HomeMy WebLinkAbout07045 ORD - 10/09/1963I- — IMS:JKH:9 -20 -63 AN ORDINANCE AMENDING THE CORPUS CHRISTI CODE, 1958, AS AMENDED, BY ADDING A NEW SECTION TO ARTICLE IV IMMEDIATELY FOLLOWING SECTION 9 -10, TO BE DESI NATED AS SECTION 9 -10A, PRO- HIBITING CERTAIN USES Or THE BARGE DOCK; AMENDING SECTION 9 -46, REGULATING SIGN ADVERTISING OF COMMERCIAL AND CHARTER VESSELS; AMENDING SECTION 9 -47, REGULATING ERECTION AND MAINTENANCE OF AWNINGS; ADDING A NEW SECTION TO ARTICLE IV IMMEDIATELY FOLLOWING SECTION 9 -47, TO BE DESIGNATED AS SECTION 9 -47A, REGULATING GEAR BOXES AND TICKET BOOTHS; AMENDING SECTION 9 -56, REGULATING USE OF WATER; AND ADDING A NEW SECTION TO ARTICLE IV IMMEDIATELY FOLLOWING SECTION 9 -56, TO BE DESIGNATED AS SECTION 9 -56A, REGULATING THE USE OF ELECTRICITY; PROVIDING A PENALTY FOR VIOLATION; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; PROVIDING AN EFFECTIVE DATE; AND PROVID- ING FOR PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CORPUS CHRISTI CODE, 1958, AS AMENDED, BE AND THE SAME IS HEREBY AMENDED BY ADDING A NEW SECTION TO ARTICLE IV IMMEDI- ATELY FOLLOWING SECTION 9 -10, WHICH NEW SECTION SHALL BE NUMBERED SECTION 9 -10A, AND READ AS FOLLOWS: , "SECTION 9 -10A. BARGE DOCK -- CERTAIN USES PROHIBITED. THE CITY BARGE DOCK IS HEREBY DESIGNATED A COMMERCIAL AREA AND NO PERSON SHALL ENTER THE BAY WATERS FROM SUCH BARGE DOCK. NO BOATS SHALL BE LAUNCHED FROM THE BARGE DOCK. No PERSON SHALL DOCK ANY BOAT SMALLER THAN,25 FEET IN LENGTH MEASURED AT THE WATER LINE, AT THE BARGE DOCK. EACH VIOLATION SHALL BE CONSIDERED A SEPARATE OFFENSE." SECTION 2. THAT THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BE AMENDED BY CHANGING SECTION 9 -46 SO AS TO HEREAFTER READ AS FOLLOWS: "SECTION 9 -46. REGULATIONS OF SIGNS ADVERTISING COMMERCIAL AND CHARTER VESSELS. WHERE ANY SIGN IS DISPLAYED REGARDING ANY VESSEL CARRYING PERSONS OR FREIGHT FOR HIRE, SUCH VESSEL SHALL BE SUBJECT TO THE FOLLOWING REGULA- TIONS CONCERNING SIGNS ADVERTISING SUCH VESSELS: wfCl'3,ci+ r� A. THERE SHALL BE NO MORE THAN ONE SIGNBOARD REFERRING TO ANY BOAT. SUCH SIGNBOARD MAY BE PAINTED AND CONTAIN A SIGN ON TWO SIDES OF SAID SIGNBOARD,.' B. NO SIGNBOARD SHALL EXCEED 4 FEET IN HEIGHT, NOR EXCEED 8 FEET IN WIDTH. C. NO SIGNBOARDS SHALL BE ERECTED OR MAINTAINED WHICH EXTEND LOWER THAN 7 FEET OR HIGHER THAN 12 FEET ABOVE THE LEVEL OF THE PAVED OR SIDEWALK AREA IMMEDIATELY BELOW THE SIGN. D. No SIGN SHALL BE ERECTED OR MAINTAINED EXCEPT WITH THE WRITTEN APPROVAL OF THE MARINA SUPERVISOR AND UNDER A BUILDING PERMIT OBTAINED FROM THE INSPECTION SECTION OF THE DEPARTMENT OF PUBLIC WORKS OF THE CITY OF CORPUS CHRISTI. E. NO SIGN SHALL BE PLACED, PAINTED OR MAINTAINED ON ANY GEAR BOX. F. No SIGN SHALL BE USED OR MAINTAINED WHICH IS NOT PERMANENTLY ATTACHED TO SUBSTANTIAL SUPPORTS IN A MANNER APPROVED BY THE CITY BUILDING CODE. G. :No SIGN SHALL BE PLACED OR MAINTAINED ON ANY TICKET BOOTH WHICH HAS ANY LETTERS IN EXCESS OF 6 INCHES IN HEIGHT NOR SHALL THE NAME OF THE CHARTER VESSEL FOR WHICH SUCH TICKET BOOTH IS MAINTAINED CONTAIN THE NAME OF SUCH VESSEL MORE THAN ONCE ON SAID TICKET BOOTH. THE ONE SIGN PERTAINING TO ANY VESSEL MAY BE ERECTED AND MAINTAINED IN ADDITION TO ANY SIGN WHICH MAY BE PLACED OR MAINTAINED ON THE EXTERIOR SURFACE OF ANY TICKET BOOTH. H. ALL SIGNBOARDS SUPPORTS THEREOF AND THE PAINTING ON ALL TICKET BOOTHS SHALL BE KEPT AND MAINTAINED IN A GOOD STATE OF REPAIR AT ALL TIMES. ANY PERSON PERMITTING ANY SIGN -2- PAINTED, PLACED, ERECTED OR EXISTING OR REFERRING TO ANY BOAT OWNED OR OPERATED BY HIM WHICH SIGN IS NOT IN COMPLIANCE WITH ANY OF THE FOREGOING PROVISIONS SHALL BE GUILTY OF A SEPARATE OFFENSE AND EACH PROVISION REGARDING WHICH HE MAY BE IN VIOLATION, AND EACH DAY OF VIOLATION SHALL BE CONSIDERED A SEPARATE OFFENSE." SECTION 3. THAT THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BE AND THE SAME IS HEREBY AMENDED BY AMENDING SECTION 9 -47 TO HEREAFTER READ AS FOLLOWS: "SECTION 9 -47. ERECTION AND MAINTENANCE OF AWNINGS. NO AWNINGS SHALL BE ERECTED OR MAINTAINED EXCEPT THAT EACH SLIP TENANT MAY ERECT AND MAINTAIN NOT MORE THAN TWO AWNINGS APPURTENANT TO EACH BOAT FOR WHICH HE IS A SLIP TENANT. NO AWNINGS SHALL EXTEND BEYOND THE WIDTH OF THE RENTED SLIP AREA AND NO AWNING SHALL BE ERECTED OR MAIN- TAINED IN SUCH A MANNER THAT THE LOWEST PART OF SUCH AWNING IS LESS THAN 7 FEET IN HEIGHT ABOVE THE FLOOR, WALK OR GROUND LEVEL IMMEDIATELY BELOW SUCH AWNINGS. NO AWNING SHALL BE CLOSER TO THE FRONT OR STREET SIDE OF THE CURB BETWEEN THE STREET AND SIDEWALK THAN 2 FEET. NO PERSON SHALL COMMENCE INSTALLATION OF NOR MAINTAIN ANY AWNING IN VIOLATION OF THE FORE- GOING PROVISIONS PRIOR TO OBTAINING THE WRITTEN APPROVAL OF THE MARINA SUPERVISOR OR PRIOR TO OBTAINING A BUILDING PERMIT FROM THE INSPECTION SECTION OF THE DEPARTMENT OF PUBLIC WORKS OF THE CITY NOR PERMIT ANY AWNING TO EXIST IN ANY CONDITION OTHER THAN IN A GOOD STATE OF REPAIR. EACH VIOLATION OF ANY PROVISION OF THIS SECTION SHALL BE A SEPARATE OF- FENSE AND EACH DAY OF VIOLATION SHALL CONSTITUTE A SEPARATE OFFENSE." SECTION 4. THAT THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BE AND THE SAME IS HEREBY AMENDED BY ADDING A NEW SECTION TO ARTICLE IV TO FOLLOW SECTION 9 -47 AND TO BE DESIGNATED AS SECTION 9 -47A AND WHICH NEW SECTION HEREBY ADOPTED SHALL READ AS FOLLOWS: -3- "SECTION 9 -47A. GEAR BOXES AND TICKET BOOTHS REGULATED. NO GEAR BOX OR TICKET BOOTH SHALL BE ERECTED OR MAINTAINED EXCEPT BY WRITTEN PERMISSION OF THE MARINA SUPERVISOR AND UNDER A PERMIT FROM THE INSPECTION SECTION OF THE DEPARTMENT OF PUBLIC WORKS OF THE CITY, AND THEN ONLY IN ACCORDANCE WITH THE FOLLOWING REGULATIONS: A. PERTAINING TO EACH CHARTER VESSEL, THERE SHALL BE NOT IN EXCESS OF ONE TICKET BOOTH NOR IN EXCESS OF TWO GEAR BOXES. B. ALL GEAR BOXES SHALL BE OF A DESIGN AND SPECIFICATIONS APPROVED BY THE MARINA SUPERVISOR AND THE DIRECTOR OF PARKS AND RECREATION OF THE CITY OF CORPUS CHRISTI BUT IN NO EVENT SHALL ANY GEAR BOX EXCEED IN SIZE 4 FEET IN HEIGHT, 4 FEET IN WIDTH AND 8 FEET IN LENGTH AND NO TICKET BOOTH SHALL EXCEED 7 FEET IN HEIGHT, AND 4 FEET IN WIDTH AND 4 FEET IN LENGTH. NO COMBINED GEAR BOX- TICKET BOOTH SHALL EXCEED 12 FEET IN LENGTH NOR 4 FEET IN WIDTH. ALL GEAR BOXES AND ALL TICKET BOOTHS AND ALL COMBINED GEAR BOX- TICKET BOOTHS SHALL BE KEPT AND MAINTAINED IN A GOOD STATE OF REPAIR AND WELL - PAINTED AT ALL TIMES. NO PERSON SHALL PERMIT THE'EXISTENCE OF NOR MAINTAIN ANY GEAR BOX, TICKET BOOTH OR COMBINED GEAR BOX - TICKET BOOTH IN VIOLATION OF ANY OF THE FOREGOING PROVISIONS. THE VIOLATION OF EACH OF THE FOREGOING PROVISIONS SHALL CONSTITUTE A SEPARATE OFFENSE AND EACH DAY OF VIOLATION SHALL CONSTITUTE A SEPARATE OFFENSE." SECTION 5. THAT THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BE AND THE SAME IS HEREBY AMENDED BY AMENDING SECTION 9 =56 SO AS TO HEREAFTER READ AS FOLLOWS% "SECTION 9 -56. USE OF WATER. A. THE OWNER OR OPERATOR OF EACH VESSEL OCCUPYING -4- A SLIP OR DOCKING IN THE CORPUS CHRISTI MARINA SHALL FURNISH SAID VESSEL WITH A HOSE THAT HAS A POSITIVE SHUTOFF AT THE OUTBOARD END. B. NO PERSON SHALL CONNECT THE CITY'S WATER SYSTEM TO THE BILGE OF ANY VESSEL, THE WATER IN THE MARINAS OR ANY OTHER WATER OR FLUID. THE USE OF A WATER POWERED SIPHON OR EJECTOR (COMMONLY KNOWN AS A 'JET PUMP) BY ANY PERSON IN THE CORPUS CHRISTI MARINA IS STRICTLY FORBIDDEN" SECTION 6. THAT THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED BE AND THE SAME IS HEREBY AMENDED BY ADDING A NEW SECTION TO ARTICLE IV TO FOLLOW SECTION 9 -56 AND NUMBERED SECTION 9 -56A AND READING AS FOLLOWS: "SECTION 9 -56A. USE OF ELECTRICITY. ELECTRICITY MAY BE USED FROM THE WIRING CONNECTIONS OF THE CITY BY SLIP TENANTS WHOSE BOATS ARE FOR PRIVATE USE ONLY. SLIP TENANTS SHALL OBTAIN THEIR OWN SOURCE OF ELECTRICITY AND AT THEIR OWN EXPENSE MAKE ANY CONNECTIONS REQUIRED WHEREVER ANY BOAT IS USED FOR COMMERCIAL USE OR AS A CHARTER BOAT AND IS HIRED FOR CARRYING FREIGHT OR PASSENGERS." SECTION 7. ANY PERSON, FIRM, CORPORATION OR ASSOCIATION WHO VIOLATES ANY OF THE PROVISIONS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION THEREOF, SHALL BE PUNISHED BY A FINE OF NOT MORE THAN TWO HUNDRED DOLLARS ($200.00), AND EACH AND EVERY DAY OF CONTINUANCE THEREOF SHALL CONSTITUTE A DISTINCT AND SEPARATE OFFENSE. SECTION 8. ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH ARE HEREBY REPEALED. SECTION 9. IF FOR ANY REASON ANY SECTION, PARAGRAPH, SUBDIVI- SION, CLAUSE, PHRASE OR PROVISION OF THIS ORDINANCE SHALL BE HELD INVALID, IT SHALL NOT AFFECT ANY VALID PROVISIONS OF THIS OR ANY OTHER ORDINANCE OF THE CITY OF CORPUS CHRISTI TO WHICH THESE RULES AND REGULATIONS RELATE. SECTION 10. THIS ORDINANCE SHALL TAKE EFFECT FROM:AND AFTER ITS FINAL PASSAGE AND PUBLICATION. -5- SECTION 11. PUBLICATION SHALL BE MADE IN THE OFFICIAL PUBLICA- TION OF THE CITY OF CORPUS CHRISTI, ONE TIME, WHICH PUBLICATION SHALL CON- TAIN THE CAPTION STATING IN SUBSTANCE THE PURPOSE OF THE ORDINANCE.
