HomeMy WebLinkAbout06912 ORD - 05/15/1963'i IMS:JKH:5 -6 -63 AN ORDINANCE w AMENDING ORDINANCE NO. 6839, BY AMENDING THE LAST CLAUSE OF SECTION 1 OF SAID ORDINANCE SO AS TO BE IN STRICT ACCORDANCE WITH THE AGREEMENT FOR ANNEXATION EXISTING BETWEEN THE UNITED STATES OF AMERICA AND THE CITY OF CORPUS CHRISTI REGARD- ING THE TAXATION OF PROPERTY WITHIN THE TERRITORY ANNEXED; AND DECLARING AN EMERGENCY. '•IHEREAS, THE LAST CLAUSE OF SECTION 1 OF ORDINANCE No. 6839, PASSED AND APPROVED BY THE CITY COUNCIL ON THE 6TH DAY OF MARCH, 1963, PROVIDES THAT THE UNITED STATES NAVAL AIR STATION, CORPUS CHRISTI, TEXAS, BE ANNEXED TO THE CITY OF CORPUS CHRISTI BY SAID ORDINANCE AND "SHALL HEREAFTER BEAR ITS PROPORTIONATE SHARE OF THE TAXES LEVIED BY THE CITY"; AND "'HEREAS, THE AGREEMENT BETWEEN THE UNITED STATES OF AMERICA AND THE CITY OF CORPUS CHRISTI PROVIDED "THAT THE EFFECT OF ANNEXATION OF THE AFORESAID TERRITORY WILL HAVE NO EFFECT AS FAR AS TAXATION OF GOVERNMENT PROPERTY IS CONCERNED, INCLUDING REAL, PERSONAL OR MIXED, OR GOVERNMENT FURNISHED PROPERTY, AND THE WHERRY HOUSING PROJECT AT SAID STATION, KNOWN AS tLAGUNA SHORES, SO LONG AS SUCH PROPERTY SHALL REMAIN GOVERNMENT PROPERT'J'Y- AND HEREAS, IT IS DESIRED BY THE PARTIES TO SAID ANNEXATION AGREEMENT THAT THE ANNEXATION ORDINANCE CONTAIN THE SAME TERMSAS THE ANNEXATION AGREEMENT: NOd, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT ORDINANCE No. 6839, PASSED AND APPROVED BY THE CITY COUNCIL ON THE 6TH DAY OF MARCH, 1963, BE AND THE SAME IS HEREBY AMENDED BY AMENDING THE LAST CLAUSE OF SECTION 9 OF SAID ORDINANCE NO. 6839 SO THAT SAID FINAL CLAUSE OF SECTION 1 SHALL HEREAFTER READ AS FOLLOWS: "SAID DESCRIBED TERRITORY SHALL HEREAFTER BEAR ITS PROPOR- TIONATE SHARE OF THE TAXES LEVIED BY THE CITY EXCEPT THAT ANNEXATION OF THE AFORESAID TERRITORY WILL HAVE NO EFFECT AS FAR AS TAXATION OF 0 GOVERNMENT PROPERTY IS CONCERNED, INCLUDING REAL, PERSONAL AND MIXED, OR GOVERNMENT FURNISHED PROPERTY, AND THE 'dHERRY HOUSING PROJECT AT SAID STATION, KNOWN AS 'LAGUNA SHORES', 50 LONG AS SUCH PROPERTY SHALL REMAIN GOVERNMENT PROPERTY, AND THE INHABITANTS OF SUCH TERRITORY SHALL HAVE THE PRIVILEGES AND BE SUBJECT TO ALL OF THE DUTIES OF OTHER INHABI- TANTS OF THE CITY OF CORPUS CHRISTI, TEXAS." SECTION 2. EXCEPT AS HEREIN AND HEREBY AMENDED, ORDINANCE N0. 6839 SHALL CONTINUE IN FULL FORCE AND EFFECT. SECTION 3. THE NECESSITY FOR IMMEDIATELY AMENDING ORDINANCE No. 6839 TO CONFORM WITH THE AGREEMENT OF ANNEXATION HERETOFORE ENTERED INTO BETWEEN THE CITY OF CORPUS CHRISTI AND THE UNITED STATES GOVERNMENT CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDI- NANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED THIS THE / "� DAY OF MAY, 1963- —t= 11 YOR ATTEST: THE CITY OF CORPUS CHRISTI, TEXAS r/ V2? / CITY SECRETARY. 1 -427 APPROVED AS TO LEGAL FORM THIS DAY OF MAY, 1963: CITY NTTORNEY 'f CORPUS CHRISTI, TEXAS ZDAY OF , 19_�-/j TO THE MEMBERS OF THE CITY COUNCIL CORPUS CHRISTI, TEXAS FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE- GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO- DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
