HomeMy WebLinkAbout06341 ORD - 11/22/1961JKH :11 -21 -61 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO ACCEPT AN EASEMENT FROM THE CORPUS CHRISTI INDEPENDENT SCHOOL DISTRICT, SAID EASEMENT BEING DESCRIBED AS A TRACT OF LAND 30 FEET IN WIDTH AND 2,601.$7 FEET IN LENGTH AND BEING THE NORTH 30 FEET OF THE NORTH 1/2 0? LOT SECTION 2 OF THE BOHEMIAN COLONY LANDS, ALL AS MORE FULLY DESCRIBED IN THE EASEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER, BE AND HE IS HEREBY AUTHORIZED AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO ACCEPT AN EASEMENT FROM THE CORPUS CHRISTI INDEPENDENT SCHOOL DISTRICT, SAID EASEMENT BEING DESCRIBED AS A TRACT OF LAND 30 FEET IN WIDTH AND 2,601.57 FEET IN LENGTH AND BEING THE NORTH 30 FEET OF THE NORTH ONE -HALF OF LOT 3, SECTION 2 OF THE BOHEMIAN COLONY LANDS, ALL AS MORE FULLY DESCRIBED IN THE EASEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF. SECTION 2. THE NECESSITY TO ACCEPT FROM THE CORPUS CHRISTI INDEPENDENT SCHOOL DISTRICT THE AFOREMENTIONED EASEMENT CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SMALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY PASSED AND APPROVED, THIS THE DAY OF NOVEMBER, 1961. 7 ATTES �3,.a CITY SEC E AR)) / MAYORTHE ITY bCCHRISTI, TEXAS APPRDVED AS Y0 LEGAL FORT THIS .LL DAY OF NOVEMBER, 1961: CITY At4ORN'ER F, TAE STATE OF TAB COUNTY OF WJECW WHEREAS, at a meeting of the Board o° Trustees of the Corpus Christi Independent S'chh�ool District, duly called and held in Corpus Christi, Texas, on �/ 0 , 1961, at which a quorum was pre- sent, the following resolution was unanimously adopted: "BE IT RESOLVED, that the Corpus Christi Independent School District grant and convey unto the City of Corpus Christi, Texas, a municipal corporation duly incorporated under and by virtue of the laws of the State of Texas, its successors and legal representa- tives, the free and uninterrupted use, liberty, priv- ilege and easement of going in, on, over, under and along that certain tract of land situated in Nueces County, Texas, described as follows: A tract of land 30 feet in width and 26ol.8T feet in length and being the north 30 feet of the north 112 of Lot 3, Section 2 of the Bohe- mian Colony lands as shown by map or plat of record in Vol. A. page 48 of the Map Records of Aueces County, Texas, to which reference is hereby made for more particular description; together with the free ingress, egress and regress to and for the City of Corpus Christi, Texas, for the pur- pose of constructing streets, sidewalks, curbs, gutters and appurtenances upon said tract and way for the public use by foot, with automobiles, carts, carriages, and all other vehicles and all other means of transportation necessary or convenient at all times and in all seasons In, along, and upon said tract and way, as well as for laying, repairing, servicing, and mintaining of public utility lines and storm sewers in, on, over, under and along said tract or way. TO HAVE AND TO HOLD, all and singular, the rights and privileges aforesaid to the City of Corpus Christi, Texas, its succeosors and legal representatives and the public, for the proper use as public streets and utility easements or utility easemento for so long as used for such purpose or any of them, and if the use of said tract and way for all of said uses shall ever ceass, then, in that event, the aforesaid rights and privileges hereinabove granted to the City of Corpus Christi, Texas, shall automatically teminaee and revert to the Corpus Christi Independent School District, its successors and assigns. 1961.
