AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER,
FOR AND ON BEHALF OF THE CITY OF CORPUS
CHRISTI, TO EXECUTE A CONTRACT WITH MICO
CONSTRUCTION COMPANY, CONTRACTORS, FOR THE
PLACING OF APPROXIMATELY 4,657 1/2 CUBIC YARDS
OF SAND ON SOUTH BEACH AT A UNIT PRICE OF $2.56
PER CUBIC YARD, AND NOT TO EXCEED A TOTAL COST
OF $12,000.00; APPROPRIATING AND REAPPROPRIATING
OUT OF NO. 111 TRUST FUND, ACCOUNT NO. 1772,
THE SUM OF X12,000.00; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS;
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY,
AUTHORIZED AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF
CORPUS CHRISTI, A CONTRACT WITH FOWcO CONSTRUCTION COMPANY, CONTRACTORS,
FOR PLACING OF APPROXIMATELY 4,657 1/2 CUBIC YARDS OF SAND ON SOUTH
BEACH AT A UNIT PRICE OF 52.56 PER CUBIC YARD, NOT TO EXCEED A TOTAL
COST OF $12,000.00, ALL AS MORE FULLY SET OUT IN THE PLANS AND
SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE IN THE OFFICE OF THE
CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF BY REFERENCE, AND
ACCORDING TO THE BID OF FOWCO CONSTRUCTION COMPANY, OPENED ON THE 3RD
DAY OF APRIL, 1963, THE SAID BID OF FOWCO CONSTRUCTION COMPANY BEING
THE LOWEST AND MOST ADVANTAGEOUS TO THE CITY OF CORPUS CHRISTI, TEXAS.
SECTION 2. THERE IS HEREBY APPROPRIATED AND REAPPROPRIATED
OUT OF N0. 111 TRUST FUND, ACCOUNT NO. 1772, THE SUM OF $12,000.00 FOR
THE AFORESAID SAND TO BE PLACED ON SOUTH BEACH IN THE CITY OF CORPUS
CHRISTI.
SECTION 3. THE NECESSITY TO MAKE THE AFORESAID APPROPRIATION
AND TO AUTHORIZE THE EXECUTION OF THE AFORESAID CONTRACT SO THAT THE
NECESSARY WORK MAY BE BEGUN AS PROMPTLY AS POSSIBLE ON THE SOUTH BEACH
PROJECT CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY
REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION
AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL
MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH
EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF
THE SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON
THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE TAKE EFFECT AND
BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY
SO ORDAINED THIS THE v DAY OF APRIL, 1963.

THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCILS I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO-
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
