AVENUE TO RUTH STREET; AND ON KENWOOD DRIVE,-ADJACENT TO ROBERT DRISCOLL :SCHOOL
FROM INTERSECTION OF'OLD ROBSTOWN ROAD EASTERLY, APPROXIMATELY-567 FEET, AS TO
THE SPECIAL BENEFITS TO ACCRUE TO SAID PROPERTY AND THE REAL AND TRIPE OWNERS
THEREOF BY VIRTUE OF THE IMPROVEMENTS OF SAID STREETS WITHIN SAID LIMITS, AND
AS TO ANY ERRORS, AND INVALIDITIES OR IRREGULARITIES IN ANY OF THE PROCEEDINGS
OR CONTRACT THEREOF; FINDING AND DETERMINING THAT THE PROPERTY ABUTTING UPON
SAID STREETS WITHIN THE LIMITS DEFINED WILL BE SPECIALLY BENEFITTED AND ENHANCED
IN VALUE IN EXCESS OF THE AMOUNT OF THE COST OF SAID IMPROVEMENTS PROPOSED TO BE
ASSESSED AGAINST SAID PROPERTY ABUTTING UPON SAID RESPECTIVE STREETS WITHIN THE
LIMITS DEFINED AND LEVYING AN ASSESSMENT AGAINST THE PROPERTY AND THE OWNERS
THEREOF, ABUTTING UPON SAID STREETS; AND DECLARING AN EMERGENCY.
WHEREAS, the following STREETS were ordered improved;
1. LUM STREET FROM AIRLINE ROAD TO GOLLIHAR ROAD
2. ELESA STREET FROM MARY STREET To RUTH STREET
CHIPPEWA STREET FROM ELEANOR STREET TO FRANCESCA STREET
RUTH STREET FROM ELEANOR STREET To FRANCESCA STREET
5. ELEANOR STREET FROM CHIPPEWA STREET TO RUTH STREET
6. FRANCESCA STREET, FROM HIGHLAND AVENUE TO RUTH STREET
7. KENWOOD 'DRIVE ADJACENT To ROBERT DRISCOLL SCHOOL FROM
INTERSECTION OF OLD ROBSTOWN ROAD EASTERLY APPROX. 567 FEET,
as more particularly shown by proceedings heretofore had; and
WHEREAS, a contract was duly 'entered into by the City of Corpus Christi
for the improvement of said streets as is more particularly shown by the terms of the
said contract and proceedings had for same; and
WHEREAS, by ordinance passed on the 15 day of AUGUST , A.D. 19 62,
the City Council of the City of Corpus Christi determined the necessity of levying an
assessment against the property and theowners thereof, abutting upon the said streets
and portions thereof named above; and
WHEREAS, in accordance with the law, the said owners of said property and
their agents were duly notified to appear before the City Council of the City of
Corpus Christi, in the Council Chamber in the City Hall on the 3RD day of OCTOBER
A.D., 19 62, at 3:00 o'clock P.M., at which time all of said owners, their agents
and attorneys, and all persons interested in said property were notified of the de-
termination of the City Council to fix the proportionate amount of the cost of the
said pavement against the said property and the owners thereof, and the said owners
were allowed to make such protest, remonstrances, and objections as they deemed
advisable; and
WHEREAS, all of the said owners were duly notified, and the said hearing has
been continued from time to time, and no protests have been made; and
WHEREAS, The City Council, after fully considering the proportionate amount
to be paid by each of the said property owners, and the particular amount that the
said property owners and their property would be benefited and enhanced in value by

Mayor McDonald announced the public hearing scheduled for 3:00 p.m.
on Assessments for the proposed street improvements to Lum Street, Streets in
the De Zavala School area, and Kenwood Drive adjacent to Driscoll School.
Joe Pierce, Paving Coordinator, presented the plans for the improve-
ments and the preliminary assessment roll; testified under oath as to the
nature, extent and specifications of the proposed improvements; the cost of
copstruction; the amount of cost to be borne by the City, and the amount to be
assessed against the abutting property owners; the manner in which such pro
x
rata share was computed; and explained that the improvements are being made
under this Council's Voluntary Street Improvement Assessment Program.
W. A. (Bill) Roberts testified under oath as to his background and
experience which he felt qualified him as a real estate appraiser for all types
of properties in this City; testified that he had personally viewed and under-
stood the extent and specifications of the proposed improvements; that he had
personally viewed within the past week the assessment roll and each of the
properties to be assessed; and that in his opinion, each of the properties so
assessed would be enhanced to more than the extent of the proposed assessment,
with no exceptions.
Assistant City Attorney James S. Tunnel asked if anyone in the
audience had any questions or objections to offer with regard to any of the
proposed improvements relative to the project.
D. M. Espinosa, owner of Lots 13 and 24, Block 5, Seikel Addition, '
speaking for himself and others in the area, questioned the omission of im-
provement of Elesa Street from Mary to Highway 44. It iras explained. that Mr.
Marstoa, owner. of the wbutting property on - both "sides 6k that portion *of Elesa
had•declined to� participate in the program, and after some discussion, Mayor
McDonald suggested that the Council's Sub - committee again contact Mr. Marston
in the matter.

properties on both sides of Eleanor and on the West side of Elesa, all South of
Chippewa, and the necessary right -of -way to open Chippewa from Eleanor to Osage,
and if consummated, they desire to close Chippewa from Eleanor to Francesca and
close Elesa South of Chippewa, thus making a solid school tract containing Ella'
Barnes Junior High School and De Zavala Elementary School with no intervening
streets; and requested that the proposed Chippewa Street improvements from
Eleanor to Francesca at least be delayed to give them an opportunity to carry
out this plan.
No one else appeared to be heard.
Motion by Barnard, seconded by Swantner and passed that the hearing be
closed and the Assessment Roll adopted as presented, but that no Work Order be
issued on that portion of Chippewa from Francesca to Eleanor for a period not
to exceed 90 days in order to give the School District an opportunity to carry°
out the plan presented at this hearing.

applicable law, and that the said hearing heretofore referred to be, and the same is
hereby closed:

NOW, THEREFORE, BE IT =WPM BY THE CITY COUNCIL OF TEE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. That the revised assessment be, and the same is hereby made
against the property and the owners thereof abutting upon the said street, and whose
property is specially benefited by reason of making said improvement in the amounts
shown in said assessment; and the hearing heretofore had be and the same is hereby
closed.
SECTION 2. The need for promptly determining the assessments against
property owners and closing the hearing on assessments creates a public emergency and
an imperative public necessity requiring the suspension of the Charter Rule that no
ordinance or resolution shall be passed finally on the date of its introduction and
that such ordinance or resolution shall be read at three several meetings of the City
Council, and the Mayor, having declared such emergency and necessity to exist, having
requested the suspension of said Charter rule and that this resolution be passed
finally on the date of its introduction and that this resolution take effect from and
after its passage, IT IS ACCORDINGLY PASSED AND APPROVED, this the1(Lday of
