HomeMy WebLinkAbout05997 ORD - 12/14/1960IMS :JKH :12 -9 -60 AN ORDINANCE DESIGNATING THAT AREA EXTENDING FROM KING STREET TO CARANCAHUA STREET EXTENDING EASTWARD FROM THE EAST END OF AGNES AT THE INTERSECTION OF KING STREET HEREIN SPECIFICALLY DESCRIBED, TO BE USED FOR STREET RIGHT OF WAY FOR THE EASTWARD EXTENSION OF AGNES STREET; AND DECLARING AN EMERGENCY. WHEREAS, OVER A PERIOD OF SEVERAL YEARS IT HAS BEEN CONTEMPLATED THAT AGNES STREET WOULD BE EXTENDED EASTWARD FROM KING STREET TO CARANCAHUA STREET AND THROUGH VARIOUS PURCHASES THE CITY HAS ACQUIRED PROPERTY NEEDED FOR SAID RIGHT OF WAY AND IS NOW THE OWNER OF THE AREA HEREINAFTER DESCRIBED AND IT IS DESIRABLE TO OFFICIALLY DESIGNATE THE SAID AREA AS STREET RIGHT OF WAY FOR THE EASTWARD EXTENSION OF AGNES STREET; AND WHEREAS, NOTICE OF THE INTENTION OF ESTABLISHING SAID EASTWARD EXTENSION OF AGNES STREET HAS BEEN GIVEN BY PUBLICATION AND LETTER, AS REQUIRED BY THE CHARTER, AND THEREAFTER, PURSUANT TO SAID NOTICE, A PUBLIC HEARING WAS HELD ON THE 14TH DAY OF DECEMBER, 1960, BY THE CITY COUNCIL IN ACCORDANCE WITH THE PROVISIONS OF THE CITY CHARTER; AND WHEREAS, IT HAS BEEN DULY DETERMINED BY THE CITY COUNCIL AFTER SUCH PUBLIC HEARING THAT SAID AREA HEREINAFTER DESCRIBED BE DESIGNATED AS STREET RIGHT OF WAY FOR THE EASTWARD EXTENSION OF AGNES STREET IN THE CITY OF CORPUS CHRISTI AND THAT IT WOULD BE TO THE ADVANTAGE OF THE CITY TO SO DESIGNATE SAID AREA: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CI T' OF CORPUS CHRISTI, TEXAS: SECTION I. THAT ALL OF THAT AREA DESCRIBED AS FOLLOWS BE AND THE SAME IS HEREBY DESIGNATED FOR USE AS STREET RIGHT OF WAY FOR THE EASTWARD EXTENSION OF AGNES STREET IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS: ALL OF THAT AREA EXTENDING FROM KING STREET TO CARANCAHUA STREET EXTENDING EAST FROM THE EAST END OF AGNES STREET AT THE INTERSECTION OF AGNES STREET WITH KING STREET AND SPECIFICALLY INCLUDING THE FOLLOWING PROPERTIES: ALL OF THAT PROPERTY, APPROXIMATELY 2001 X 80° DESCRIBED IN A DEED FROM FRED A. BOUVIER TO THE CITY OF CORPUS CHRISTI, RECORDED IN VOL. 250 BEGINNING AT PAGE 581 OF THE DEED RECORDS OF NUECES COUNTY, TEXAS; ALL OF THAT PROPERTY, APPROXIMATELY 501 X 80' DESCRIBED IN A DEED FROM H. A. WHITE TO THE CITY OF CORPUS CHRISTI, RECORDED IN VOL. 283 BEGINNING AT PAGE 250 OF THE DEED RECORDS OF NUECES COUNTY, TEXAS; 59.9 ALL OF THAT PROPERTY, APPROXIMATELY 751 X 1501 DESCRIBED IN DEED FROM BEULAH BISBEE TO THE CITY OF CORPUS CHRISTI, RECORDED IN VOL. 286 BEGINNING AT PAGE 580 OF THE DEED RECORDS OF NUECES COUNTY, TEXAS, ALL OF THAT PROPERTY SHOWN AS LOTS 4 AND 8 OF PARK PLACE, A SUBDIVISION IN THE CITY OF CORPUS CHRISTI, TEXAS, NUECES COUNTY, AS SHOWN ON THE MAP OR PLAT OF PARK PLACE, RECORDED IN THE OFFICE OF THE COUNTY CLERK OF NuECES COUNTY, TEXAS; ALL OF THAT PROPERTY SHOWN AS LOTS 1, 2, 7 AND 8, BLOCK 2, BRAYTON ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, SHOWN BY THE MAP OR PLAT RECORDS OF NUECES COUNTY, TEXAS, IN THE OFFICE OF THE COUNTY CLERK OF NUECES COUNTY, TEXAS. SECTION 2. THE NECESSITY FOR OFFICIALLY DESIGNATING THE AREA DESCRIBED IN SECTION 1 AS THE STREET RIGHT OF WAY FOR THE EASTWARD EXTENSION OF AGNES STREET SO AS TO COMMENCE CONSTRUCTION AS PROMPTLY AS POSSIBLE FOR STREET PURPOSES CREATES A:PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDI- NANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION':IOF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTE S PASSAGE, IT IS ACCORDINGLY PASSED AND APPROVED, THIS DAY OF , 1960.
