AN ORDINANCE PROVIDING FOR THE APPROVAL OF THE AGREEMENT DATED NOVEmBm 1, 1963
BETWEEN THE STATE OF TEXAS AND THE CITY OF CORPUS CHRISTI FOR THE
CONTINUED EXISTENCE, USE, OPERATION, AND MAINTENANCE OF HIGHWAY TRAFFIC SIGNAL(S)
AT THE LOCATIONS) SHOWN ON EXHIBIT 1, ATTACHED HERETO AND MADE A PART HEREOF, IN
THE CITY OF CORPUS CHR=T ; PROVIDING FOR THE EXECUTION OF SAID AGREE-
MENT; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI
SECTION 1. That the certain agreement dated Noyemher �_ is q between the State
of Texas and the City of Corpus Christi for the continued existence,
use, operation, and maintenance of certain highway traffic signals) at the loca-
tion(79) shown on EXHIBIT 1, attached hereto and made a part hereof, in the City of
Corpus Christi be and the same is hereby approved, and Herbert W.
Whitney, City Manager is hereby authorized to execute said agreement on
behalf of the City of Corpus Christi and to transmit the same to the
State of Texas for appropriate action.
SECTION 2. The fact that the existing highway traffic signal(m) named in the above
mentioned is (are) needed, creates an emergency which for the immediate preservation
of the public peace, health, safety, and general welfare requires that this Ordi-
nance take effect immediately from and after its passage, and it is accordingly
so ordained.

This AGREEMENT, made this 1st day of November . 1963_,
by and between the State of Texas, hereinafter called the "State," Party of the
First Part; and the City of Corpus Christi Nueces County,
Texas, acting by and through its duly authorized officers under an rdinanc passed
the day of , 19 , hereinafter called the "City,"
Party of the Second Part:

W I T N E S S E T H
WHEREAS, there is (aas) (a) highway traffic signal(s) in place at the
location(a) shown on EXiIIBIT 1, attached hereto and made a part hereof, said
highway traffic signal(a) having been installed, operated, and maintained by the
State at a time when said location(a) was (were) not within the corporate limits
of the City; and.
WHEREAS, said location(e) is (are) now within the corporate limits of
the City; and
WHEREAS, it is not the policy of the State to install, operate, or main-
tain highway traffic signals inside the corporate limits of cities of 5,000 popu-
lation and over (latest Federal Census), except on expressway type of construction;
and
WHEREAS, the City has requested the State to leave the highway traffic-
signal(e) in place at the location(&) shown on EXHIBIT 1 and has authorized the
continued existence, use, operation, and maintenance of the highway traffic
signal(s) by Rcsclticn passed on the day of , 19

NOW, therefore, in consideration of the premises and of the mutual cove-
nants and agreements of the parties hereto to be by them respectively kept and J
performed, as hereinafter set forth, it is agreed as follows:
1. The State will leave the highway traffic signal(c) in place at the
location(a) shown on EXBIBIT 1. The plans for the highway traffic signal instal -
lation(a) are attached hereto, marked iXFIIBIT 2, and made a part hereof.
2. The City will operate and maintain the signal(a).
•3. The City will pay all power costs for operating the signal(s).
4. The City will return any and all parts of said highway traffic signal
installations) to the State should it (44tey4 be removed by the City for any reason
other than for installation on a State or Federal numbered highway route at a
location approved by the State.
5. In the event the terms of this Agreement are in conflict with the
provisions of any other existing Agreements and /or Contracts between the City and
the State, this Agreement shall take precedence over the other Agreements and /or.
Contracts.

RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCIL; 1, THEREFORE2 HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO -
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL,
RESPECTFULLY,
