HomeMy WebLinkAbout06729 ORD - 12/19/1962EE:12 -17 -62 • AN ORDINANCE AUTHORIZING EXECUTION BY THE CITY MANAGER OF AN AGREEMENT WITH THE STATE HIGHWAY COMMISSION FOR THE ESCROW OF FUNDS, PREVIOUSLY APPROPRIATED BY ORDINANCE NO. 6705, PASSED AND APPROVED ON NOVEMBER 28, 1962, FOR THE PAYMENT OF COSTS OF CONSTRUCTION, INCLUDING CONTINGENCIES AND CON- STRUCTION ENGINEERING OF A,STREEP ILLUMINATION SYSTEM ON INTERSTATE 37 BETWEEN WACO STREET AND PEABODY STREET; AUTHORIZING AND DIRECTING THE CITY MANAGER TO DO SUCH OTHER THINGS AS MAY BE NECESSARY TO FACILITATE THE CITY'S PART OF THE CONSTRUCTION AND PAYMENT OF THE CITY'S PORTION OF THE PAYMENT OF THE COSTS OF THE SAID ILLUMI- NATION SYSTEM; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER IS HEREBY AUTHORIZED AND DIRECTED TO EXECUTE AN AGREEMENT WITH THE STATE HIGHWAY COMMISSION FOR THE ESCROW OF FUNDS PREVIOUSLY APPROPRIATED BY ORDINANCE N0. 6705, FOR THE PAYMENT OF THE COSTS OF CONSTRUCTION, INCLUDING CONTINGENCIES AND CONSTRUCTION ENGINEERING OF A STREET ILLUMINATION SYSTEM ON INTER- STATE 37 BETWEEN WACO AND PEABODY STREETS. SECTION 2. THAT THE CITY MANAGER IS HEREBY AUTHORIZED AND DIRECTED, IN BEHALF OF THE CITY OF CORPUS CHRISTI, TO DO SUCH OTHER THINGS AS MAY BE NECESSARY TO FACILITATE THE CITY'S PART OF THE CON- STRUCTION AND PAYMENT OF THE CITY'S PORTION OF THE PAYMENT OF THE COSTS OF SAID ILLUMINATION SYSTEM. SECTION 3. THE NECESSITY FOR EXECUTING AN AGREEMENT AND DO- ING SUCH OTHER THINGS AS ARE NECESSARY IN ORDER TO FACILITATE THE CITY'S PART IN CONNECTION WITH THE AFORESAID PROJECT, CREATES A PUBLIC EMER- GENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED 6 -729 6- CORPUS CHRIST1,TEXAS r- OF / -� , 99�� To THE MEMBERS OF THE CITY COUNCIL CORPUS CHRIsTI,.TEXAS FOR THE REASONS SET FORTH IN' THE EMERGENCY CLAUSE OF THE FORE- GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPENSION-OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT 18 INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION BHALL BE READ AT THREE MEETINGS OF THE CITY ,COUNCIL; I'p THEREFOREV HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRODUCEDp OR AT THE PRESENT MEETING OF THE CITY COUNCIL. YOUNG r C 74 -6-48 1- 37- 1(16) 000 Nueces County STATE IF TELLS COUNTY OF TRAVIS THIS AOREEMT, made this day of , 1962, by and between the City of Corpus Christi, Texas, hereinafter called the "City", Party of the First Part, acting by and through its City Manager and the State of Texas, hereinafter called the "State ", Party of the Second Part, acting by and through its State High— wary Commission. WHEREAS, it is the desire of the State and City to construct a roadway illumina- tion system within the limits from Waco Street in Corpus Christi to Peabc.dy Street in Corpus Christi on Interstate Highway No. 37. The State will construct or have constructed this work and the City will pay fifty per cent (50%) of the construc- tion cost of this work, estimated to cost Fifty Three Thousand Nine Hundred and No/100 Dollars ($53,900.00), including contingencies and construction engineering. The Cltyts estimated share of the cost of this work amounts to Twenty Six Thousand Nine Hundred Fifty and No /loo Dollars ($26,950.00). NOW THBTHCRE, it is understood that this proposed work, consisting of the construction of a roadway illumination system within the limits from Waco Street in Corpus Christi to Peabody Street in Corpus Christi on Interstate Highway No. 37, will be constructed by the State. The total estimated construction cost of this work amounts to Fifty Three Thousand Nine Hundred and No /100 Dollars ($,53,900.00), including contingencies and construction engineering. The City will pay fifty per cent (50 %) of the construction cost of this work and it is estimated the Cityts share is Twenty Six Thousand Nine Hundred Fifty and No /100 Dollars ($26,950.00), and the City will transmit to the State with the return of this agreement, executed by the City, a warrant made payable to the State Treasurer, Account of Trust Fund 2.
