AN ORDINANCE
AMENDING ORD 557, PASSED AND APPROVED ON THE
11TH DAY OF NOVEMBER, 1959, ENTITLED: "CREATING AND
ESTABLISHLNQ A CITY-000NTY DEPARTMENT 6F PUBLIC HEATH
A D WELF ; PROVIDING FOR THE ADMINISTRATION THEREOF;
PROVIDING FOR CREATION AND APPOINTMENT OF THE CITIZENS
ADVISORY HEALTH AND WELFARE BOARD; PROVIDING FOR THE
DUTIES, POGIERS AND PROCEDURES OF SAID DEPARTMENT AND
SAID ADVISORY BOARD; ABOLISHING CERTAIN BOARDS, COM-
MITTEES AND ORGANIZATIONS NOW IN EXISTENCE AND TRANS-
FERRING THE OPERATIONS AND RESPONSIBILITIES OF SAID
BODIES TO THE NEW BOARD; PROVIDING AN EFFECTIVE DATE AND
REPEALING ALL ORDINANCES, RESOLUTIONS, APPOINTMENTS AND ORDERS
CONCERNING THE BOARDS, COMMITTEES AND ORGANIZATIONS HEREBY
ABOLISHED" BY AMENDING S 2 SO AS TO ELIM HATE T 0 E
PROVISIONS REQUIRING THAT THE ADVISORY BOARD DIVIDE ITS

SAID ORDINANCE SO AS TO PROVIDE THAT THE SUBCOMMITTCE_ON
HEALTH SHALL ACT AS THE .Iry -CO HTY ADVISORY BOARD OF HEALTH,.
AND DECLARING AN EMERGENCY. "° --
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. ORDINANCE NO. 5557 IS HEREBY AMENDED BY AMENDING
SECTION 2 OF SAID ORDINANCE TO HEREAFTER READ AS FOLLOWS:
"SECTION 2. THERE IS HEREBY CREATED THE CITIZENS ADVISORY
HEALTH AND WELFARE BOARD, SAID BOARD SHALL CONSIST OF ELEVEN MEMBERS,
FIVE MEMBERS APPOINTED BY THE NUECES COUNTY COMMISSIONERS COURT AND
FIVE BY THE CITY COUNCIL AND ONE MEMBER APPOINTED JOINTLY BY SAID COM-
MISSIONERS COURT AND SAID CITY COUNCIL. THE BOARD SHALL ADOPT ITS OWN
RULES OF PROCEDURE FOR THE CONDUCT OF ITSBUSINESS AND SHALL ELECT ITS
OWN PRESIDENT AND VICE - PRESIDENT. OF THE MEMBERSHIP FIRST APPOINTED,
THREE MEMBERS SHALL SERVE FOR ONE YEAR, FOUR MEMBERS SHALL SERVE FOR
TWO YEARS AND FOUR MEMBERS SHALL SERVE FOR THREE YEARS, WITH THE TERMS TO
BE DECIDED BY LOT AT THE FIRST BUSINESS SESSION OF THE BOARD. AFTER THE
EXPIRATION OF EACH OF THE RESPECTIVE TERMS, THE SUCCEEDING TERMS OF ALL
MEMBERS SHALL BE FOR A PERIOD OF THREE YEARS. ANY VACANCY OCCURRING DURING
A TERM OF OFFICE SHALL BE FILLED BY APPOINTMENT BY THE APPOINTING AGENCY
WHICH APPOINTED THE MEMBER WHOSE OFFICE IS VACANT, AND THE APPOINTMENT
SHALL BE FOR THE UNEXPIRED TERM OF THE OFFICE IN WHICH THE VACANCY OCCURS.
NO PERSON SHALL BE ELIGIBLE TO RE- APPOINTMENT ON THE BOARD UNLESS AT LEAST
ONE YEAR HAS ELAPSED SINCE THE LAST SERVICE ON TiE BOARD OF SUCH APPOINTEE
EXCEPT THAT APPOINTEES FIRST APPOINTED UPON THE PASSAGE OF THIS ORDINANCE
WHOSE TERMS ARE FOR NOT EXCEEDING ONE YEAR MAY BE RE- APPOINTED TO SUCCEED
THEMSELVES FOR A NEW FULL, THREE -YEAR TERM. ALL MEMBERS DURING THEIR TERMS
IN OFFICES WILL SERVE AT THE PLEASURE OF THE COMMISSIONERS COURT AND THE
CITY COUNCIL."
SECTION 2. THAT A NEW SECTION BE ADDED TO SAID ORDINANCE N0.
5557 TO BE DESIGNATED AS SECTION 2 -A WHICH SECTION 2 -A SHALL READ AS FOL-
LOWS:
"SECTION 2-A. THERE SHALL BE SUCH SUBCOMMITTEES AS THE BOARD
SHALL DETERMINE PROVIDED THAT ALL OF THE MEMBERS OF EACH AND ALL OF
SAID SUBCOMMITTEES SHALL BE MEMBERS OF THE SAID CITIZENS ADV130RY.HEALTH
AND WELFARE BOARD AND FURTHER PROVIDED THAT THERE SHALL BE ONE SUB-
COMMITTEE TO BE DESIGNATED AS 'HEALTH SUBCOMMITTEE' AND SAID HEALTH SUB-
COMMITTEE SHALL SERVE AS THE CITY - COUNTY ADVISORY BOARD OF HEALTHY IN
ACCORDANCE WITH THE REGULATIONS OF THE STATE BOARD OF HEALTH. THE
CITIZENS ADVISORY HEALTH AND WELFARE BOARD SHALL ADOPT SUCH BYLAWS AND
RULES OF PROCEDURE FOR THE CONDUCT OF ITS MEETINGS AS IT SHALL DECIDE
BY MAJORITY VOTE PROVIDED THAT BEFORE BECOMING EFFECTIVE A COPY OF SUCH
BYLAWS AND RULES AS WELL AS ANY AMENDMENTS THEREOF SHALL BE DELIVERED
TO THE OFFICE OF THE CITY SECRETARY FOR THE INFORMATION OF THE CITY
COUNCIL AND TO THE COUNTY JUDGE FOR THE INFORMATION OF THE COMMISSIONERS
COURT AND REMAIN ON FILE AT THOSE OFFICES."
SECTION 3. EXCEPT AS HEREIN PROVIDED, ORDINANCE N0. 5557 SHALL
REMAIN IN FULL FORCE AND EFFECT.
SECTION 11. THE NECESSITY TO MAKE THE HEREINA13OVE AMENDMENTS
TO PERMIT REORGANIZATION OF THE HEALTH AND WELFARE ADVISORY BOARD 50 THAT
THE BOARD MAY FUNCTION MORE EFFECTIVELY CREATES A PUBLIC EMERGENCY AND AN
IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE
PROVIDING THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE
DATE IT IS INYRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE
READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING

DECLARED THAT SUCH PUBLIC EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED
THAT SUCH CHARTER RULE BE SUSPENDED, AND THAT THIS ORDINANCE TAKE EFFECT
AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY
PASSED AND APPROVED, THISDAY OF

GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE
SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLU-
TION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH
ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL;
I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIRE-
MENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE
PRESENT MEETING OF THE CITY COUNCIL.
