HomeMy WebLinkAbout06848 ORD - 03/20/1963JKH:3 -19 -63 AN ORDINANCE CLOSING THAT ALLEY DESCRIBED AS BEING 20 FEET IN WIDTH EXTENDING FROM LESTER STREET TO LEARY STREET, THROUGH BLOCK 3 OF DOSS O'NEAL ADDITION AND BLOCK 1 OF PALM PARK ADDITION, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; AND DECLARING AN EMERGENCY. WHEREAS, NOTICE OF THE CLOSING OF A 20 FOOT WIDE ALLEY, EXTENDING FROM LESTER STREET TO LEARY STREET THROUGH BLOCK 3 OF DOSS OINEAL ADDITION AND BLOCK 1 OF PALM PARK ADDITION, HAS BEEN GIVEN BY PUBLICATION AND REGISTERED MAIL TO THE LAST KNOWN ADDRESSES OF ALL OWNERS ABUTTING SAID ALLEY AND WITHIN 450 FEET THEREOF, AND THEREAFTER, PURSUANT TO SAID NOTICE, WHICH PUBLIC HEARING WAS HELD BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, ON MARCH 13, 1963, IN ACCORDANCE WITH THE PROVISIONS OF THE CITY CHARTER; AND WHEREAS, IT HAS BEEN DULY DETERMINED BY THE CITY OF CORPUS CHRISTI, AFTER SAID PUBLIC HEARING THAT THE SAID ALLEY IS NOT SUITABLE AS LAID OUT FOR SAID PURPOSES AND THAT IT WILL BE TO THE ADVANTAGE OF THE CITY OF CORPUS CHRISTI, TEXAS, TO HAVE SAID ALLEY CLOSED: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THERE IS HEREBY CLOSED FOR PUBLIC USE AS AN ALLEY THE 20 FOOT WIDE ALLEY EASEMENT FROM LESTER STREET TO LEARY STREET, THROUGH BLOCK 3 OF DOSS OINEAL ADDITION AND BLOCK 1 OF PALM PARK ADDITION, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS. SECTION 2. THE FACT THAT THE PUBLIC CONVENIENCE AND NECESSITY WOULD BE BETTER SERVED BY THE CLOSING OF THE SAID ALLEY CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS 0* 0 ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY 50 ORDAINED THIS THEO AY OF MARCH, 1963- ATTEST: AYOR THE CITY OF CORPUS CHRISTI, XAS CI '(Y SECRETAX APPROVED AS TO LEGAL FORM IS DAY OF MARCH, 1963: CITY `OR Q Corpus Chris i, Texas / a� day of�4 L d. TO THE MEMBERS OF THE CITY COUNCIL Corpus Christ *, Texas For the reasons set forth in the emergency clause of the fore- going ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
