HomeMy WebLinkAbout06764 ORD - 01/17/1963• IMS :JKH :1 -16 -63 • AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A CLARIFICATION AGREEMENT BETWEEN THE CITY AND THE CORPUS CHRISTI TENNIS ASSOCIATION CLARIFYING THE PROVISIONS OF A LEASE AGREEMENT HERETOFORE ENTERED INTO ON APRIL 6, 1962, CON- CERNING CERTAIN LAND AND PREMISES LOCATED IN THE H. E. BUTT TENNIS AREA, IN THE CITY OF CORPUS CHRISTI, ALL AS MORE FULLY SET OUT IN THE CLARIFI- CATION AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A CLARIFICATION AGREEMENT BETWEEN THE CITY AND THE CORPUS CHRISTI TENNIS ASSOCIATION, CLARIFYING THE PROVISIONS OF A LEASE AGREEMENT HERETOFORE ENTERED INTO BY SAID PARTIES ON APRIL 6, 1962, CONCERNING CERTAIN LAND AND PREMISES LOCATED IN THE H. E. BUTT TENNIS AREA, IN THE CITY OF CORPUS CHRISTI, ALL AS MORE FULLY SET OUT-IN THE CLARIFICATION AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF. SECTION 2. THE NECESSITY TO IMMEDIATELY CLARIFY THE PROVI- SIONS OF THE LEASE AGREEMENT HERETOFORE ENTERED INTO BETWEEN THE CITY AND CORPUS CHRISTI TENNIS ASSOCIATION CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED THIS THE /7 DAY OF JANUARY, 1963. aTr � J` / CITY SECRETAI APPROVED AS TO LEGAL FORM THIS / DAY OF JANUARY,1963: CITY ATTORNEY Cf� MAYORpro.TBD1 THE CITY OF CORPUS CHRISTI, TEXAS 67E4 Tt Tcpa krd�a Pat ia1844 +aGA3 i T ft. tst ati iaiC Yl AE. i ilSY�MGA Mile' =+.
