AMENDING ORDINANCE NO. 8670 PASSED AND APPROVED BY
THE CITY COUNCIL ON THE lath DAY OF JULY, 1962, BY
AMENDING SECTION 3 OF SAID ORDINANCE CORRECTING AND
ADJUSTING THE ASSESSMENTS LEVIED AGAINST ABUTTING
PROPERTY OWNERS ON EVERHART ROAD FROM TEE WEST
BOUNDARY LINE OF PARKDALE DRIVE TO TBE SOUTHEAST
BOUNDARY LINE OF LEXINGTON BOULEVARD= AND DECLARING
AN EMERGENCY.
BE IT ORDAINED BY TEE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1, That Section 3 of Ordinance No. 6670, passed and approved
by the City Council on the 11th day of duly, 1962s is hereby amended and said
Section 3 of said ordinance shall hereafter read as follows, to�wit:
"SECTION 3. That in pursuance of said ordinance, duly enacted, by
said City Council, authorizing and ordering the improvement of Everhart Road from
the West boundary line of Parkdale Drive to the Northeast boundary line of Lexington
Boulevard, and in pursuance of said proceedings heretofore bad and enacted by said
City Council in reference to said improvements and by virtue of the powers vested
in said City with respect to said street improvements by the Laws of the State of
Texas and the Charter of said City, with particular reference to Chapter 106 of
the Acts of the First Called Session of the 40th Legislature of the State of Texas,
known and shown as Article 1105�b of vernon*s Annotated Civil Statutes of Texas,
as amended, there shall be, and is hereby levied, assessed and taxed against the
respective parcels of property_. abutting upon said portion of said street, and
against the real and true owners thereof, whether such real and true owner or owners
be named or correctly named herein or not, the several sums of money hereinbelow
mentioned and itemized opposite the description of the respective parcels of said
property, and the number of front feet of each and the several amounts assessed
against same and the real and true owner or owners thereof, and the names of
the apparent owners thereof, all as corrected and adjusted by said City Council,
being as follows, to -wit:

F&:qMT BOAD FROM PART&LE ISM TO IUMGTON BOULEVARD
Everhart Road from the intersection of Parkdale Drive to Lexington Boulevard,
to be improved by: excavating to a width eighteen (18) inches back of proposed
curbs, and to a depth to perimi.t.the construction of a five (5) inch lime sta-
bilized base, four (4) inch compacted caliche.base, W and oge -half (21-2)
inch Type "A" asphaltic concrete and one and one -half (lz) inch Type "D" as-
phaltic concrete surface. Pavement width will be forty four (14) feet face
to face of curb, from Parkdale Drive to Sta. 13 {90 or approximately two hundred
thirty (230) feet before the intersection of 'Janssen Drive and Everhart Road.
Because of existing curb and gutter at this point the pavement width 'become
fifty feet and six inches (50.5) from fate to face of comb and( continues this
width to Mt. Vernon Drive intersection, thence forty four (44) feet wide to
Lexington Boulevard.
The assessment rates for the above project are:
Property zoned and used other than R -1 or R -2 for
curb, gutter and pavement $8.55 p-1 -f.
Property zoned and used R -1 or R -2 $3 B %1•f
Property zoned and used R -1 Or R -2 and having existing
curb and gutter $5.13 P.1 -f.
Six (6) Inch reinforced concrete driveway $0.80 ps.f.
Four (4) inch reinforced concrete sidewalk $0.38 p.s.f.
Full credit has been given for all existing sidewalk and driveways which must
be replaced to fit new grades. A pro -rata credit for existing curb and gutter
based on a life expectancy.of 20 years has also peen given.

SECTION 2. The necessity for amending said Ordinance No. 6570
in order to correct and adjust assessments against the abutting properties
and the real and true owners thereof, creates a public emergency and an
imperative public necessity, requiring the suspension of the Charter Rule that
no ordinance or resolution shall be passed finally on the date of its
Introduction, and that said ordinance shall be read at three several meetings
of the City Council, and the Mayor having declared that such emergency and
imperative public necessity exists, and having requested that the Charter Rule
be suspended and that this ordinance be passed finally on the date of its Intro-
duction and that this ordinance take effect and be in full force and effect from
and after its passage, IT IS ACCORDINGLY SO ORDAINED.
