AN ORDINANCE
APPROPRIATING OUT OF UNALLOCATED NO. 220 STREET
BOND IMPROVEMENT FUND THE SUM OF $1,575.00, OF
WHICH AMOUNT $1,500.00 IS FOR THE ACQUISITION OF
A TRACT OF LAND 55 FEET IN WIDTH AND 210 FEET IN
LENGTH, REQUIRED FOR THE EXTENSION OF KAY STREET,
AS MORE FULLY DESCRIBED HEREINAFTER, AND $75.00 IS
FOR TITLE EXPENSE AND OTHER COSTS RELATED THERETO;
AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE
REAL ESTATE CONTRACT FOR AND IN BEHALF OF THE CITY
OF CORPUS CHRISTI FOR ACQUISITION OF SAID TRACT;
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. THERE IS HEREBY APPROPRIATED OUT OF UNALLOCATED
NO. 220 STREET BOND IMPROVEMENT FUND THE SUM OF $1,575.00, OF WHICH
AMOUNT $1,500.00 IS FOR THE ACQUISITI6N OF A TRACT OF LAND 55 FEET
IN WIDTH AND 210 FEET IN LENGTH, REQUIRED FOR THE EXTENSION OF KAY
STREET, MORE FULLY DESCRIBED AS FOLLOWS:
A TRACT OF LAND 55 FEET IN WIDTH AND 210 FEET IN
LENGTH OUT OF THE NORTH ONE -HALF OF THE EAST
ONE- QUARTER OF LOT 6, SECTION B, PAISLEYS SUB-
DIVISION OF THE HOFFMAN TRACT AS SHOWN BY MAP OR
PLAT OF RECORD IN VOL. A, PAGE 28 OF THE MAP RECORDS
OF NUECES COUNTY, TEXAS, AND BEING THE SAME TRACT
OF LAND CONVEYED BY W. L. BATES TO WILBURN E.
MONTGOMERY BY DEED DATED MARCH 7, 1952, AND RECORDED
IN VOL. 571, PAGE 33,_DEED RECORDS OF NUECES COUNTY,
TEXAS,
AND $75.00 IS FOR TITLE EXPENSE AND OTHER COSTS RELATED THERETO.
SECTION 2. THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED
AND DIRECTED TO EXECUTE REAL ESTATE CONTRACT FOR AND ON BEHALF OF THE
CITY OF CORPUS CHRISTI FOR THE ACQUISITION OF THE ABOVE DESCRIBED TRACT.
SECTION 3. THE NECESSITY TO IMMEDIATELY MAKE AVAILABLE THE
FUNDS FOR THE ACQUISITION OF THE ABOVE DESCRIBED PARCEL, AND AUTHORIZING
THE CITY MANAGER TO EXECUTE THE NECESSARY REAL ESTATE SALES CONTRACT
FOR THE ACQUISITION OF SAID PROPERTY CREATES A PUBLIC EMERGENCY AND AN
IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER TULE
THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF
ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT
THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING REQUESTED

THE SUSPENSION OF THE SAID CHARTER RULE AND THAT THIS ORDINANCE
BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT
AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS
ACCORDINGLY SO ORDAINED THIS THE DAY OF AUGUST, 1963.

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE-
GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR
THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCIL; I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO-
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
