HomeMy WebLinkAbout06941 ORD - 06/26/1963AJKH:6 -21 -63 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A CONTRACT WITH FOWCO CONSTRUCTION COMPANY FOR CON- STRUCTION OF THE UPPER McARDLE STORM SEWER, DESIGNATED AS PROJECT NO. 295- 61 -22; APPROPRIATING OUT OF NO. 295 STORM SEWER BOND FUND THE SUM OF $98,750.00, OF WHICH AMOUNT $291,007.45 IS FOR THE CONSTRUCTION CON- TRACT AND $7,742.55 IS FOR CONTINGENCIES,INCLUDING ENGINEERING, LABORATORY AND LEGAL ADVERTISING COSTS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, A CONTRACT WITH FOWCO CONSTRUCTION COMPANY FOR CONSTRUCTION OF APPROXIMATELY 9577 FEET OF R.C. PIPE LINE, 1511 TO 48.11 IN SIZE, AND APPURTENANCES ALONG MCARDLE ROAD BETWEEN EVERHART ROAD AND NESBITT DRIVE, DESIGNATED AS PROJECT No. 295- 61 -22, ALL AS MORE FULLY SET OUT IN THE PLANS AND SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE IN THE OFFICE OF THE CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF BY REFERENCE, AND ACCORDING TO THE BID OF FOWCO CON- STRUCTION COMPANY OPENED ON THE 19TH DAY OF JUNE, 1963, THE SAID BID OF FOWCO CONSTRUCTION COMPANY BEING THE LOWEST AND MOST ADVANTAGEOUS TO THE CITY OF CORPUS CHRISTI, TEXAS. p SECTION 2. THERE IS HEREBY APPROPRIATED THE SUM OF $98,750.00 OUT OF NO. 295 STORM SEWER BOND FUND, OF WHICH AMOUNT $91,007.145 IS FOR THE CONSTRUCTION CONTRACT AND $7,742.55 IS FOR CONTINGENCIES, INCLUDING ENGINEER- ING, LABORATORY AND LEGAL ADVERTISING COSTS. SECTION 3. THE NECESSITY TO EXECUTE THEPFORESAID CONTRACT AS PROMPTLY AS POSSIBLE SO THAT AN ADEQUATE DRAINAGE SYSTEM MAY BE INSTALLED IN THE ABOVE DESCRIBED AREA CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH PUBLIC EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED, AND THAT THIS ORDINANCE 6941 BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED THIS THE 26TH DAY OF JUNE, 1963.
