HomeMy WebLinkAbout07027 ORD - 09/18/1963IMS:JKH:9 -16 -63 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, A REVOCABLE EASEMENT TO WESTWOOD CENTER, INC., TO PLACE A 6" SANITARY SEWER DISPOSAL LINE IN LABRANCH STREET, THIS REVOCABLE EASEMENT BEING 10 FEET IN WIDTH, NORTH OF AND ADJACENT TO THE SOUTH BOUNDARY LINE OF LABRANCH STREET EXTENDING WESTWARD FROM A POINT APPROXIMATELY 100 FEET WEST OF WESTWOOD DRIVE FOR A DISTANCE OF 615 FEET, A COPY OF WHICK EASEMENT IS ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. WHEREAS, THE CITY HAS REQUIRED THE OBTAINING OF PROPER AUTHORITY FROM THE CITY TO MAINTAIN A PRIVATE SANITARY SEWER DISPOSAL LINE IN THE PUBLIC RIGHT OF WAY OF LABRANCH STREET; AND WHEREAS, THE CITY AND THE PROPERTY OWNER PROPOSING TO CONSTRUCT, OPERATE AND MAINTAIN SAID SANITARY SEWER LINE HAVE AGREED UPON THE LOCATION AND OBLIGATIONS OF SAID LINE AND THE CITY IS DESIROUS OF AUTHORIZING THE EXISTENCE OF SAID LINE UNDER THE AUTHORITY OF THE CITY TO REGULATE AND CONTROL ALL INSTALLATIONS WITHIN THE PUBLIC STREETS OF THE CITY: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A REVOCABLE EASEMENT TO WESTWOOD CENTER, INC., TO PLACE A 6'. SANITARY SEWER DISPOSAL LINE IN LABRANCH STREET] THIS REVOCABLE EASEMENT BEING 10 FEET IN WIDTH, NORTH OF AND ADJACENT TO THE SOUTH BOUNDARY LINE OF LABRANCH STREET EXTENDING WESTWARD FROM A POINT APPROXIMATELY 100 FEET WEST OF WESTWOOD DRIVE FOR A DISTANCE OF 615 FEET, A COPY OF WHICH EASEMENT IS ATTACHED HERETO AND MADE A PART HEREOF. SECTION 2.
