AN ORDINANCE
GRANTING TO NUECES ELECTRIC COOPERATIVE, INC.,
ITS SUCCESSORS AND ASSIGNS, AN ELECTRIC LIGHT,
HEAT AND POWER FRANCHISE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. THERE IS HEREBY GRANTED TO NUECES ELECTRIC COOPERATIVE,
INC., ITS SUCCESSORS AND ASSIGNS, HEREINAFTER CALLED "GRANTEE ", THE RIGHT,
PRIVILEGE AND FRANCHISE FOR A TERM OF FIVE (5) YEARS FROM THE EFFECTIVE DATE
HEREOF TO CONTINUE TO FURNISH ELECTRIC ENERGY TO ANY DWELLING, STRUCTURE,
APPARATUS OR POINT OF DELIVERY TO WHICH THE CO- OPERATIVE CO P ATION WAS

DELIVERING ELECTRIC ENERGY ON THE DATE OF SUCH ANNEXATION AN IF ANY PERSON
DESIRES ELECTRIC SERVICE IN SUCH ANNEXED AREA FOR ANY DWELLING, STRUCTURE,
APPARATUS OR POINT OF DELIVERY WHICH WAS MT BEING SERVED BY THE COOPERATIVE
CORPORATION ON THE DATE THE AREA BECAME ANNEXED AND TO WHICH CENTRAL STATION
SERVICE IS NOT AVAILABLE FROM THE CITY OR TOWN OR A PUBLIC UTILITY CORPORATION,
THE CO- OPERATIVE CORPORATION MAY THEREAFTER FURNISH ELECTRIC ENERGY TO SUCH
DWELLINGS STRUCTURE, APPARATUS OR POINT OF DELIVERY, UNDERGROUND CONDUITS,
POLES, TOWERS, WIRES, TRANSMISSION LINES AND COMMUNICATION LINES FOR ITS
OWN USE, FOR THE PURPOSE OF SUPPLYING ELECTRICITY TO THE SAID CITY AND THE
INHABITANTS THEREOF AND PERSONS AND CORPORATIONS IN AND BEYOND THE LIMITS
THEREOF, FOR LIGHT, HEAT, POWER AND ANY OTHER PURPOSES FOR WHICH ELECTRICITY
MAY BE USED.
FOR AND AS FULL CONSIDERATION AND COMPENSATION FOR THIS FRANCHISE
AND THE RIGHTS, PRIVILEGES AND EASEMENTS GRANTED AND CONFERRED THEREBY AND
AS RENTAL FOR THE USE OF THE STREETS ALLEYS AND OTHER PUBLIC AREAS WITHIN OR
THAT MAY HEREAFTER BE WITHIN SAID CITY, THE GRANTEE SHALL PAY SAID CITY 2%
OF THE GRANTEES GROSS RECEIPTS DURING THE YEAR FROM THE SALE OF ELECTRIC
ENERGY IN AND FOR USE WITHIN THE CORPORATE LIMITS OF THE CITY OF CORPUS
CHRISTI, IN SEMIANNUAL INSTALLMENTS, AS FOLLOWS:
GRANTEE, WITHIN ONE MONTH OF JUNE 30 AND DECEMBER 31
OF EACH YEAR SHALL FILE WITH THE CITY SECRETARY A REPORT
SWORN TO BY ITS SECRETARY - TREASURER SHOWING ITS GROSS
RECEIPTS FOR THE SIX MONTHS PRECEDING JUNE 30 AND DECEMBER
31 AS THE CASE MAY BE FROM THE SALE OF ELECTRIC ENERGY IN
AND FOR USE WITHIN THE CORPORATE LIMITS OF THE CITY OF
CORPUS CHRISTI AND THE AMOUNT TO BE PAID HEREUNDER WILL
BE BASED UPON SAID REPORTS AND WILL BE PAID IN SEMIANNUAL
INSTALLMENTS ON OR BEFORE JULY 31 AND JANUARY 31, RESPECTIVELY.

SECTION g. POLES OR TOWERS SHALL BE SO ERECTED AS NOT TO UN-
REASONABLY INTERFERE WITH TRAFFIC OVER STREETS AND ALLEYS. THE LOCATION OF
ALL POLES AND TOWERS OR CONDUITS SHALL BE FIXED UNDER THE SUPERVISION OF THE
STREET AND ALLEY COMMITTEE OF THE CITY OF CORPUS CHRISTI, OR THE SUCCESSORS
TO THE DUTIES OF THAT COMMITTEE, BUT NOT SO AS TO UNREASONABLY INTERFERE WITH
THE PROPER OPERATION OF SAID LINES.
SLCIION 3. IHE PROPERTY OF GRANTEE SHALL BE MAINTAINtu IN GOOD
ORDER uURING THE LIFE OF THIS GRANT, AND THE SERVICE FURNISHED HEREUNDER TO
SAID CITY AND ITS INHABITANTS SHALL BE FIRST CLASS IN ALL RESPECTS AND AT
REASONABLE RATES, AND SHALL SE SUBJECT TO SUCH REASONABLE RULES AND FE GULATIONS
AS THE GRANTEE MAY MAKE FROM TIME TO TIME. THIS FRANCHISE MAY BE FORFEITED IN
A COURT OF COMPETENT JURISDICTION BY THE CITY OF CORPUS CHRISTI FOR FAILURE
OF THE GRANTEE TO FURNISH EFFICIENT SERVICE AT REASONABLE RATES AND /OR TO MAIN-
TAIN THE PROPERTY IN GOOD ORDER THROUGHOUT THE LIFE OF THIS GRANT. THE
GRANTEE MAY REQUIRE REASONABLE SECURITY FOR THE PAYMENT OF ITS BILLS.
SECTION 4. UPON THE TERMINATION OF THIS GRANT, THE GRANT AS WELL
AS THE PROPERTY, IF ANY, OF THE GRANTEE IN THE STREETS, AVENUES AND OTHER
PUBLIC PLACES, IN THE THEN CITY LIMITS OF THE CITY OF CORPUS CHRISTI, SHALL,
THEREUPON UPON A FAIR VALUATION THEREOF BEING PAID TO THE GRANTEE, BE AND
BECOME THE PROPERTY OF THE CITY OF EORPUS CHRISTI, AND THE GRANTEE SHALL NEVER
BE ENTITLED TO ANY PAYMENT OR VALUATION BECAUSE OF ANY VALUE DERIVED FROM THE
FRANCHISE OR THE FACT THAT IT I5 OR MAY BE A GOING CONCERN DULY INSTALLED AND
OPERATED. PROVIDED, HOWEVER, IT SHALL BE OPTIONAL WITH THE CITY OF CORPUS
CHRISTI WHETHER OR NOT IT ACQUIRED TITLE TO SAID PROPERTIES IN SAID MANNER.
THE MODE OF ASCERTAINING THE FAIR VALUE OF THE GRANT AND THE PROPERTY OF
GRANTEE IN THE STREETS, AVENUES AND OTHER PUBLIC PLACES OF THE CITY OF CORPUS
CHRISTI AND SHALL BE AS FOLLOWS;
CITY OF CORPUS CHRISTI SHALL APPOINT ONE COMPETENT ELECTRICAL
ENGINEER WHO HAS HAD NOT LESS THAN FIVE (5) YEARS ACTUAL
EXPERIENCE IN APPRAISING ELECTRIC PUBLIC UTILITY PROPERTIES,
AND THE GRANTEE SHALL APPOINT AN ENGINEER OF LIKE QUALIFICA-
TIONS, OR MAY, AT ITS OPTION, APPOINT ITS CHIEF ENGINEER, WHICH
TWO SAID ENGINEERS SHALL MAKE AN ACTUAL EXAMINATION OF THE
PROPERTIES AND REPORT THEIR AGREEMENT OF THE FAIR VALUE TO
THE CITY AND THE GRANTEE, AND IN CASE THE SAID ENGINEERS ARE
UNABLE TO AGREE AS TO A FAIR VALUE, THEY SHALL JOINTLY SELECT

A THIRD ELECTRICAL ENGINEER OF LIKE QUALIFICATIONS, AND A
MAJORITY OF THE THREE SO APPOINTED MAY REPORT A VALUE
WHICH SHALL BE BINDING UPON BOTH THE CITY OF CORPUS
CHRISTI AND THE GRANTEE. IF THE TWO ENGINEERS SELECTED
AS ABOVE OUTLINED BY THE CITY OF CORPUS CHRISTI AND THE
GRANTEE ARE UNABLE TO AGREE UPON THE FAIR VALUATION AND
ARE UNABLE TO AGREE UPON A THIRD ENGINEER TO ACT WITH
THEM, THEN AND IN THAT EVENT THE JUDGE OF THE UNITED
STATES DISTRICT COURT OF THE SOUTHERN DISTRICT OF TEXAS
SHALL APPOINT A THIRD ENGINEER. IT IS EXPRESSLY AGREED,
HOWEVER, THAT THE ACQUISITION OF SUCH PROPERTY SHALL BE
SUBJECT TO THE APPROVAL OF THE MORTGAGEE OF NUECES ELECTRIC
COOPERATIVE, INC. THE UNITED STATES OF AMERICA, ACTING BY AND
THROUGH THE ADMINISTRATOR OF THE RURAL ELECTRIFICATION ADMINI-
STRATION.
SECTION 5. THE GRANTEE SHALL HOLD THE CITY HARMLESS FROM ALL EX-
PENSE OR LIABILITY FOR ANY ACT OR NEGLECT OF THE GRANTEE HEREUNDER.
SECTION 6. THIS FRANCHISE IS NOT EXCLUSIVE, AND NOTHING HEREIN
CONTAINED SHALL BE CONSTRUED SO AS TO PREVENT THE CITY FROM GRANTING OTHER
LIKE OR SIMILAR RIGHTS AND PRIVILEGES TO ANY OTHER PERSON, FIRM OR CORPORATION.
SECTION 7. THE AREA OF THE CITY TO WHICH THIS FRANCHISE SHALL APPLY
IS THAT AREA IN THE WESTERN PART OF THE CITY, MORE PARTICULARLY DESCRIBED
AS FOLLOWS:
AREA ONE
ALL THAT AREA BOUNDED AS FOLLOWS:
BEGINNING AT THE INTERSECTION OF AIRLINE ROAD AND SARATOGA
ROAD; THENCE IN A NORTHERLY DIRECTION ALONG THE CENTER LINE
OF AIRLINE ROAD TO THE RAILROAD TRACK; THENCE IN A NORTH-
WESTERLY DIRECTION ALONG THE CENTER LINE OF SAID RAILROAD
TRACK TO THE INTERSECTION OF EVERHART ROAD; THENCE IN A
NORTHERLY OR NORTHEASTERLY DIRECTION ALONG THE CENTER LINE
OF EVERHART ROAD TO A POINT 2600 FEET PAST THE INTERSECTION OF

Dear Mr. Kring:
Mr. W. A. Ahlrich gave me your letter of May 22, 1963, yesterday
June 18, 1963, with the request to send the applicable rate schedules.
We are happy to furnish the rate schedules, however, Schedule A applies
to a very few consumers in the newly annexed areas of Corpus Christi which
this Cooperative serves.
The "Zero Method" of billing is being instituted with the July 1st billing
on a trial basis with the intention of continuing this method of billing. We
know that it may be difficult for some people to understand the "Zero
Method ", but it is fair and reduces billing time and expense and of course
does not change the rate schedules.

FARM AND HOME SERVICE
AVAILABILITY

Available to Farm and Horne Consumers for all Farm and home uses subject
to the established rules and regulations of the Seller. The capacity of individual
motors served under this schedule shall not exceed 10 h. p.
TYPE OF SERVICE
RATE
Single -phase 60 cycles, at available secondary voltages.
First 20 kwh per month @ 10.0 per kwh
Next 20 kwh per month @ 8.0 tr per kwh
Next 60 kwh per month @ 5. 0 C per kwh
Next 100 kwh per month @ 2.7 4 per kwh
Over 200 kwh per month @ 1.8C per kwh
MINIMUM CHARGES
The minimum monthly charge under the above rate shall be $1.50 where
3 kva or less of transformer capacity is required. For members requiring more
than 3 kva of transformer capacity the minimum monthly charge shall be increased
at the rate of 75c for each additional kva or fraction thereof required. Payment of
the minimum charge shall entitle the member in all cases to the use of the number of
kilowatt -hours corresponding to the minimum charge in accordance with the foregoing
rate.
TERMS OF PAYMENT
The above rates are net, the gross rates being five per -cent higher. In the
event the current monthly bill is not paid within fifteen days from the date of the
bill, the gross rates shall apply.

DETERMINATION OF BILLING DEMAND
The billing demand shall be the maximum kilowatt demand established by the consumer
for any period of fifteen minutes during the month for which the bill is rendered, as
indicated or recorded by a demand meter and adjusted for power factor as provided
hereafter; provided, however, that the consumer's Toad consists principally of a single
piece of electrical equipment, such as oil well pump motor, seller may, at his option,
estimate demand for billing purposes on the basis of the manufacturer's name plate
rating of equipment.
POWER FACTOR ADJUSTMENT
The consumer shall maintain unity power factor as nearly as practicable. Demand charges
will be adjusted for consumers with 50 kw or more of measured demand to correct for average
power factors lower than 90 %, and may be so adjusted for other consumers if and when the
Seller deems necessary. Such adjustments will be made by increasing the measured demand
1% for each 1% by which the average power factor is less than 90% lagging.

AVAILABILITY
Available to Farm and Home consumers who have in regular use a water heater
conforming to the specifications set forth hereunder subject to the established
rules and regulations of the seller. The rated capacity of any motor served under
this schedule shall not exceed ten horsepower.
TYPE OF SERVICE
Singel- phase, 60 cycles, at available secondary voltage.
RATE
First 20 kwh per month @ 10.0 G per kwh
Next 20 kwh per month @ 8.0 C per kwh
Next 60 kwh per month @ 5.0 c per kwh
Next 50 kwh per month @ 2.7 4 per kwh
Next 300 kwh per month @ 1.3 G per kwh
Over 450 kwh per month @ 1.8 c per kwh
MINIMUM CHARGES
The minimum monthly charge under the above rate shall be $1.50 where 3 kva or
less of transformer capacity is required. For members requiring more than 3 kva
of transformer capacity the minimum monthly charge shall be increased at the rate
of 75C for each additional kva or fraction thereof required. Payment of the
minimum charge shall entitle the member in all cases to the use of the number of
kilowatt -hours corresponding to the minimum charge in accordance with the
foregoing rate.
TERMS OF PAYMENT
The above rates are net, the gross rates being five percent higher. In the event
the current monthly bill is not paid within fifteen days from the date of the bill,
the gross rates shall apply.
CONDITIONS OF SERVICE
1. The consumer shall install and operate in regular use a standard approved storage
type of electric water heater and shall have no non - electric household water heating
device in use during any part of the year (such as heating coils in a fuel burning range
or furnace).

MINIMUM CHARGES
The minimum monthly charge under the above rate shall be $1.50 where 3 kva or
Tess of transformer capacity is required. For members requiring more than 3 kva
of transformer capacity the minimum monthly charge shall be increased at the rate
of 75c for each additional kva or fraction thereof required. Payment of the
minimum charge shall entitle the member in all cases to the use of the number of
kilowatt -hours corresponding to the minimum charge in accordance with the
foregoing rate.
TERMS OF PAYMENT
The above rates are net, the gross rates being five percent higher. In the event
the current monthly bill is not paid within fifteen days from the date of the bill,
the gross rates shall apply.
CONDITIONS OF SERVICE
1. The consumer shall install and operate in regular use a standard approved storage
type of electric water heater and shall have no non - electric household water heating
device in use during any part of the year (such as heating coils in a fuel burning range
or furnace).

RESIDENTIAL HEATING SERVICE
AVAILABILITY
Available to residential consumers who are receiving service at the same location
for other purposes and who install built -in electric space heating equipment which
is not used as a supplement to any other method of space heating and which meets
the specification of the Seller.
TYPE OF SERVICE
Single- phase, 60 cycles, at available secondary voltage.
RATE
The rate and terms under which consumer is receivingservice for other purposes shall
apply, except that during the months of October 15 through April 15 inclusive all
kwh used in excess of 1000 kwh per month shall be billed at 1.6 per kwh.
MINIMUM MONTHLY CHARGE
The total bill for space heating and for other purposes shall be not less than the minimum
monthly charge determined on the basis of transformer capacity required to serve consumer's
entire requirements in accordance with the terms of the rate schedule under which consumer
is receiving service for other purposes. The same minimum charge shall apply each month
of the year.
CONDITIONS OF SERVICE
1. Prior approval by the cooperative is required in each instance as to consumer's
location with respect to distribution facilities and resulting voltage regulation.
2. The entire installation including insulation of the house must meet the requirements
and specifications of the cooperative.

A copy of an ordinance passed and approved by the
City Council of the City of Corpus Christi, Texas, January 30,
1963, granting to the Cooperative a franchise to furnish elec-
tricity to patrons within certain areas of the City of Corpus
Christi was then presented to the Directors. After a consi-
deration of the matter upon motion made by Charlie Rosse, second-
ed by R. H. Roewe and duly carried the franchise was accepted
by the Cooperative.
