HomeMy WebLinkAbout06946 ORD - 06/26/1963IMS:JKH:6 -25 -63 AN ORDINANCE ABANDONING, WITH EXCEPTIONS, THE UTILITY EASEMENT EXTENDING THROUGH BLOCK 10, SOUTHMORELAND ADDITION, FROM AYERS STREET TO LEWIS STREET; AND DECLARING AN EMERGENCY. WHEREAS, THE OWNER OF BLOCK 10, SOUTHMORELAND ADDITION, AN ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, DESIRES TO HAVE THE UTILITY EASEMENT FIVE FEET IN WIDTH EXTENDING THROUGH SAID BLOCK 10, FROM AYERS STREET TO LEWIS STREET; AND WHEREAS, NO UTILITIES OF THE CITY, AND NONE OTHER THAN THOSE OF CENTRAL POWER AND LIGHT COMPANY, ARE AFFECTED THEREBY AND THE INTEREST OF THE PUBLIC WILL NOT BE AFFECTED BY THE ABANDONMENT THEREOF: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT ALL'OF THAT CERTAIN UTILITY EASEMENT LOCATED IN BLOCK 10, SOUTHMORELAND ADDITION, AN ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, BE AND THE SAME IS HEREBY DECLARED ABANDONED AND RELEASED AND RELINQUISHED BY THE CITY OF CORPUS CHRISTI UNTO THE RESPECTIVE PRESENT OWNERS OF THE RESPECTIVE LOTS IN SAID BLOCK; SAVE AND EXCEPT THAT THERE IS RETAINED AN EASEMENT FOR THE USE OF POLES AND OVERHEAD POWER LINES SUPPLYING ELECTRIC LIGHT AND POWER TO LOTS 9, 102 11, 12, 13, 14, 15 AND 16 OF SAID BLOCK 10, SOUTHMORELAND ADDITION, ON AND ALONG THE EASEMENT ABUTTING SAID LOTS. SECTION 2. THE NECESSITY FOR RECOGNIZING THE ABANDONMENT OF THE EASEMENT HEREINABOVE DESCRIBED CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDI- NANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED'SUCH EMERGENCY AND NECES- SITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH 0 6946 ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AF E ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED THIS THE DAY OF , 1963, ATTESTS OR THE CITY OF CORPUS CHRISTI, TEXAS -/ k ITY SECRE APPROVED AS TO LEGA L IT FORM THISHE DAY CF , 1963: TY CORPUS CHRISTI, TEXAS �D Al OF �9 TO THE MEMBERS OF THE CITY COUNCIL CORPUS CHRISTI, TEXAS * FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE- GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO- DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
