AN ORDINANCE
RECEIVING AND ACCEPTING THE CONSTRUCTION OF
THE UPPER McARDLE STORM SEINER, PROJECT NO.
295- 61 -22, AS PERFORMED BY THE CONTRACTOR,
FOWCO CONSTRUCTION COMPANY, UNDER THEIR CON-
TRACT DATED JUNE 262 1963, AUTHORIZED BY ORDI-
NANCE NO. 6941; AUTHORIZING PAYMENT OF FINAL
ESTIMATE NO. 3 IN THE AMOUNT OF $10,$98.07,
DATED SEPTEMBER 26, 1963, A COPY OF WHICH IS
ATTACHED HERETO AND MADE A PART HEREOF, SAID
PAYMENT TO BE MADE FROM NO. 295 STORM SEWER
BOND FUNDS PREVIOUSLY APPROPRIATED FOR CON-
STRUCTION AND CONTINGENCIES; AND DECLARING
AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. THAT THE CONSTRUCTION OF THE UPPER MCARDLE STORM
SEWER, PROJECT NO. 295- 61 -22, AS PERFORMED BY THE CONTRACTOR, FOWCO
CONSTRUCTION COMPANY, UNDER THEIR CONTRACT DATED JUNE 26, 1963, AUTHORIZED
BY ORDINANCE No. 6941, HAVING BEEN PERFORMED AND COMPLETED IN ACCORDANCE
WITH THE TERMS AND PROVISIONS OF THE CONTRACT, PLANS AND SPECIFICATIONS
THEREIN CONTAINED, AND THE DIRECTOR OF PUBLIC WORKS HAVING INSPECTED +

THE SAME AND CERTIFIED TO THE COMPLETION OF SAID WORK IN ACCORDANCE WITH
SAID PLANS AND SPECIFICATIONS, THE WORK AFORESAID IS HEREBY FOUND TO
HAVE BEEN COMPLETED IN ACCORDANCE WITH ME PLANS AND SPECIFICATIONS AND
IS HERE AND NOW ACCEPTED AND RECEIVED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS.
SECTION 2. THAT FINAL PAYMENT DUE UNDER THE CONTRACT AND AS
SET OUT IN FINAL ESTIMATE N0. 3, DATED SEPTEMBER 26, 1963, ATTACHED
HERETO AND MADE A PART HEREOF, PREPARED BY THE DEPARTMENT OF PUBLIC WORKS
AND APPROVED BY THE DIRECTOR OF PUBLIC WORKS, IN THE AMOUNT OF $10,898.07,
OUT OF N0. 295 STORM SEWER BOND FUNDS, PREVIOUSLY APPROPRIATED FOR
CONSTRUCTION AND CONTINGENCIES,-)S HEREBY AUTHORIZED.
SECTION 3. THE NECES §ITY FOR COMPLETION OF SUCH WORK BY
SAID ACCEPTANCE AND FINAL PAYMENT IMMEDIATELY CREATES A PUBLIC EMERGENCY
AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER
RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE
DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE

READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING
DECLARED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE
PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN
FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE-
GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR
THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCIL; 1, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO-
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
