AN ORDINANCE
ABANDONING A PORTION OF THE EXISTING ENNIS JOSLIN ROAD
AND IN LIEU THEREOF, ESTABLISHING AND DEDICATING A NEW
ROAD RIGHT OF WAY AS SHOWN ON THE MAP ATTACHED HERETO
AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY.
-WHEREAS, IT HAS BEEN DETERMINED BY THE CITY OF CORPUS CHRISTI
AND THE COUNTY OF NUECES TO STRAIGHTEN AS MUCH AS PRACTICAL THE ENNIS
JOSLIN ROAD AND TO ACCOMPLISH THE SAME BY ABANDONING PORTIONS OF THE
HERETOFORE EXISTING ROAD AND CONSTRUCTING A NEW ROAD ELIMINATING AS FAR
AS PRACTICAL THE CURVING PORTIONS HERETOFORE EXISTING IN THE ROAD; AND
WHEREAS, AFTER DUE NOTICE IN ACCORDANCE WITH THE PROVISIONS OF
THE CITY CHARTER, A PUBLIC HEARING WAS HELD ON THE 9TH DAY OF NOVEMBER,
1960, AT REGULAR MEETING OF THE CITY COUNCIL AND IT APPEARING AT SAID
HEARING THAT THERE WAS NO OPPOSITION TO THE CHANGING OF THE LOCATION OF
SAID ROAD BY THE ABANDONING OF PORTIONS OF THE HERETOFORE EXISTING ROAD
AND THE ESTABLISHMENT OF A NEW ROAD, AND THAT IT 1S IN THE BEST INTERESTS
OF THE PUBLIC AND THE CITY AND THE COUNTY TO SO ESTABLISH SAID NEW ROAD
AND THAT THE NEW ROUTE OF SAID ROAD BE ESTABLISHED AS SHOWN ON THE MAP
EXHIBITED AT SAID MEETING, WHICH IS ATTACHED HERETO AND MADE A PART
HEREOF:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THERE BE AND IS HEREBY ABANDONED THE FOLLOWING
DESCRIBED PORTION OF THE EXISTING ENNIS JOSLIN ROAD:
ALL THAT SECTION OF ENNIS JOSLIN ROAD AT A POINT NEAR
THE PLACE WHERE THE CITY LIMITS LINE NOW CROSSES THE
ENNIS JOSLIN ROAD, SAID POINT BEING APPROXIMATELY 670
FEET IN A SOUTHEAST DIRECTION FROM THE SOUTHEASTERN
BOUNDARY LINE OF THE GUTH PARK PROPERTY OF THE CITY
AND EXTENDING IN A GENERAL NORTHERLY DIRECTION TO A
POINT APPROXIMATELY 225 FEET FROM THE NORTHERN LINE
OF LOT 0, SECTION 17, FLOUR BLUFF AND ENCINAL FARM
AND GARDEN TRACT, MEASURED ON A LINE EXTENDING NORTH-
WARD N. 9° 591- WEST; SAVE AND EXCEPT FOR THOSE PORTIONS
OF SAID ROAD WHICH COINCIDE WITH THE PORTIONS OF A PRO-
POSED NEW ROAD BEING SUBSTITUTED FOR AND IN LIEU OF THE
EXISTING ENNIS JOSLIN ROAD,
AS SHOWN ON THE MAP ATTACHED HERETO AND MADE A PART HEREOF.
SECTION 2. IN LIEU OF THE ABANDONED PORTIONS OF ENNIS JOSLIN
ROAD AS THE SAME HERETOFORE EXISTED PRIOR TO THE HEARING OF NOVEMBER
9, 1960, THERE IS HEREBY ESTABLISHED AND DEDICATED AS A PUBLIC ROAD,
INCLUDING THOSE PORTIONS WITHIN THE RIGHT OF WAY HEREBY DEDICATED WHICH
HERETOFORE EXISTED AS PART OF SAID ENNIS JOSLIN ROAD THE FOLLOWING;
PARCEL NO. 1
A STRIP OF LAND 801 WIDE BY 2618.41' IN LENGTH, REQUIRED
FOR ROAD RIGHT OF WAY, DRAINAGE, AND UTILITY PURPOSES,
OUT OF A PORTION OF LOT 1, SECTION 29; AND OUT OF LOTS
5, 6, 7 AND 8, SECTION 17, FLOUR BLUFF AND ENCINAL FARM
AND GARDEN TRACTS, THE ABOVE MENTIONED LOTS BEING LOCATED
IN A 70 -ACRE TRACT OF LAND NOW OWNED BY THE CITY OF CORPUS
CHRISTI, NUECES COUNTY, TEXAS, AND KNOWN AS SOUTH GUTH PARK.
SAID 801 WIDE STRIP OF LAND IS REQUIRED FOR THE RELOCATION
OF THAT PORTION OF THE CAYO DEL OSO ROAD LYING WITHIN SOUTH
GUTH PARK, AND IT IS INTENDED THAT THIS RELOCATION SHALL TAKE
PRECEDENCE OVER THAT TRACT OF LAND CONVEYED TO NUECES COUNTY
ON AUGUST 6, 1952, BY THE CITY OF CORPUS CHRISTI FOR ROAD
RIGHT OF WAY PURPOSES AND RECORDED IN VOLUME 568, PAGE 575,
AND THAT THE LAND CONVEYED ON AUGUST 6, 1952, IS HEREBY ABAN-
DONED. METES AND BOUNDS FOR THE PROPOSED ROAD RIGHT OF WAY
ARE AS FOLLOWS:
BEGINNING AT A 1-1/2" IRON PIPE, SAME BEING THE SOUTHWEST
CORNER OF THE 70 ACRE TRACT KNOWN AS SOUTH GUTH PARK;
THENCE NORTH 52° 41' EAST WITH THE SOUTH LINE OF SOUTH
GUTH PARK ARID THE NORTH LINE OF THE OSO DEVELOPMENT
CORPORATION PROPERTY, A DISTANCE OF 273.321 TO THE WEST RIGHT
OF WAY LINE OF THE CAYO DEL OSO ROAD, SAID POINT BEING ON
A CURVE TO THE RIGHT, AND WHOSE POINT OF TANGENCY AT THE
BEGINNING BEARS NORTH 29° 371 18" WEST, FOR THE SOUTHWEST
CORNER AND PLACE OF BEGINNING OF THIS DESCRIPTION;
THENCE IN A NORTHWESTERLY DIRECTION WITH THE WEST RIGHT OF WAY

AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER
RULE THAT NO ORDNANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE
OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ
AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING
DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THE
SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY
ON TIE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND
