AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER,
FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI,
TO EXECUTE AN AGREEMENT WITH THE OWNERS OF THE
SURF APARTMENTS, ESTABLISHING THAT THE RIGHT OF
WAY OF WATER AND POWER STREETS AS SHOWN ON THE
MAP OR PLAT OF BEACH PORTION, OF RECORD IN THE
MAP RECORDS OF NUECES COUNTY, TEXAS,`IS CORRECT
AND 'HAT THE RIGHT OF WAY AS SHOWN ON SAID MAP
AS WATER AND POWER STREETS IS PUBLIC RIGHT OF WAY
AND PUBLIC STREETS, AND TO PERMIT THE CONTINUANCE
OF EXISTENCE OF THE BUILDING OWNED BY THE OWNERS OF
THE SURF APARTMENTS, LOCATED ON LOT 1, BLOCK 45,
BEACH PORTION, NUECES COUNTY, TEXAS, ABUTTING RIGHT
OF WAY AND EXTENDING INTO THE PUBLIC RIGHT OF WAY OF
WATER STREET AND POWER STREETS, ALL AS MORE FULLY
DESCRIBED IN THE AGREEMENT, A COPY OF WHICH IS AT-
TACHED HERETO AND MADE A PART HEREOF; AND DECLARING
AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. THAT THE CITY MANAGER, ACTING FOR AND ON BEHALF
OF THE CITY OF CORPUS CHRISTI, IS HEREBY AUTHORIZED AND DIRECTED TO
EXECUTE AN AGREEMENT WITH HUGH WARREN HERNDON, EXECUTOR OF THE ESTATE
OF CARRIE ELLEN HERNDON, DECEASED, OWNERS OF THE SURF APARTMENTS,
ESTABLISHING THAT THE RIGHT OF WAY OF WATER AND POWER STREETS, AS
SHOWN ON THE MAP OR PLAT OF BEAOW-PORTION, OF RECORD IN THE MAP RECORDS
OF NUECES COUNTY, TEXAS, IS CORRECT AND THAT THE RIGHT OF WAY AS SHOWN
ON SAID MAP AS WATER STREET AND POWER STREET IS PUBLIC RIGHT OF WAY AND
PUBLIC STREETS, AND TO PERMIT THE CONTINUANCE OR EXISTENCE OF THE
BUILDING OWNED BY THE ESTATE OF CARRIE ELLEN HERNDON, DECEASED, LOCATED
ON LOT 1, BLOCK 45, BEACH PORTION, ABUTTING RIGHT OF WAY OF AND EXTENDING
INTO PUBLIC RIGHT OF WAY OF WATER AND POWER STREETS, ALL AS MORE FULLY
DESCRIBED IN THE AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE
A PART HEREOF.
SECTION 2. THE NECESSITY TO EXECUTE THE AGREEMENT AS OUTLINED
IN SECTION 1 HEREINABOVE CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE
PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO
ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS
INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT
THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING
DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED

THAT SUCH CHARTER RULE BE SUSPENDED, AND THAT THIS ORDINANCE BE PASSED
FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL
FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO
ORDAINED THIS THE AY OF JANUARY, 1963.
