AND POULTRY FOR HUMAN FOOD, AND PROVIDING FOR THE COLLECTION OF SAID FEES, AND PROVIDING FOR CERTAIN REPORTS TO BE MADE BY ESTABLISHMENTS TO WHICH INSPECTION SERVICE IS GRANTED; REPEALING ORDINANCES IN CONFLICT HERE- WITH; CONTAINING A SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING PENALTIES FOR VIOLATION; PROVID- FOR PUBLICATION. WHEREAS, ORDINANCE N0. 6331 PASSED ON NOVEMBER 8, 1961, PROVIDED FOR CERTAIN MEAT INSPECTION FEES; AND WHEREAS, SAID INSPECTION FEES ARE INTENDED TO COVER THE COSTS OF INSPECTION, INCLUDING, BUT NOT LIMITED TO, SALARIES OF INSPECTOR, SUPPLIES, TRANSPORTATION, AND ADMINISTRATIVE OVERHEAD EXPENSES; AND WHEREAS, SAID ORDINANCE HAS BEEN IN EFFECT FOR MORE THAN TWO YEARS, AND BASED ON SAID TWO -YEAR EXPERIENCE THE INSPECTION FEES CONTAINED IN ORDINANCE NO. 6331 ARE NOT SUFFICIENT TO REIMBURSE THE CITY OF CORPUS CHRISTI FOR SAID EXPENSES. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT SECTION 5 OF SAID ORDINANCE NO. 6331 SHALL BE AND IS HEREBY AMENDED TO READ AS FOLLOWS: "SECTION 5. ALL PERSONS, FIRMS, CORPORATIONS AND ASSOCIATIONS WHICH ARE GRANTED MEAT INSPECTION SERVICES BY THE PUBLIC HEALTH DEPARTMENT OF THE CITY OF CORPUS CHRISTI SHALL PAY AN INSPECTION FEE ACCORDING TO THE FOLLOWING SCHEDULE: POUNDS OF MEAT OR MEAT MONTHLY PRODUCTS PROCESSED MONTHLY INSPECTION FEE UP To 500 Les. $ 15.00 UP TO 1,000 LBS. 0.00 1 000 To 5,000 LBS. 5.00 5,000 TO 10,000 LBS. 60.00 10,000 TD 20,000 LBS. 75,00 203000 To 50,000 LBS. 90.00 50,000 To 100;000 Las. 110.60 100,000 TO 150,000 LBS. 125.00 150,000 LBS. UP 150.00 PROVIDED, HOWEVER, ESTABLISHMENTS WHICH HAVE BEEN ASSIGNED THE FULL TIME SERVICES OF ONE OR MORE INSPECTORS SHALL PAY A FEE OF $3.00 PER MAN HOUR FOR 7099 AN EIGHT -HOUR DAY ON MONDAY THROUGH FRIDAY INCLUSIVE; PROVIDED FURTHER, A MEAT PROCESSING ESTABLISHMENT SHALL PAY AN ADDITIONAL FEE EQUAL TO THE ONE AND A HALF HOURLY SALARY OF EACH INSPECTOR WHEN SAID INSPECTOR WORKS ON A SATURDAY, SUNDAY, CITY HOLIDAY, OR FOR MORE THAN EIGHT HOURS ON ANY OTHER DAY. THE PUBLIC HEALTH DEPARTMENT OF THE CITY OF CORPUS CHRISTI SHALL DELIVER AN INVOICE TO EACH ESTABLISHMENT GRANTED INSPECTION SERVICES, WITH A COPY TO THE COLLECTION SUPERVISOR OF THE COLLECTION SUPERVISOR OF THE COLLECTION SECTION OF THE CITY DEPARTMENT OF FINANCE AT THE END OF EACH CALENDAR MONTH OR AS SOON THEREAFTER AS POSSIBLE. SAID ESTABLISHMENT GRANTED INSPECTION SERVICES SHALL PAY THE REQUIRED FEE TO THE COLLECTION SECTION OF THE DEPARTMENT OF FINANCE OF THE CITY OF CORPUS CHRISTI WITHIN TEN DAYS FROM THE DATE THE INVOICE IS DELIVERED TO SAID ESTABLISHMENT. ALL ESTABLISHMENTS GRANTED INSPECTION SERVICES ON A PART -TIME BASIS SHALL SUBMIT A MONTHLY REPORT TO THE DIRECTOR OF PUBLIC HEALTH OF THE CITY, SWORN TO BY AN AUTHORIZED OFFICER OR AGENT OF SAID ESTABLISHMENT, STATING THE NUMBER OF POUNDS OF MEAT OR MEAT FOOD PRODUCTS PROCESSED DURING THE PRECEDING MONTH. SAID REPORT SHALL BE IN ACCORDANCE WITH A FORM PRESCRIBED BY THE DIRECTOR OF PUBLIC HEALTH OF THE CITY OF CORPUS CHRISTI AND SHALL BE FILED AS SOON AS PRACTICAL AFTER THE END OF EACH CALENDAR MONTH, BUT SAID REPORT MUST BE FILED WITHIN TEN DAYS AFTER THE END OF THE PRECEDING CALENDAR MONTH." SECTION 2. ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE ARE HEREBY REPEALED. SECTION 3. IF ANY SECTION, PARAGRAPH, SUBDIVISION, CLAUSE, PHRASE, OR PROVISION OF THIS ORDINANCE SHALL BE ADJUDGED INVALID OR HELD UNCONSTITUTIONAL, THE SAME -SHALL NOT AFFECT THE VALIDITY OF THIS ORDINANCE AS A WHOLE OR ANY PART OR PROVISION THEREOF OTHER THAN THE PORTION SO DECIDED TO BE INVALID OR UNCONSTITUTIONAL. -2- SECTION 4. THIS ORDINANCE SHALL BE EFFECTIVE ON THE FIRST DAY OF THE CALENDAR MONTH FOLLOWING THE PUBLICATION OF THE CAPTION ONCE IN THE OFFICIAL PUBLICATION OF THE CITY OF CORPUS CHRISTI. SECTION 5. ANY PERSON, AGENT OR EMPLOYEE VIOLATING ANY OF THE PROVISIONS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MIS - DEMEANORS AND UPON CONVICTION THEREOF SHALL BE PUNISHED BY A FINE NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00). EACH VIOLATION OF THIS ORDINANCE SHALL CONSTITUTE A SEPARATE OFFENSE.
