HomeMy WebLinkAbout07001 ORD - 08/14/1963..� JKH:7 -31 -63 AN ORDINANCE CLOSING A DEDICATED BUT UNDEVELOPED 60 -FOOT STREET BETWEEN LOTS 6 AND 7 AND 10 AND 11, SEC. 5, RANGE VIII, GUGENHEIM & COHN'S FARM LOTS, NEAR THE INTER- SECTION OF THE OLD BROWNSVILLE ROAD AND LEXINGTON BOULEVARD, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; AND DECLARING AN EMERGENCY. WHEREAS, NOTICE OF THE INTENTION OF CLOSING A DEDICATED, UNDEVELOPED w. I 60 -FOOT STREET BETWEEN LOTS 6 AND 7 AND 10 AND 11, SECTION 5, RANGE VIII, GUGENHEIM AND COHN'S FARM LOTS, NEAR THE INTERSECTION OF THE OLD BROWNSVILLE ROAD AND LEXINGTON BOULEVARD, HAS BEEN GIVEN BY PUBLICATION AND REGISTERED MAIL TO THE LAST KNOWN ADDRESS OF ALL OWNERS ABUTTING SAID UNDEVELOPED STREET AND WITHIN 450 FEET THEREOF, AND THEREAFTER, PURSUANT TO SAID NOTICE, A PUBLIC HEARING WAS HELD ON JULY 24, 1963, BY THE CITY COUNCIL IN ACCORDANCE WITH THE PROVISIONS OF THE CITY CHARTER; AND WHEREAS, IT HAS BEEN DETERMINED BY THE CITY COUNCIL, AFTER SUCH PUBLIC HEARING, THAT THE SAID AREA IS NOT NEEDED AS A PUBLIC STREET, AND THAT THE SAME WILL NOT BE NEEDED FOR A PUBLIC STREET WITHIN THE FORESEEABLE FUTURE; AND WHEREAS, IT HAS BEEN DETERMINED THAT IT WILL BE TO THE ADVANTAGE OF THE CITY TO ABANDON SAID AREA AS A PUBLIC STREET SO THAT THE SAME MAY BE USED BY THE ABUTTING PROPERTY OWNERS FOR OTHER PURPOSES: NOW,IHEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THERE IS HEREBY CLOSED FOR PUBLIC USE THAT 60 -FOOT DEDICATED BUT UNDEVELOPED STREET BETWEEN LOTS 6 AND 7 AND 10 AND 11, SECTION 5, RANGE VIII, GUGENHEIM AND COHN'S FARM LOTS, NEAR THE INTERSECTION OF THE OLD BROWNSVILLE ROAD AND LEXINGTON BOULEVARD, AS SHOWN ON THE MAP OF SAID STREET EASEMENT ATTACHED HERETO AND MADE A PART HEREOF, AND ABANDONING THE SAME TO THE ABUTN NG PROPERTY OWNERS. SECTION 2. THE FACT THAT THE PUBLIC CONVENIENCE AND NECESSITY WOULD BE BETTER SERVED BY THE CLOSING OF THE AREA HEREINABOVE DESCRIBED AND THE ABANDONING OF THE PROPERTY TO THE ABUTTING PROPERTY OWNERS CREATES A 7001 0 PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPEN- SION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND aFTER ITS PASSAGES IT IS ACCORDINGLY SO ORDAINED THIS THE DAY OF V/1.4�YL /c/ 1963.
