATRIES. "SECTION 12 -47. RULES AND REGULATIONS FOR THE USE OF THE FACILITIES AND EQUIPMENT DR OTHER MATTERS NOT HEREIN EXPRESSLY PROVIDED FOR SHALL BE LEFT TO THE DISCRETION OF THE COLISEUM MANAGER TO B£ DETER- MINED IN ACCORDANCE WITH CITY POLICY. �% ECTION 12 -48. ACTING THROUGH ITS AGENTS (THE CITY MANAGERS DIRECTOR OF PARKS AND RECREATION AND THE COLISEUM MANAGER THE CITY RESERVES THE RIGHT TO REFUSE TO RENT THE FACILITIES TO ANY GROUP OR INDIVIDUAL NOT ACTING IN THE BEST INTEREST OF THE PUBLIC OR THE CITY. "SECTION 12 -49. AL-L LESSEES ARE REQUIRED TO PAY ANY AND ALL SUMS WHICH ARE DUE UNDER THE RENTAL CONTRACT UPON THE DEMAND OF THE COLISEUM MANAGER.' THE FAILURE OF THE LESSEE TO MAKE SUCH PAYMENT PROMPTLY SHALL BE UNLAWFUL AND SHALL BE PUNISHABLE AS A MVSDEMEANOR. `SECTION 12 -550. ALL CONTRACTS EXECUTED IN ACCORDANCE WITH RATES AND REGULATIONS IN EFFECT PRIOR TO THE EFFECTIVE DATE OF THIS ORDINANCE SHALL BE VALID AND ARE HEREBY RATIFIED.
