Barnard, Mrs. Ray Airheart, Joseph H. Damn, Commissioners, Patrick J. Dunne, R. A. Humble, Gabe Lozano, Sr., T. Ray Sring, City Secretary, with the following absent: Ij , constituting a quorum, at which time the following among other business was transacted: Mr. Ellroy Sing, Mayor, presented for the consideration of the Ctmcil an ordinance. The ordinance was read by the City Secretary. The Mayor presented to the Council a communication in writing pertaining to said proposed ordinance, as follows: "Co Christi, Texas, 1961. TO THE CITY COUNCIL, Corpus Christi, Texas. Gentlemen: The public importance and pressing need for the per- manent improvements to be constructed by use of the proceeds of the bonds voted at the election held on January 28, 1961, create an emergency and an imperative public necessity requiring the suspension of rules and Charter provisions requiring ordinances to be considered and voted upon at three regular meetings. I, therefore, request that the City Council pass the proposed ordinance canvassing the returns and declaring the result of the el- ection for the issuance of said bonds as an emergency measure. You will pl consider this request in connection with the ordinance which has been intro- duced in the City Council of this subject. NOES: None The Mayor requested that the records show that he voted Aye. This was done. The Mayor announced that the ordinance had been passed. The ordinance is as follows: ORDINANCE NO. BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, CANVASSING RETURNS AND DE- CLARING RESULTS OF AN ELECTION ON THE la,UESTION OF THE ISSUANCE OF THE FOLLOWING BONDS: $1,360,000.00 WESTSIDE SEWER SYSTEM IMPROVE- MENT BONDS; $3,305,000.00 SOUTH STATUS AND OSO SEWER SYSTEM IMPROVEMENT BONDS; $1,720,000 STORM SEWER BONDS; $195,000.00 LIBRARY BONDS AND $775,000.00 STREET DWROVE40T BONDS, AND DECLARING AN EMERGENCY. WHEREAS, heretofore on the 11th day of January, 1961, the City Council of the City of Corpus Christi, Texas, passed an ordinance call- ing an election to be held in said City on the 28th day of January, 1961, on the following propositions: PROPOSITION NO. 1 "Shall the City Council of the City of Corpus Christi, Texas, be authorized to issue the bonds of said City in the amount of $1,360,000.00, maturing serially in such installments as the City Council may prescribe, the maxima- maturity being not more than Thirty Five (35) yes from their date, bearing interest at a rate not to exceed Five (5 %) per cent per annum, and to levy a tax on all tax- able property within said City sufficient to pay the annual interest and provide a sinking fund to pay the bonds at maturity, for the purpose of constructing a westside sever trunk main and laterals and other general sever system im- provements, as authorized by the Constitution and laws of the State of Texas, and the Charter of said City." PROPOSITION NO. 2 "Shell the City Council of the City of Corpus Christi, Texas, be authorized to issue the bonds of said City in the amount of $3,305,000.00, maturing serially in such installments as the City Council may prescribe, the maxl7man maturity being not more then Thirty Five (35) years from their date, bearing interest at a rate not to exceed Five (5 %) per cent per annum, and to levy a tax on all tax- able property within said City sufficient to pay the annual interest and provide a sinking Pimd to pay the bonds at maturity, for the purpose of constructing a sever relief line in the South Staples Street area, providing funds for rehabilitating and expanding Oso sever plant and other general sever system improvements, as authorized by the Constitution and lave of the State of Texas, and the Charter of said City." PROPOSITION NO. 3 "Shall the City Council of the City of Corpus Christi, Texas, be authorized to issue the bonds of said City in the amount of $1,720,000.00, maturing serially in such installments as the City Council may prescribe, the maximiml maturity being not more than Thirty Five (35) years from their date, bearing interest at a rate not to exceed Five (5 %) per cent per annum, and to levy a tax on all tax- able property within said City sufficient to pay the annual interest and provide a sinking fund to pay the bonds at maturity, for the purpose of constructing storm sever im- provements in the City, including such improvements in the area of Whelan Drive, sections of Gollibar Road and Green- wood Drive, Thompson Road, McBride Lane, Cliff Maus Airport Area, sections of McArdl.e Road and Westport area between Morgan Street and Greenwood Drive, as authorized by the Constitution and lave of the State of Texas, and the Charter of said City." PROPOSITION N0. 4 "Shall the City Council of the City of Corpus Christi, Texas, be authorized to issue the bonds of said City in the amount of $195,000.00, maturing serially in such installments as the City Council may prescribe, the maximum maturity being not more than Thirty Five (35) years from their date, bearing interest at a rate not to exceed Five (5 %) per cent per annum, and to levy a tax on all tax- able property within said City sufficient to pay the annual interest and provide a sinking fund to pay the bonds at maturity, for the purpose of constructing and equipping a branch library for the City, as authorized by the Consti- tution and laws of the State of Texas, and the Charter of said City." • ; and PROPOSITION NO. 5 "Shall the City Council of the City of Corpus Christi, Texas, be authorized to issue the bonds of said City in the amount of $775,000.00, maturing serially in such installments as the City Council may prescribe, the maximum maturity being not more than Thirty Five (35) years from their date, bearing interest at a rate not to exceed Five (5 %) per cent per annum, and to levy a tax on all tax- able property within said City sufficient to pay the annual interest and provide a sinking fund to pay the bonds at maturity, for the purpose of constructing improvements to the streets of the City, including improvements to Green- wood. Drive, Santa Fe Street, Everhart Road and North Staples Street, as authorized by the Constitution and laws of the State of Texas, and the Charter of said City." WeERFAS, said election was duly held at the time and places specified after due notice as required by law had been given by post- ing and publication; and votes: WHEREAS, there were cast at said election the following PROPOSITION NO. 1 "FOR THE ISSUANCE OF WESTSIDE SEWER SYSTEM Votes; IMPROVE��NT BONDS" "AGAINST THE ISSUANCE OF WESTSIDE SEWER SYSTEM IMPROVEMENT BONDS" 3 r Votes. PROPOSITION NO. 2 "FOR THEISSUANCE OF SOUTH STAPLES AND OSO ���,�/ SEWER SYSTEM nAMVEMENT BONDS" / T Votes; "AGAINST THE ISSUANCE OF SOUTH STAPLES AND 5 OSO SEWER SYSTEM IMPROVEMENT BONDS" ho votes. PROPOSITION NO. 3 "FOR THE ISSUANCE OF STORM SEWER BONDS" Votes; "AGAINST THE ISSUANCE OF STORM SEWER BONDS" 3.0 q Votes. PROPOSITION N0. 4 "FOR THE ISSUANCE OF LIBRARY BONDS" Votes; "AGAINST THE ISSUANCE OF LIBRARY BONDS" voter PROPOSITION NO. 5 "FOR THE ISSUANCE OF STREET IMPROVEMENT Votes; BONDS"� "A TTH ISSUANCE OF STBEET IMPROVE- PjL�lfsVotes, as is reflected in the election returns heretofore filed with the City Secretary; and WHEREAS, only qualified taxpaying voters owning taxable property in said City and who had duly rendered their property for taxation were allowed to vote; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: 1. That said election was duly called; that notice was given in accordance with law and in accordance with the ordinance calling the election; that the election was held in accordance with law; that the returns of said election have been made by the proper officers; that a majority of the qualified voters who own taxable property in said City and who have duly rendered the same for taxation voting at said election have voted in favor of the issuance of said bonds. 2. That the City Council be and it is hereby in all things authorized to issue said bonds and to do any and all things necessary or convenient in connection therewith. 3. That the public importance and the pressing need for the permanent improvements to be constructed by use of the proceeds of the sale of said bonds create an emergency and an imperative public necessity requiring the suspension of roles and Charter provisions requiring same to be considered and voted upon at three regular meetings, and such facts re- quire that this ordinance be passed and take effect immediately as an emergency measure, and such rules and provisions are hereby suspended and this ordinance is passed and shall take effect as an emergency measure, and sba11 be in full force and effect immediately upon its passage.
