AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER,
FOR AND ON BEHALF OF THE CITY OF CORPUS
CHRISTI, TO EXECUTE A CONTRACT WITH HELDENFELS
BROTHERS FOR CONSTRUCTION OF THE NAVIGATION BOULE-
VARD STORM SEWER, UNIT I, DESIGNATED AS PROJECT
No. 295- 61 -30; APPROPRIATING OUT OF NO. 295 STORM
SEWER BOND FUND THE SUM OF $112,000.00, OF WHICH
AMOUNT $10 532.70 IS FOR THE CONSTRUCTION CON-
TRACT AND 6,167.30 IS FOR CONTINGENCIES, INCLUDING
ENGINEERING, LABORATORY AND LEGAL ADVERTISING COSTS;
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED
AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI,
A CONTRACT WITH HELDENFELS BROTHERS FOR CONSTRUCTION OF THE NAVIGATION
BOULEVARD STORM SEWER, UNIT 1, PROJECT No. 295- 61 -301 SAID CONSTRUCTION
TO CONSIST OF APPROXIMATELY 3655 FEET OF MONOLITHIC CONCRETE BOX CONDUIT
51 X 51, REDUCING TO 5' X 51, AND OTHER APPURTENANCES IN THE EASEMENT
MIDWAY BETWEEN NAVIGATION BOULEVARD AND SAVAGE LANE, GENERALLY
BETWEEN UP RIVER ROAD AND INTERSTATE HIGHWAY NO. 37, ALL AS MORE FULLY
SET OUT IN THE PLANS AND SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE
IN THE OFFICE OF THE CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF
BY REFERENCE, AND ACCORDING TO THE BID OF HELDENFELS BROTHERS OPENED ON
THE 17TH DAY OF JANUARY, 1963, THE SAID BID OF HELDENFELS BROTHERS BEING
THE LOWEST AND MOST ADVANTAGEOUS TO THE CITY OF CORPUS CHRISTI, TEXAS.
SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF NO. 295
STORM SEWER BOND FUND THE SUM OF $112,000.00, OF WHICH AMOUNT $103,832.70
IS FOR THE CONSTRUCTION CONTRACT AND $8,167.30 IS FOR CONTINGENCIES,
INCLUDING ENGINEERING, LABORATORY AND LEGAL ADVERTISING COSTS.
SECTION 3. THE NECESSITY TO IMMEDIATELY BEGIN CONSTRUCTION
AS HEREINABOVE SET FORTH TO PROVIDE A DRAINAGE SYSTEM FOR THE AREA
HEREINABOVE DESCRIBED, AND IN COOPERATION WITH STATE HIGHWAY 37 CONSTRUC-
TION CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY
REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION

AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL
MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH
PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY EXIST, AND HAVING
REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED, AND THAT THIS ORDINANCE
BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND
BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY
SO ORDAINED THIS THE DAY OF JANUARY, 1963.

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE-
GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR
THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCILS IS THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRODUCED,
OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
