AN ORDINANCE
4
AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR
AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO
EXECUTE AN ENCROACHMENT AGREEMENT WITH HARVIE
BRANSCOMB, JR. WHEREBY THE CITY AGREES TO PERMIT
THE OVERHANGING EAVES OF THE DWELLING LOCATED ON
LOT D -1, TANGLEWOOD ADDITION, TO REMAIN AT THEIR
PRESENT LOCATION AS AN ENCROACHMENT ON THE UTILITY
EASEMENT IN SAID LOT D -1, TANGLEWOOD ADDITION,
Ov /NED BY THE CITY, SUBJECT TO THE TERMS AND CONDI-
TIONS SET OUT IN SAID AGREEMENT, A COPY OF WHICH
IS ATTACHED HERETO AND MADE A PART HEREOF; AND
DECLARING AN EMERGENCY.
WHEREAS, HARVIE BRANSCOMB, JR. IS THE OWNER IN FEE SIMPLE OF LOT
D -1, TANGLEWOOD ADDITION, AN ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES
COUNTY, TEXAS; AND
WHEREAS, THERE EXISTS AT THE REAR OF THE ABOVE DESCRIBED LOT
A UTILITY EASEMENT PRESENTLY OCCUPIED BY THE CITY OF CORPUS CHRISTI, AND
INTO WHICH SAID UTILITY EASEMENT THE DWELLING ON SAID LOT ENCROACHES TO
THE EXTENT OF APPROXIMATELY FOUR FEET; AND
WHEREAS, THE SAID HARVIE BRANSCOMB, JR. HAS REQUESTED THE CITY
OF CORPUS CHRISTI FOR PERMISSION TO LEAVE THE SAID IMPROVEMENTS AS THE
SAME EXTEND INTO THE EASEMENT IN THEIR PRESENT LOCATION AS AN ENCROACHMENT
ON SAID UTILITY EASEMENT; AND
WHEREAS, THE EASEMENT WILL NOT AFFECT CITY UTILITIES:
NO; /, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY
OF CORPUS CHRISTI, BE AND HE 15 HEREBY, AUTHORIZED AND DIRECTED TO EXECUTE
AN ENCROACHMENT AGREEMENT WITH HARVIE BRANSCOMB, JR., SAID CITY PRESENTLY
OCCUPYING A UTILITY EASEMENT ON LOT D -1, TANGLEWOOD ADDITION, WHEREBY
SAID HARVIE BRANSCOMB, JR. IS PERMITTED TO LEAVE THE AFOREMENTIONED
ENCROACHMENTS TO REMAIN AT THEIR PRESENT LOCATION ON SAID UTILITY EASE-
MENT, SUBJECT TO THE TERMS AND CONDITIONS SET OUT IN SAID AGREEMENT, A COPY
OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF.

SECTION 2. THE NECESSITY FOR EXECUTING THE AGREEMENT DESCRIBED
IN SECTION 1 HEREOF CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC
NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND
THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS
OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND
NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE
AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION
AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM
AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED THIS THE
DAY OF APRIL, 1963.

WHEREAS, the City of Corpus Christi is the owner of
a utility easement situated on the Following described pr'operay.

of Corpus Christi, Texas, as further shown
on plat entitled "Resubdivis on of Lots C,
D, E, and F, Tang1ewood, a Subdivision of
the City of Corpus Christi, Nueees_County,
Texas" which is filed in Volume 20 at
page 26 of the Map Records of Nuecea County,

WHEREAS, said utility easement is ten (10) 2eet in
width, is parallel with the northwestern boundary line of said .
lot, and is so situated so that there is a strip of land ten
(10) feet in width between the northwest boundary line of said
utility easement and the northwest boundary line of said Lot
0 -1, as is £urther_shown on map or plat attached hereto and
hereby made a part hereof, such strip beings referred to herein
and on said plat as the -" l.G'_ Deserve Strip"; and

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE-
GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR
THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCIL; 1, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO-
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
