AN ORDINANCE
CLOSING A PORTION OF DENVER STREET, DESCRIBED AS
THE EAST 15 FEET OF THE RIGHT -OF -WAY OF DENVER
STREET THAT ABUTS LOTS 33 THROUGH 64, INCLUSIVE,
BLOCK 15, PORT ARANSAS CLIFFS SUBDIVISION, AND
THE WEST 15 FEET OF THE RIGHT-OF-WAY OF DENVER
STREET THAT ABUTS LOTS 1 THROUGH 8, INCLUSIVE,
BLOCK 115, PORT ARANSAS CLIFFS SUBDIVISION; RE-
TAINING THE FULL 15 FOOT STRIPS ABOVE DESCRIBED
AS UTILITY EASEMENTS; AND DECLARING AN EMERGENCY.
WHEREAS, NOTICE OF THE INTENTION OF HOLDING A HEARING CONCERNING
THE CLOSING OF A PORTION OF DENVER STREET DESCRIBED A$ THE EAST 15 FEET
OF THE RIGHT -OF -WAY OF DENVER STREET THAT ABUTS LOTS 33 THROUGH 64, IN-
CLUSIVE, BLOCK 15, PORT ARANSAS CLIFFS SUBDIVISION, AND THAT PORTION OF
DENVER STREET DESCRIBED AS THE WEST 15 FEET OF THE RIGHT -OF -WAY OF DENVER
STREET THAT ABUTS LOTS 1 THROUGH 8, BLOCK 115, PORT ARANSAS CLIFFS SUB-
DIVISION, HAS BEEN GIVEN BY PUBLICATION AND REGISTERED MAIL TO THE LAST
KNOWN ADDRESS OF ALL OWNERS OF PROPERTY ABUTTING SAID STREET AND WITHIN
450 FEET THEREOF, AND THEREAFTER, PURSUANT TO SAID NOTICE, A PUBLIC HEARING
WAS HELD ON AUGUST 145 1963, BY THE CITY COUNCIL IN ACCORDANCE WITH THE
PROVISIONS OF THE CITY CHARTER; AND
WHEREAS, IT HAS BEEN DETERMINED BY THE CITY COUNCIL AFTER SUCH
HEARING THAT THE SAID AREA IS NOT NEEDED AS A PUBLIC STREET BUT IS NEEDED
AS A UTILITY EASEMENT RIGHT -OF -WAY AND THAT SAID AREA WILL NOT BE NEEDED
AS A PUBLIC STREET WITHIN THE FORESEEABLE FUTURE; AND
WHEREAS, IT HAS BEEN DETERMINED THAT IT WILL BE TO THE ADVANTAGE
OF THE CITY TO ABANDON SAID PORTION OF SAID STREET AS A PUBLIC STREET SO
THAT THE SAME MAY BE USED BY THE ABUTTING PROPERTY OWNERS FOR OTHER PUR-
POSES, SUBJECT, HOWEVER, TO THE RETENTION BY THE CITY OF SAID AREA AS A
PUBLIC UTILITY RIGHT -OF -WAY:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. THERE IS HEREBY CLOSED FOR PUBLIC USE THAT PORTION
OF DENVER STREET DESCRIBED AS THE EAST 15 FEET OF THE RIGHT -OF -WAY OF
DENVER STREET THAT ABUTS LOTS 33 THROUGH 64, INCLUSIVE, BLOCK 15, PORT

ARANSAS CLIFFS SUBDIVISION, AND THE WEST 15 FEET OF THE RIGHT -OF -WAY OF
DENVER STREET THAT ABUTS LOTS 1 THROUGH H, INCLUSIVE, BLOCK 115, PORT
ARANSAS CLIFFS SUBDIVISION, SUBJECT TO THE RETENTION BY THE CITY OF SAID
AREA AS A PUBLIC UTILITY RIGHT -OF -WAY.
SECTION 2. THE FACT THAT THE PUBLIC CONVENIENCE AND NECESSITY
WOULD BE BETTER SERVED BY THE CLOSING OF THE SAID STREET CREATES A PUBLIC
EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF
THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY
ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL
BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING
DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION
OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE
OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM
AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE �/ DAY
