PRESCRIBING THE TAXES TO BE LEVIED, ASSESSED AND COLLECTED
BY THE CITY OF CORPUS CHRISTI, TEXAS, FOR THE YEAR 1963
AND FOR EACH SUCCEEDING YEAR THEREAFTER UNTIL OTHERWISE
PROVIDED AND ORDAINED, AND SUCH OTHER YEARS AS THE SAME
MAY BE APPLICABLE; PROVIDING A SAVINGS CLAUSE; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That there is hereby levied, to be assessed and collected
in current money of the United States of America, for the use of the City of
Corpus Christi, Texas, for the Year 1963, and for each succeeding year thereafter,
until otherwise provided and ordained, an annual direct ad valorem tax of
$ .7960 on each One Hundred Dollars ($100) value thereof, on all property, real,
personal, and mixed, located within the said City of Corpus Christi, upon which
a tax is authorized to be levied by law, and upon all franchises of all
individuals, partners, and corporation holding franchises in the City from
said City of Corpus Christi, Texas, said tax to be appropriated to the
payment and defrayment of current expenses of the Government of said City.
SECTION 2. That there is hereby levied to be.assessed and collected
in current money of the United States of America, for the use of the City of
Corpus Christi, for the Year 1963, and for each succeeding year thereafter until
otherwise provided and ordained, an annual direct ad valorem tax of $ .2426 on
each One Hundred Dollars ($100) of value therelif, upon all property and franchises
described in Section 1 of this Ordinance, said Tax to be appropriated and used in
making payments for General Street Improvements and building bridges in the City
of Corpus Christi, Texas.
SECTION 3. That for the purpose of paying interest and providing the
necessary sinking funds for the payment of outstanding bonds and bonded indebted-
ness of the City of Corpus Christi, and for paying interest and making provisions
for the sinking fund of such future issues as may be authorized, there is hereby
levied for the Year 1963, and for each succeeding yearcthereafter, unless other-
wise provided and ordained, to be assemei and collected in current money of the
United States of America, upon all property and franchises described in Section 1
of this Ordinance, an annual direct ad valorem tax of $0.5614 on each One Hundred
Dollars ($100) of value thereof, which said taxes as and when the same shall be
collected, shall be appropriated and credited to the following bond interest and
sinking funds of the City of Corpus Christi, Texas:

(1) Out of said amount of $0.5614 there is hereby appropriated
$0.0376 for the purpose of paying interest and creating
the necessary sinking fund to pay Refunding Bonds, Series
1936, dated February 1, 1936;
(2) Out of the amount of $0.5614 there is hereby appropriated
$0.0096 for the purpose of paying interest and creating
the necessary sinking fund to pay Street Improvement Bonds,
Series 1940, dated June 1, 1940;
(3) Out of said amount of $0.5614 there is hereby appropriated
$0.0077 for the purpose of paying interest and creating the
necessary sinking fund to pay Sanitary Sewer Improvement
and Extension Bonds, Series 1940, dated June 1, 1940;
(4) Out of the amount of $0.5614 there is hereby appropriated
$0.0024 for the purpose of paying interest and creating
the necessary sinking fund to pay Fire Station Bonds,
Series 1941, dated December 1, 1941;
(5) Out of said amount of $0.5614 there is hereby appropriated
$0.0010 for the purpose of paying interest and creating
the necessary sinking Hind to pay Garbage Disposal Plant
Bonds, Series 1941, dated December 1, 1941;
(6) Out of said amount of $0.5614 there is hereby appropriated
$0.0072 for the purpose of paying interest and creating
the necessary sinking fund to pay Hospital Bonds, Series
1941, dated December 1, 1941;
(7) Out of said amount of $0.5614 there is hereby appropriated
$0.0010 for the purpose of paying interest and creating
the necessary sinking fund to pay Park System Improvement
Bonds, Series 1941, dated December 1, 1941;
(8) Out of said amount of $0.5614 there is hereby appropriated
$0.0079 for the purpose of paying interest and creating
the necessary sinking Hind to pay Sanitary and Storm Water
Sewer Improvement Bonds, Series 1941, dated December 1, 1941;
(9) Out of said amount of $0.5614 there is hereby appropriated
$0.0014 for the purpose of paying interest and creating
the necessary sinking fund to pay Fire Department Bonds,
Series 1944, dated June 1, 1944;
(10) Out of said amount of $0.5614 there is hereby appropriated
$0.0014 for the purpose of paying interest and creating
the necessary sinking fund to pay Airport Improvement Bonds,
Series 1948, dated June 1, 1948;
(11) Out of said amount of $0.5614 there is hereby appropriated
$0.0018 for the purpose of paying interest and creating
the necessary sinking fund to pay Park Bonds, Series 1948,
dated June 1, 1948;
(12) Out of said amount of $0.5614 there is hereby appropriated
$0.0074 for the purpose of paying interest and creating
the necessary sinking fund to pay Sanitary Sewer Improvement
Bonds, Series 1948, dated June 1, 1948;
(13) Out of said amount of $0.5614 there is hereby appropriated
$0.0202 for the purpose of paying interest and creating
the necessary sinking fund to pay Storm Sewer Bonds, Series

$0.0015 for the purpose of paying interest and creating the
necessary sinking Hind to pay Fire Station Bonds, Series

(17) Out of said amount of $0.5614 there is hereby appropriated
$0.0012 for the purpose of paying interest and creating
the necessary sinking fluid to pay Municipal Auditorium
Bonds, Series 1950, dated January 15, 1950;

$0.0100 for the purpose of paying interest and creating

$0.0049 for the purpose of paying interest and creating the
necessary sinking fluid to pay Airport Improvement Bonds,
Series 1951, dated September 1, 1951;
(29) Out of said amount of $0.5614 there is hereby appropriated
$0.0005 for the purpose of paying interest and creating
the necessary sinking fluid to pay Sanitary Sewer Improvement
Bonds, Series 1951, dated September 1, 1951;
(30) Out of said amount of $0.5614 there is hereby appropriated
$0.0030 for the purpose of paying interest and creating
the necessary sinking fund to pay Storm Sewer Improvement
Bonds, Series 1951, dated September 1, 1951;
(31) Out of said amount of $0.5614 there is hereby appropriated
$0.0051 for the purpose of paying interest and creating the
necessary sinking fund to pay Street Improvement Bonds,

the necessary sinking fund to pay any bond that may be issued
during the fiscal year 1963 -64.
SECTION 4. All taxes for the Year 1963 hereby levied shall become due
and payable at the Office of the Tax Assessor - Collector of the City of Corpus
Christi, Texas, on or after the first day of August, 1963, and if the taxes
levied for said year are not paid on or before January 31st next after
becoming due, interest shall be charged upon the gross amount of the taxes
due and penalty due until paid at the rate of one -half of one percent (1/2 of 1%)
for each month or fraction thereof thereafter. Said interest shall be in
addition to such penalties as may be hereafter provided for delinquent taxes.
No discount for payment of taxes prior to such taxes becoming delinquent shall
be allowed.
SECTION 5. In addition to all other taxes, there is hereby levied
a tax in the nature of a street rental fee, against all persons, firms or
corporations having any pipes, mains, conductors or other facilities in any
public ways, streets, alleys, utility easements, or waters within the City
limits of the City of Corpus Christi as part of a Public Utility System.
Said tax shall be based on the gross receipts of such public utility derived
from the sale of gas, electricity or water or other utility service within
the City limits. Said tax is payable for each and every calendar year,
and shall be paid on or before March 1 next following the end of such
calendar year. Such payments shall be made to the Assessor Collector of Taxes
of the City with a verified statement showing the amount of such gross sales
for the respective year. A reasonable tax or charge is hereby determined to
be two percent (2%) of the gross receipts of such utility derived from the
sale of gas, electric energy, or water and /or other utility service within
the City of Corpus Christi and is hereby levied in that amount. In the
event a street rental fee and /or occupation tax is by State law prohibited,
except as to a different rate than as is hereby levied, then the rate is
hereby fixed at the highest rate permitted by State law to be levied by the
City. Any public utility having a franchise from the City or for any reason
permitted to operate withing the City shall be liable for the payment of the
tax hereby levied unless a different rate or payment or other consideration
is provided by written agreement with the City.
SECTION 6. If for any reason any section, paragraph, subdivision,
clause, phrase, or provision of this ordinance shall be held invalid, it shall
not affect any valid provisions of this or any other ordinance of the City of
Corpus Christi to which these rules and regulations relate.
SECTION T. That the fact that the passage of an ordinanee:fa the
levying of taxes for the City of Corpus Christi for the Year 1963 is necessary
and important to the people of the City and the further fact that the prepara-
tion and completion of the tax rolls of the City for the Year 1963 is dependent
upon the passage of this ordinance , and in order that said tax roll may be
completed and ready for the collection of said taxes when the same becomes
due and payable as aforesaid, creates an emergency and an imperative public
necessity requiring the suspension of the Charter rule providing that no
ordinance or resolution shall be passed finally on the date of its introduction
and that such ordinance or resolution shall be read at three several meetings
of the City Council, and the Mayor having declared such emergency and necessity
to exist, having requested the suspension of said Charter rule and that this
ordinance be passed finally on the date of its introduction and take effect
and be in full force and effect from and after the passage of same, IT IS

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE-
GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR
THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCIL; I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO-
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
