HomeMy WebLinkAbout07021 ORD - 09/11/1963IMS:JKH:9 -11 -63 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE AND DELIVER A LEASE IN THE FORM PROVIDED IN ORDINANCE NO. 6654, BUT WITH THE DELETION OF SUBSECTION (B) OF CONDITION 1, CONCERNING 113.77 ACRES OF LAND LOCATED AT THE INTERNATIONAL AIRPORT, DESIGNATED AS TRACT "B" WITH TOM SLAY AS SUBSTITUTE LESSEE FOR THE ORIGINAL LESSEE NAMED IN SAID ORDINANCE NO. 6654, FOR A TERM OF FIVE (5) YEARS, BEGINNING AUGUST 15, 1962; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION-1. THAT,THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED TO ENTER INTO A FARM LEASE FOR A TERM OF FIVE YEARS WITH TOM SLAY AS SUBSTITUTE LESSEE FOR THE ORIGINAL LESSEE NAMED IN ORDINANCE N0. 6654, SAID FARM LEASE TO BE IN THE FORM PROVIDED IN ORDINANCE No. 6654, BUT WITH THE DELETION OF SUBSECTION (B) OF CONDITION 1, CONCERNING 113.77 ACRES OF LAND LOCATED AT THE INTERNATIONAL AIRPORT, DESIGNATED AS TRACT MORE PARTICULARLY DESCRIBED AS FOLLOWS: AN AREA OF 113.77 ACRES HAVING ITS WEST LINE PARALLEL TO AND 285 FEET EAST OF THE CENTERLINE OF THE PAVEMENT OF THE AIRPORT ENTRANCE ROAD, FORMERLY STATE FM 763, AND EXTENDING 2665 FEET FROM HIGHWAY 44 SOUTHWARD TO A POINT; THENCE EAST 210 FEET FOR AN INSIDE CORNER; THENCE SOUTH 420 FEET FOR THE SOUTHWEST CORNER; THENCE EAST 750 FEET TO A CORNER; I i THENCE NORTH PARALLEL TO SAID ENTRANCE ROAD NORTH 1250 FEET TO THE NORTH EDGE OF THE DRAINAGE DITCH; a THENCE ALONG THE NORTH EDGE OF SAID DRAINAGE DITCH TO THE DRAINAGE DITCH APPROXIMATELY 600 FEET WEST OF NEW FM ROAD 763; , THENCE ALONG THE WEST EDGE OF SAID DRAINAGE DITCH TO A POINT APPROXIMATELY 150 FEET FROM TEX -MEX RIGHT OF WAY AND BEING THE SOUTH LINE OF STATE HIGHWAY 44; THENCE ALONG THE SOUTH RIGHT OF WAY OF HIGHWAY44 TO THE PLACE OF BEGINNING, SAVE AND EXCEPT THAT THERE IS EXCLUDED THE DRAINAGE DITCH RUNNING THROUGH SAID TRACT, APPROXIMATELY p,, PARALLEL TO STATE HIGHWAY,44 AND APPROXIMATELY 1800 FEET THEREFROM, SAID LEASE TERM TO BEGIN AUGUST 15, 1962. SAID LEASE SHALL PROVIDE A RIGHT OF TERMINATION IN THE CITY UNDER CERTAIN CONDITIONS WHERE AN OPPORTUNITY TO USE ALL OR ANY PORTION OF SAID LAND FOR USES RELATED TO AIRPORT USE`ARE PRESENTED TO THE CITY. 7021L SECTION 2. THE NECESSITY FOR IMMEDIATELY AUTHORIZING A SUBSTITUTE TENANT TO ASSUME THE OBLIGATIONS AND PROCEED WITH CULTIVATION OF THE LAND DESCRIBED IN SAID LEASE CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINA`CE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECES- SITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF THE SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT a IS ACCORDINGLY SO ORDAINED, THIS THE J I DAY OF SEPTEMBER, 1963. ATTEST• M THE CITY OF CORPUS CHRISTI, TEXAS CITY SECRETARY APPROVED AS TO LEGAL FORM THI AY OF SEPTEMBER, 1963: CITY ATTORNEY TO THE MEMBERS OF THE CITY COUNCIL CORPUS CHRISTI, TEXAS CORPUS CHRISTI, TEXAS DAY OF 9_0 FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE- GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO- DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
