AN ORDINANCE
CLOSING A PORTION OF HILLCREST STREET, BEING
THE SOUTHERLY ONE -HALF OF HILLCREST STREET, A
DISTANCE OF 73.51 FEET ON THE EASTERLY SIDE
AND 160.03 FEET ON THE WESTERLY SIDE WHICH ABUTS
A 10 -FOOT ALLEY ON THE WESTERLY SIDE OF HILLCREST
STREET, TO THE INTERSECTION OF LEOPARD AND
PEABODY STREETS; AUTHORIZING THE CITY MANAGER TO
EXECUTE AND DELIVER A QUITCLAIM DEED ON THAT
PORTION OF THE STREET CLOSED UPON THE PAYMENT
OF THE CONSIDERATION OF $1,000.00 BY THE ABUTTING
PROPERTY OWNER, JOHN THOMASON,• AND DECLARING AN
EMERGENCY.
WHEREAS, NOTICE OF THE INTENTION OF CLOSING A PORTION OF
HILLCREST STREET, BEING THE SOUTHERLY ONE -HALF OF HILLCREST STREET,
A DISTANCE OF 73.51 FEET ON THE EASTERLY SIDE AND 160.03 FEET ON THE
WESTERLY SIDE WHICH ABUTS A 10 -FOOT ALLEY ON THE WESTERLY SIDE OF
HILLCREST STREET, TO THE INTERSECTION OF LEOPARD AND PEABODY STREETS,
HAS BEEN GIVEN BY PUBLICATION AND REGISTERED MAIL TO THE LAST KNOWN
ADDRESS OF ALL OWNERS ABUTTING SAID STREET AND WITHIN 450 FEET THEREOF,
AND THEREAFTER, PURSUANT TO SAID NOTICE, A PUBLIC HEARING WAS HELD ON
MAY 24, 1961, BY THE CITY COUNCIL IN ACCORDANCE WITH THE PROVISIONS OF
THE CITY CHARTER; AND
WHEREAS, IT HAS BEEN DETERMINED BY THE CITY COUNCIL, AFTER
SUCH PUBLIC HEARING, THAT THE SAID AREA IS NOT NEEDED AS A PUBLIC STREET,
AND THAT THE SAME WILL NOT BE NEEDED AS A PUBLIC STREET WITHIN THE FORE-
SEEABLE FUTURE; AND
WHEREAS, IT HAS BEEN DETERMINED THAT IT WILL BE TO THE AD-
VANTAGE OF THE CITY TO ABANDON SAID AREA AS A PUBLIC STREET SO THAT THE
SAME MAY BE USED BY THE ABUTTING PROPERTY OWNER FOR OTHER PURPOSES:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THERE IS HEREBY CLOSED FOR PUBLIC USE THAT
PORTION OF HILLCREST STREET MORE PARTICULARLY DESCRIBED AS FOLLOWS:
BEING THE SOUTHERLY ONE -HALF OF HILLCREST STREET,
A DISTANCE OF 73.51 FEET ON THE EASTERLY SIDE OF
HILLCREST STREET, AND 160.0 FEET ON THE WESTERLY
SIDE WHICH ABUTS A 10 -FOOT ALLEY ON THE WESTERLY
SIDE OF HILLCREST STREET, TO THE INTERSECTION OF
LEOPARD AND PEABODY STREETS, MORE PARTICULARLY
DESCRIBED BY METES AND BOUNDS AS FOLLOWS:

1 OF THE NELSON ADDITION NO. 2, AS SHOWN BY MAP OR PLAT
OF RECORD IN VOL. 1, PAGE 18, MAP RECORDS OF NUECES
COUNTY, TEXAS;
THENCE IN A NORTHWESTERLY AND NORTHERLY DIRECTION WITH
THE ARC OF A CIRCULAR CURVE TO THE RIGHT HAVING A
RADIUS OF 9.97 FEET AND A CENTRAL ANGLE OF 90° A
DISTANCE OF 15.66 FEET TO A POINT;
THENCE N. 00 181 E. A DISTANCE OF 94.79 FEET TO A

THENCE N. 29° 131 E. WITH THE NORTHWEST RIGHT OF WAY
LINE OF HILLCREST STREET A DISTANCE OF 43.40 FEET TO A
POINT FOR A CORNER OF THIS TRACT;
THENCE S. 89' 421 E. A DISTANCE OF 57.12 FEET TO A
POINT FOR A CORNER OF THIS TRACT. SAID .POINT BEING
THE NORTHWEST CORNER OF SAID LOT 11 BLOCK 11 NELSON
ADDITION N0. 2;
THENCE S. 290 131 W. WITH THE NORTHWEST BOUNDARY LINE
OF SAID LOT 1, A DISTANCE OF 16o.3 FEET TO THE PLACE OF
BEGINNING,
AND ABANDONING THE SAME TO THE ABUTTING PROPERTY OWNER, JOHN THOMASON,
UPON THE PAYMENT OF THE CONSIDERATION OF $1,000.00.
SECTION 2. THE CITY MANAGER OF THE CITY OF CORPUS CHRISTI
IS HEREBY AUTHORIZED AND DIRECTED TO EXECUTE AND DELIVER, FOR AND ON
BEHALF OF THE CITY OF CORPUS CHRISTI, A QUITCLAIM DEED TO THE AREA
DESCRIBED IN SECTION 1 HEREOF, UNTO THE ABUTTING PROPERTY OWNER UPON
THE PAYMENT OF THE CONSIDERATION OF $1,000.00.
SECTION 3. THE FACT THAT THE PUBLIC CONVENIENCE AND NECESSITY
WOULD BE BETTER SERVED BY THE CLOSING OF THE AREA HEREINABOVE DESCRIBED
AND THE ABANDONING OF THE PROPERTY TO THE ABUTTING PROPERTY OWNER CREATES
A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUS-
PENSION OF THE CHARTER RULE THAT NIL ORDINANCE OR RESOLUTION SHALL BE
PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL,
AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST,
HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS

ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT
THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND
AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE
DAY OF MARCH, 1963.

For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and that
such ordinance or resolution shall be read at three meetings of the City
Council; i, therefore, hereby request that you suspend said Charter rule
or requirement and pass this ordinance finally on the date it is introduced,
or at the present meeting of the City Council.
