AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND
ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE
A CONTRACT WITH HELDENFELS BROTHERS FOR CONSTRUCTION
OF THE LOWER .MCARDLE STORM SEWER, DESIGNATED AS PRO-
JECT N0. 295- 61 -24; APPROPRIATING OUT OF NO..295
STORM SEWER BOND FUND THE SUM OF $202,256.00 OF WHICH
AMOUNT $189,]]58.60 IS FOR THE CONSTRUCTION CONTRACT
AND $12,491.40 IS FOR CONTINGENCIES, INCLUDING ENGINEER-
ING,-LABORATORY AND LEGAL ADVERTISING COSTS; AND DE-
CLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY,
AUTHORIZED AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF
CORPUS CHRISTI, A CONTRACT WITH HELDENFELS BROTHERS FOR THE CONSTRUCTION
OF A STORM SEWER, SAID CONSTRUCTION TO CONSIST OF APPROXIMATELY 4520 FEET
OF MONOLITHIC CONCRETE BOX CONDUIT 7.51 X 51 REDUCING TO 51 X 51 AND
5000 FEET OF PIPE, 6011 TO 15" IN SIZE, ALONG MCARDLE ROAD FROM NOLAN TO
WOODLAWN THENCE TO OSO CREEK, ALL AS MORE FULLY SET OUT IN THE PLANS
AND SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE IN THE OFFICE OF THE
CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF BY REFERENCE, AND
ACCORDING TO THE BID OF HELDENFELS BROTHERS, OPENED ON THE 17TH DAY OF
JANUARY, 1963, THE SAID BID OF HELDENFELS BROTHERS BEING THE LOWEST AND
MOST ADVANTAGEOUS TO THE CITY OF CORPUS CHRISTI, TEXAS.
SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF NO. 295 STORM
SEWER BOND FUND THE SUM OF $202,250.00, OF WHICH AMOUNT $1$9,758.60 IS
FOR THE CONSTRUCTION CONTRACT AND $12,491.44 IS FOR CONTINGENCIES, IN-
CLUDING ENGINEERING, LABORATORY AND LEGAL ADVERTISING, ALL IN CONNECTION
WITH PROJECT N0. 295- 61-24.
SECTION 3. THE NECESSITY TO IMMEDIATELY BEGIN CONSTRUCTION
AS HEREINABOVE SET FORTH SO THAT ADDITIONAL STORM SEWER DRAINAGE FACILI-
TIES MAY BE PROVIDED CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC
NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE
OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION
AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL
MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH
PUBLIC EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THAT SUCH
CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE IN FULL FORCE
AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED

GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR
THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCIL; 1, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRODUCED,
