AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER,
FOR AND ON BEHALF OF THE CITY OF CORPUS
CHRISTI, TO ACCEPT A QUITCLAIM DEED FROM THE
SOUTHERN PACIFIC COMPANY BY WHICH SAID SOUTHERN
PACIFIC COMPANY DONATES AND QUITCLAIMS UNTO THE
CITY OF CORPUS CHRISTI THAT PROPERTY KNO!JN AS THE
OLD EPWORTH WYE PROPERTY ON CORPUS CHRISTI BEACH
IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS,
CONSISTING OF 3.57 ACRES OF LAND TO BE USED FOR
PANK ANU FLATUROUND PURPOSES, ALL AS MORE FULLY
SET FORTH IN THE QUITCLAIM DEED, A COPY OF WHICH
IS ATTACHED HERETO AND MADE A PART HEREOF; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED
AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO ACCEPT
A QUITCLAIM DEED FROM THE SOUTHERN PACIFIC COMPANY BY WHICH SAID
SOUTHERN PACIFIC COMPANY DONATES AND QUITCLAIMS UNTO THE CITY OF CORPUS
CHRISTI THAT PROPERTY KNOWN AS THE OLD EPWORTH WYE PROPERTY ON CORPUS
CHRISTI BEACH IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS,
CONSISTING OF 3.57 ACRES OF LAND TO BE USED FOR PARK AND PLAYGROUND
PURPOSES, ALL AS MORE FULLY SET FORTH IN THE QUITCLAIM DEED, A COPY
OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF.
SECTION 2. THE NECESSITY TO ACCEPT THE AFORESAID QUITCLAIM
DEED FOR THE PURPOSES THEREIN DESCRIBED CREATES A PUBLIC EMERGENCY
AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE
CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY
ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION
SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE
MAYOR, HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND
HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED, AND THAT THIS
ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE
EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE,
IT IS ACCORDINGLY PASSED AND APPROVED THIS THE_/d7 DAY of JANUARY,

COUNTY OF NUECES I KNOW ALL MEN BY THESE PRESENTS:
THAT, the Southern Pacific Company, a Delaware Cor-
poration, hereinafter sometimes called `Grantor ", for and in
consideration of the benefit to be derived from the development
of a public park and playground by the City of Corpus Christi,
a municipal corporation of the State of Texas, by these presents
does Donate, Sell, Release and forever Quitclaim, unto the said
City of Corpus Christi, all of its right, title and interest, in
and to that certain tract or parcel of land situated at Corpus
Christi, Nueces County, Texas, and more particularly described
as follows, to -wit:
Being Grantor's old Epworth Wye property
bounded on the West by a line that is twenty
five feet (25') east of and parallel to the
centerline of Grantor's fifty foot (500) main
track right of way, on the South by the North
boundary line of Epworth Place, on the East
by the West boundary line of North Shoreline
(Avenue A) and on the North by the old Epworth
Encampment Grounds, as shown on map of Corpus
Reach Hotel Addition of record in Volume 1,
Page 51, of the Nap Records of Nueces County
Texas, and containing 3.87 acres of land more
or less.
Grantor hereby reserves to itself, its successors and
assigns,all of the oil, gas, sulphur and other minerals, 11im
as well as unlike, in, on and underlying the herein described
premises, without however, any right whatsoever to use the surface
of the land herein described for arW purpose in connection there-
with.
TO RAVE AND TO HOLD the said promises hereinabore
described, together with all rights, hereditaments and appur-
tenanoes thereto belonging unto the said City of Corpus Christi,
Its successors and assigns forever, so that nsithsr the Southern
Pacific Company, nor any person or persons claiming under the
Southern Pacific Company, shall, at any time hereafter, have
or claim mW right, title or interest, in or to said premises,
or any part thereof -
