HomeMy WebLinkAbout06170 ORD - 06/07/1961IMS :Mw 6 -7 -61 • AN ORDINANCE CLOSING THE SOUTH PORTION OF THE ALLEYWAY EXTENDING NORTH AND SOUTH BETWEEN BLOCKS 22 AND 23, DEL MAR ADDITION; ACCEPTING AN ALLEY AND UTILITY EASEMENT ON AND ACROSS PORTIONS OF LOTS 15 AND 16, BLOCK 23, DEL MAR ADDITION, IN LIEU OF THE ALLEYWAY HEREBY CLOSED; AND DECLARING AN EMERGENCY. WHEREAS, PETITION WAS FILED WITH THE CITY COUNCIL FOR THE CLOSING OF THE SOUTH PORTION OF THE ALLEYWAY EXTENDING NORTH AND SOUTH BETWEEN BLOCKS 22 AND 23, DEL MAR ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, 130 FEET IN LENGTH EXTENDING NORTHWARD FROM THE SOUTHEAST CORNER OF BLOCK 22 OF SAID DEL MAR ADDITION; AND WHEREAS, NOTICES HAVE BEEN ISSUED AND HEARING HELD IN ACCORDANCE WITH THE REQUIREMENTS OF THE CITY CHARTER AND ORDINANCES RELATING TO THE CLOSING OF STREETS AND ALLEYS; AND WHEREAS, THE FIRST STATE BANK OF CORPUS CHRISTI HAS EXECUTED, DELIVERED AND PLACED OF RECORD IN THE COUNTY CLERK'S OFFICE AN EASEMENT FOR ALLEY AND UTILITY PURPOSES WHICH WILL EXTEND ON AND ACROSS A PORTION OF LOTS 15 AND 16 IN BLOCK 23, DEL MAR ADDITION, FOR THE USE OF UTILITY INSTALLATIONS AND THE PUBLIC, IN LIEU OF THE ALLEY HEREAFTER ABANDONED AND CLOSED; AND WHEREAS, THE CITY COUNCIL FINDS THAT IT IS IN THE PUBLIC INTEREST TO RELOCATE SAID ALLEY BY THE CLOSING OF SAID PORTION EXTENDING BETWEEN BLOCKS 22 AND 23, AND ESTABLISHING AN ALLEY AND UTILITY EASEMENT ON AND ACROSS LOTS 15 AND 16 IN BLOCK 23, DEL MAR ADDITION, IN LIEU THEREOF: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT IN THE PUBLIC INTEREST THE SOUTH 130 FEET OF THE ALLEYWAY AND UTILITY EASEMENT EXTENDING IN A NORTH AND SOUTH DIRECTION BETWEEN BLOCKS 22 AND 23 OF DEL MAR ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, AS SHOWN BY THE MAP OR PLAT OF SAID ADDITION ON FILE IN THE RECORDS OF THE COUNTY CLERK'S OFFICE, NUECES COUNTY, TEXAS, IS HEREBY CLOSED AND ABANDONED AS A UTILITY EASEMENT AND 6170 • • PUBLIC ALLEY, AND IN LIEU THEREOF THERE IS HEREBY ACCEPTED BY THE CITY A UTILITY AND ALLEY EASEMENT ON AND ACROSS LOTS 15 AND 16 IN BLOCK 23 OF DEL MAR ADDITION TO THE CITY OF CORPUS CHRISTI, A COPY OF WHICH EASEMENT IS ATTACHED HERETO AND MADE A PART HEREOF. SECTION 2. THE NECESSITY FOR IMMEDIATELY MAKING A PUBLIC RECORD OF THE FINDINGS OF THE COUNCIL AND DECISION TO ABANDON SAID PORTION OF SAID ALLEYWAY AND ACCEPT A NEW ALLEYWAY AND UTILITY EASEMENT IN LIEU THEREOF CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS APPROVED THIS 7 DAY OF ATTEST: AGE, IT IS ACCORDINGLY PASSED AND , 1961.
