AN ORDINANCE
APPR_0_PRIATING OUT OF NO. 220 STREET BOND IMPROVEMENT
FUND THE SUM OF 156,.66.00 FOR THE ACQUISITION OF
18 PARCELS OF PROPERTY FOR RIGHT OF WAY REQUIRED
BY THE STATE OF TEXAS AND APPLICABLE TO PROJECT
NO. 22 (7-5 72 , CROSSTOWN EXPRESSWAY, HIGHWAY 286
RELOCATED, A COPY OF WHICH PARCEL LIST IS ATTACHED
HERETO AND MADE A PART HEREOF; AUTHORIZING AND DIRECT-
ING THE CITY MANAGER TO EXECUTE REAL ESTATE SALES CON-
TRACTS FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI,
FOR THE ACQUISITION OF SAID PARCELS, WHEN AND ONLY
WHEN THE PURCHASE PRICE IS WITHIN THE "APPROVEDVALUE"
AS DETERMINED BY THE STATE; AND DECLARING AN EMERGENCY.
WHEREAS, THE CITY COUNCIL HAS PREVIOUSLY AUTHORIZED THE
CITY MANAGER TO ENTER INTO A CONTRACT WITH THE HIGHWAY DEPARTMENT
OF THE STATE OF TEXAS WHEREBY THE CITY AGREED TO PURCHASE THE
NECESSARY RIGHT OF WAY FOR STATE HIGHWAY N0. 256, COMMONLY KNOWN
AS THE CROSSTOWN EXPRESSWAY, AND THE STATE OF TEXAS, ACTING BY AND
THROUGH ITS HIGHWAY DEPARTMENT, AGREED TO DETERMINE EACH PARTICULAR
PARCEL OR TRACT OF LAND TO BE ACQUIRED AND TO APPRAISE SAID LAND AND
TO SET AN "APPROVED VALUE" UPON EACH OF SAID TRACTS AND TO REIMBURSE
THE CITY FOR ,ONE -HALF OF THE COST THEREOF; AND
WHEREAS, IT IS NECESSARY TO AUTHORIZE THE CITY MANAGER TO
EXECUTE REAL ESTATE SALES CONTRACTS FOR THE PURCHASE OF THE NECESSARY
TRACTS OR PARCELS OF LAND, AS DESIGNATED BY THE STATE OF TEXAS, BY
AND THROUGH ITS HIGHWAY DEPARTMENT, AND TO APPROPRIATE THE NECESSARY
FUNDS FOR THE ACQUISITION THEREOF:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. THERE IS HEREBY APPROPRIATED THE SUM OF $156,665.00
FROM STREET BOND IMPROVEMENT FUND N0. 220 FOR THE ACQUISITION OF 15
PARCELS OF PROPERTY FOR RIGHT OF WAY REQUIRED BY THE STATE OF TEXAS
FOR THE CROSSTOWN EXPRESSWAY, HIGHWAY 286 RELOCATED, PROJECT NO.
220- 56-24, A COPY OF WHICH PROPERTY LIST IS ATTACHED HERETO AND MADE
A PART HEREOF. IT BEING THE INTENTION OF THE COUNCIL TO APPROPRIATE
FUNDS TO COVER THE AFOREMENTIONED PURCHASES, BUT IT IS THE INTENTION
OF THE COUNCIL TO SEEK REIMBURSEMENT OF THE STATE OF TEXAS, FOR ONE -
HALF OF THE PURCHASE PRICE OF EACH TRACT OR PARCEL PURCHASED, FROM THE
HIGHWAY DEPARTMENT OF THE STATE OF TEXAS.

SECTION 2. THAT THE CITY MANAGER 13 HEREBY AUTHORIZED AND
DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI,
REAL ESTATE SALES CONTRACTS WITH THE OWNERS OF THOSE PARCELS OR TRACTS
OF LAND DESIGNATED BY THE TEXAS. HIGHWAY DEPARTMENT AS NEEDED FOR STATE
HIGHWAY NO. 286 RELOCATED,THE CROSSTOWN EXPRESSWAY, WHEN AND ONLY WHEN
THE PARCEL OR TRACT HAS BEEN DESIGNATED BY THE STATE HIGHWAY DEPARTMENT
AS NEEDED FOR SAID PROJECT, AND WHEN THE SALES CONTRACT IS FOR AN AMOUNT
OP MONEY WITHIN THE "APPROVED VALUE" AS SET AND DETERMINED BY THE STATE
HIGHWAY DEPARTMENT.
SECTION 3. THE PUBLIC IMPORTANCE OF MAKING FUNDS AVAILABLE
AND IN BEGINNING THE PURCHASING OF THE NECESSARY RIGHT OF WAY SO THAT
THE STATE HIGHWAY N0, 286 RELOCATED, CROSSTOWN EXPRESSWAY, PROJECT MAY
BE BEGUN IMMEDIATELY CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC
NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE
OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION
AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL
MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH
EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF
SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE
OF ITS INTRODUCTION AND THAT THLS ORDINANCE TAKE EFFECT AND BE IN FULL
FORCE AND EFFECT FROM AND AFTER In PASSAGE, IT 15 ACCORDINGLY PASSED

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE -
GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE
SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLU-
TION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH
ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCILS
I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIRE-
MENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE
PRESENT MEETING OF THE CITY COUNCIL.
